Abstract

AbstrakKecerdasan buatan (AI) telah menjadi bidang studi yang populer dalam beberapa tahun terakhir. Penggunaan AI semakin meluas dan diterapkan dalam berbagai bidang, termasuk industri kreatif seperti seni lukis dan karya suara. Namun, penggunaan AI dalam industri kreatif juga menimbulkan masalah terkait hak kekayaan intelektual (HKI). Artikel ini mengkaji masalah HKI yang timbul dalam konteks penggunaan komersial seni AI, khususnya dalam industri kreatif di Indonesia. Di Indonesia, HKI diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Undang-undang ini memberikan hak eksklusif kepada pencipta atau pemilik hak cipta atas karyanya. Namun, undang-undang ini belum mengakui kecerdasan buatan sebagai subjek hukum pencipta yang berhak mendapatkan perlindungan hak cipta. Regulasi hak cipta di Indonesia perlu diperbarui agar responsif terhadap perkembangan teknologi kecerdasan buatan. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan yuridis normatif. Data dikumpulkan melalui studi kepustakaan dan analisis peraturan perundang-undangan yang terkait. Hasil dan pembahasan artikel ini membahas penggunaan komersial lagu ciptaan kecerdasan buatan suara dan analisis terhadap hak cipta dalam Undang-Undang Nomor 28 Tahun 2014. Jurnal ini menyoroti bahwa penggunaan komersial karya suara kecerdasan buatan menimbulkan pertanyaan tentang siapa yang memiliki hak cipta atas karya tersebut dan apakah karya tersebut memiliki hak cipta. Hak cipta dianggap sebagai hak privat yang melekat pada pencipta, namun belum ada pengaturan yang khusus mengenai suara kecerdasan buatan. Permasalahan ini membutuhkan analisis hukum lebih lanjut untuk memahami implikasi penggunaan seni kecerdasan buatan untuk keperluan komersial dalam industri kreatif di Indonesia.Kata Kunci: Hak Cipta, Kecerdasan Buatan, Karya Suara, Penggunaan Komersial

Abstract

The development of financial technology has brought significant changes to the banking industry, especially with the emergence of financial technology (Fintech) and digital banks. This research examines the analysis of fintech regulations and their implications for digital bank operations in Indonesia. It focuses on the goal of identifying the impact of fintech regulations on digital banks as well as the legal challenges digital banks face in maintaining consumer data security. Through a normative juridical approach, this research examines related regulations, such as OJK Regulation No. 13/POJK.02/2018 concerning digital financial innovation and Bank Indonesia Regulation No. 19/12/PBI/2017 concerning the implementation of financial technology. The research results show that fintech regulations influence digital bank operations by creating a legal environment that impacts business models, operational strategies, and digital bank product innovation. Strict regulations, although aimed at increasing consumer confidence and preventing unhealthy financial practices, can limit the innovation and flexibility of digital banks. In addition, digital banks are faced with legal challenges regarding consumer data security, which require compliance with personal data protection regulations. This research provides important insights for regulators, digital banks, and related industry players to understand the complexity of fintech regulations and maintain a balance between technological innovation, data security, and consumer protection in the digital financial industry in Indonesia.

Abstract

This research will examine various legal aspects related to Deepfake Porn, including the role of law in protecting individual privacy, copyright, and cyber security. In addition, this research will also explore the potential for public awareness education as a preventative measure by increasing public understanding of the risks of Deepfakes and how to protect themselves from possible misuse of this technology. The research method that can be used to analyze efforts to prevent deepfake pornography and educate public awareness in the digital environment is the normative juridical research method. The steps in this method include identifying the legal problem to be researched, collecting data through searching regulations and literature related to the problem. Protection of personal data in the use of Artificial Intelligence (AI) technology is very important to avoid threats such as deepfake videos. Personal data, including personal photos, must be legally protected. Privacy is divided into three types: Physical Privacy, Information Privacy, and Organizational Privacy, which includes protection of individual communications, behavior and identity. In Europe, citizens can exercise the "right to be forgotten" (RTBF) right to delete personal information from the internet, as experienced by Mario Costeja Gonzalez in 2010. The EU updated the RTBF rules in the GDPR since May 2018. Indonesia also has a similar concept in the ITE Law Article 26 paragraphs (3) and (4), although the implementation is different and faces challenges in dealing with deepfakes.
