Abstract

Jalanan merupakan suatu pengantar yang dimana dinamikanya mempermudah pengguna jalan dan terhindarnya dari hal yang membawa pada kecelakaan dan seringkali terjadi kerusakan. Beberapa kasus kerusakan jalan sering terjadi kelambatan pemerintah di dalam meresponnya. Rumusan masalah yang diangkat, yakni: 1) bagaimana pertanggungjawaban pemerintah daerah terhadap jalanan yang rusak ditinjau dengan status pengelolaan jalan; dan 2) bagaimana sinergitas antara pemerintah pusat dan daerah dalam merespon kesenjangan kewenangan atas jalanan yang rusak di daerah. Metode penelitian yang dipakai adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini menjelaskan bahwa pemerintah daerah memiliki kewenangan di dalam memperbaiki jalanan rusak yang merupakan ranahnya dengan ditambah kewenangan penindaklanjutan sementara atas jalan nasional. Sinergitas antara pemerintah pusat dan daerah dalam penindaklanjutan jalanan yang rusak baik jalan nasional maupun jalan provinsi atau kabupaten/kota dapat dilakukan dengan cara mendirikan atau membangun suatu sistem satu pintu dalam hal pelaporan atas jalanan yang rusak tersebut.

Abstract

Technology has become an integral element in human life, influencing almost every aspect from daily activities to industrial development. Technology brings various conveniences, such as automation of industrial processes, increased efficiency in various sectors, and fast access to information. Advances in information and communications technology have provided a platform for fraudsters to devise investment schemes that are increasingly sophisticated and difficult to detect. These technology-based investment scams often utilize social media, email and fake websites to attract victims with the promise of high profits in a short time. Technology also allows fraudsters to hide their identities and makes it difficult to trace stolen funds. Education and public awareness are also key in preventing victims from falling into the trap of investment fraud. In order to reduce the risk and impact of technology-based investment fraud, collaboration between government, the technology industry and society is essential.

Abstract

The development of financial technology has brought significant changes to the banking industry, especially with the emergence of financial technology (Fintech) and digital banks. This research examines the analysis of fintech regulations and their implications for digital bank operations in Indonesia. It focuses on the goal of identifying the impact of fintech regulations on digital banks as well as the legal challenges digital banks face in maintaining consumer data security. Through a normative juridical approach, this research examines related regulations, such as OJK Regulation No. 13/POJK.02/2018 concerning digital financial innovation and Bank Indonesia Regulation No. 19/12/PBI/2017 concerning the implementation of financial technology. The research results show that fintech regulations influence digital bank operations by creating a legal environment that impacts business models, operational strategies, and digital bank product innovation. Strict regulations, although aimed at increasing consumer confidence and preventing unhealthy financial practices, can limit the innovation and flexibility of digital banks. In addition, digital banks are faced with legal challenges regarding consumer data security, which require compliance with personal data protection regulations. This research provides important insights for regulators, digital banks, and related industry players to understand the complexity of fintech regulations and maintain a balance between technological innovation, data security, and consumer protection in the digital financial industry in Indonesia.

Abstract

As the largest archipelago with vast marine territory, Indonesia bears great responsibility in maintaining maritime security and sovereignty. The challenges faced include transnational crimes such as illegal fishing, smuggling of goods and drugs, as well as the threat of terrorism and piracy. Therefore, the national defence and security system, especially at sea, must be a priority. The Navy has a major role in maintaining territorial integrity, enforcing the law, and protecting the country from various threats. This research uses the normative juridical method, which examines the existence of jurisdictional law by adopting a historical perspective and involving various sources such as journal articles and legal commentaries. To maintain the sovereignty and security of territorial waters, Indonesia needs a strong maritime defence system. Law enforcement in the Zona Ekonomi Eksklusif (ZEE) is crucial to maintaining sovereignty over Indonesia's marine natural resources. This research aims to examine Indonesia's great responsibility in maintaining maritime security and sovereignty as the largest archipelago and analyse the main role of the Indonesian Navy in maintaining territorial integrity and enforcing the law in Indonesian waters.

Abstract

The rapid rise of online gambling in Indonesia stems from economic hardship, limited legal awareness, and the exploitation of digital technologies for illegal activities. This study aims to examine the accountability of the Ministry of Communication and Digital Affairs (Komdigi) in combating online gambling through a normative juridical approach. The central issue addressed is how Komdigi’s legal authority and strategic role are implemented in managing a secure digital space. The research applies a normative legal method by analysing relevant legislation and administrative practices. Findings indicate that Komdigi has exercised its mandate through AI-based detection systems, public reporting platforms, and inter-agency collaboration with the Financial Services Authority (OJK), the Financial Transaction Reports and Analysis Center (PPATK), and the National Police to block access and take enforcement actions. This research is novel in its mapping of cross-sectoral synergy, reflecting the state's collective effort to combat digital crime. The results show that blocking alone is insufficient, as gambling websites are highly adaptive. It recommends enhancing digital literacy, reinforcing social values, and regularly assessing blocking mechanisms for long-term prevention.
