Abstract

Bunuh diri merupakan upaya yang dilakukan dengan sadar untuk mengakhiri kehidupan, dimana seseorang secara sadar berkeinginan dan berusaha melaksanakan keinginannya untuk mati. Tindakan bunuh diri sendiri, hingga saat ini masih merupakan suatu misteri dengan beragam teori yang melandasinya. Pemaparan mengenai tinjauan hukum dari tindak pidana bunuh diri masih menjadi berbincangan di kalangan ahli hukum. Teori viktimologi mencoba untuk memberikan penjelasan kepastian hukum terkait bunuh diri sekaligus menjelaskan upaya preventif untuk mencegah bunuh diri. Metode penelitian yang digunakan dalam artikel ini adalah penelitian hukum yuridis normatif dengan menganalisa suatu permasalahan hukum melaui studi kepustakaan untuk mengkaji dan menganalisa solusi terhadap permasalahan yang dibahas. Kesimpulan dari penelitian ini adalah dapat diklarifikasi bahwa dalam kajian viktomologi bunuh diri dapat dikategorikan ke dalam sebagai kejahatan tanpa korban dan untuk itu, bunuh diri sebagai kejahatan tanpa korban dapat ditangani dengan menggunakan sarana penal maupun non penal yang bertujuan untuk meminimaliris terjadinya bunuh diri.

Abstract

Extramarital children of Indonesian migrant workers face complex issues of identity and citizenship rights. In Indonesia, extramarital children often do not have birth certificates, which makes it difficult for them to access public services such as schools. The principle of non-discrimination is the most important in legal protection for extramarital children. The rights of children are recognized internationally in the Convention on the Rights of the Child, where the protection of the rights of extramarital children includes the protection of the juridical rights of extramarital children to demand recognition and validation, as well as the management of the citizenship status of the Republic of Indonesia for the child. The following results show that First, the application of the principle of non-discrimination is specifically recognized in the Convention on the Rights of the Child, which underlines the rights of children in the absence of discrimination based on the marital status of their parents and requires States Parties not to discriminate against them. Second, the implementation of children's rights, especially the rights of extramarital children of Indonesian migrant workers in various regulations in Indonesia, needs to be maintained consistently, involving aspects of substance, structure, and cultural values, so that they can provide tangible benefits and are based on a deep sense of justice. Abstract

Evidence of the existence of the enforceability of international law is the reciprocal relationship between members of the international community, one of which can be implemented through international agreements. State relations in international agreements make th e no r m s born of them binding on the parties and make these norms guidelines for third party co untr ie s in entering into international contracts by the provisions applicable in the global legal s y s tem . The research method used in this article is normative legal research with the app ro ach us e d to analyze the problems in this research, including the conceptual approach and th e co m pa r ative approach. This study concludes that Indonesia's engagement as a third party in the 1969 Vienna Convention through the ratification process makes it obligatory to transform the provisions of international treaties in the Convention into its national legalsystem. One o f th e efforts to harmonize the Law on International Treaties with the 1969 Vienna Conventio n is to eliminate reasons of national interest as the reason for terminating participation in international agreements because these reasons are not regulated in the legal norms of international treaties.

Abstract

Etnis minoritas Rohingya mengalami diskriminasi, kekerasan, dan pengusiran oleh pemerintah dan militer Myanmar. Akibatnya, banyak pengungsi Rohingya mencari perlindungan di negara-negara tetangga, seperti Bangladesh, Malaysia, Indonesia, dan Thailand. Namun, dalam perjalanan, mereka menjadi korban perdagangan manusia oleh sindikat kriminal yang mengeksploitasi mereka untuk tujuan seksual, tenaga kerja, atau organ tubuh. Penelitian ini merupakan penelitian kualitatif dengan pendekatan empiris. Hasil penelitian ini menunjukkan bahwa pelanggaran hak asasi manusia dalam perdagangan manusia terhadap pengungsi Rohingya terjadi dalam berbagai bentuk dan tingkat, yang melibatkan berbagai aktor, baik negara maupun non-negara. Kasus perdagangan manusia di Asia Tenggara, khususnya yang melibatkan etnis Rohingya, juga dipengaruhi oleh berbagai faktor yang mencakup kekerasan dan diskriminasi, kurangnya sumber daya dan lapangan kerja, kondisi keamanan yang buruk, keterbatasan sumber makanan, keterlibatan organisasi kriminal, dan keterbatasan kapasitas ASEAN dalam menangani masalah ini. Upaya perlindungan dan pencegahan terhadap perdagangan manusia terhadap pengungsi Rohingya juga masih belum memadai, baik dari sisi hukum, kebijakan, maupun praktik.
