Abstract

This research is motivated by the phenomenon of the lack of knowledge or the ability of teachers in making scientific papers, which causes obstruction of the promotion of functional positions of teachers from class IV / a to group IV / b. The approach used in this research is a qualitative approach with descriptive analysis method. The data collection technique is done through observation, interview and documentation study. The results showed that: 1) Forecasting used is a type of "Demand Forecasting", Forecasting is based on long, medium and short term time horizons. However, it does not meet the criteria of good forecasting, that is, it does not meet the standard of accuracy, cost and convenience forecasting. 2) Planning has been implemented properly through the 5W1H answer technique, but the results are not optimal. 3) Organizing has been carried out by compiling the Madrasah organizational structure, but there is no specific organizational structure to facilitate the implementation and coordination of the teacher functional position promotion program. 4) Controlling or control in Madrasah has been carried out through supervision activities, but it is not optimal, because the supervision is not in accordance with standard operating procedures and only to meet administrative reporting needs. 5) Commanding or briefing is carried out by involving civil servant teachers in education and training activities, as well as fostering and motivating PNS teachers to increase the number of credit scores, but the results of the coaching are not optimal. 6) Coordinating or coordination in Madrasahs has been carried out vertically, both internal and external, but the implementation has not been optimal.

Abstract

This article aims to provide guidance for higher education institutions to formulate policies and take action to prevent and handle sexual violence related to the implementation of the Tridharma of Higher Education. The problem is focused on preventing criminal acts of sexual violence in the campus environment. Permendikbudristek Number 30 of 2021 has regulated protection in the form of prevention and how to handle it if sexual violence occurs in the campus environment. In order to approach this problem, theoretical references from Juridical Normativ are used. Data is collected through literature studies that are relevant to the latest material to be studied and analyzed qualitatively. This study concludes that universities are obliged to implement Permenristekdikti Number 30 of 2021 regarding sexual violence in the campus environment and in preventing criminal acts of sexual violence. Universities are obliged to make policies and implement them by creating a PPKS task force in order to create an independent campus, one of which is freedom from violence. sexual intercourse by prioritizing protection for the victim and not recurring.

Abstract

Kecelakaan lalu lintas di wilayah Kabupaten Banjarnegara masih tergolong tinggi, kecelakaan tersebut selain berkaitan dengan korban, juga berkaitan dengan keamanan dalam berkendara orang lain. Pelanggaran lalu lintas dikenakan sesuai dengan tindak pelanggaran yang dilakukan, sanksi dapat diberlakukan berupa denda maupun kurungan penjara. Tujuan dari penelitian ini adalah untuk menjelaskan dan menganalisis penerapan sanksi pidana denda terhadap pelanggaran lalu lintas di Kabupaten Banjarnegara dan untuk menjelaskan dan menganalisis penanggulangan terhadap pelanggaran lalu lintas di Kabupaten Banjarnegara. Metode penelitian yang digunakan adalah penelitian yuridis normatif. Penelitian tipe ini merupakan penelitian yang difokuskan untuk mengkaji penerapan kaidah-kaidah atau norma-norma yang berada di dalam hukum positif. Berdasarkan hasil penelitian, penerapan sanksi pidana denda terhadap pelanggaran lalu lintas di Kabupaten Banjarnegara diatur dalam Pasal 279 hingga Pasal 302 Undang-undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan., yang mana nominal denda yang diterapkan variatif dari denda Rp250.000,- hingga Rp3.000.000,-. Ketentuan-ketentuan yang mengatur tentang Pelanggaran Lalu Lintas termuat dalam Pasal 58, Pasal 60, dan Pasal 128 dalam Peraturan Daerah Kabupaten Banjarnegara Nomor 8 Tahun 2017 Tentang Penyelenggaraan Transportasi. Kemudian upaya penanggulangan dan pengendalian pelanggaran lalu lintas di Kabupaten Banjarnegara dilakukan dengan melaksanakan program-program dan perencanaan sesuai dengan peraturan daerah yang berlaku. Adapun program yang dilakukan oleh aparat penegak hukum adalah ETLE (Electronic Traffic Law Enforcement), sosialisasi dan Oprasi Patuh Candi, dan Operasi Zebra Candi. Kata kunci: lalu lintas; banjarnegara; sanksi denda.

Abstract

Article 2 paragraph 4 of Law no. 48 of 2009 concerning Judicial Powers of Punishment states that trials are carried out in a simple, fast and low cost manner. This principle has been implemented in the implementation of the imposition of caning in Aceh. The implementation is in an open field and ends in 1 day. It is interesting to study from the principles of fast, simple, and low-cost justice. The execution of the caning sentence which ends in 1 day embodies the principle of a fast trial, carried out in the open field by wearing a certain size of rattan, showing a simple trial. The implementation also demonstrates the principle of low-cost justice. In the perspective of the Criminal Code Bill, the implementation of this punishment is based on living law and has been stated in the applicable law in Aceh, realizing the criminal objectives of prevention, fostering perpetrators, restoring balance, and resolving conflicts. Its rationality rests on the laws that live in Aceh, and embodies the principles of fast, simple and low-cost justice. Philosophically, this punishment is built on the basis of the Acehnese people's view of life which relies on philosophical values ​​derived from Islamic law. Sociologically, caning has been around for a long time in Acehnese society. Juridically normative based on the 1945 Constitution, the implementation of caning reflects the law that lives in society as an embodiment of customary units that apply in Acehnese society as stipulated in Article 18 B.
