Abstract

The recognition of electronic evidence as evidence that can be submitted to court and recognized as valid evidence has been carried out since 1977 through the Company Documents Law which stipulates that microfilm containing recorded documents of a company can be submitted as evidence in court if it arises in the future. lawsuit. According to the Company Documents Law, electronic document evidence is part of documentary evidence, whereas the Corruption Law clearly explains that electronic information and electronic documents are an extension of documentary evidence. Because electronic mail in the form of electronic information or electronic documents has been recognized as one of the valid pieces of evidence in special crimes outside the Criminal Code, in line with the legal evidence in Article 184 of the Criminal Procedure Code which is a new type of evidence, it is hoped that investigators, public prosecutors, advisors The law and judges have an understanding of this electronic evidence. In examining criminal cases, it is hoped that the judge will impose a sentence based on two valid pieces of evidence and the judge will be convinced that the defendant is guilty of committing a criminal act, then the judge must impose the maximum sentence according to the prosecutor's demands, so that the defendant will be deterred and the public's sense of justice will be fulfilled.

Abstract

Human Rights are standards to recognise and protect the dignity of all people. Human Rights regulate the coexistence of individuals and each other in society, their relationship with the state, and the obligations of the state towards individuals. In this context, the protection of human rights for indigenous Papuans is very important. The involvement of natural resource management in the protection of human rights is very significant, because natural resource management can have a direct impact on the welfare of indigenous peoples. In this study, we will examine how human rights protection for indigenous Papuans is related to the involvement of natural resource management. The results of this study show that the protection of human rights of indigenous Papuans can be improved through custom-based natural resource management and respect for the rights of indigenous peoples. Therefore, there needs to be greater attention to the protection of human rights and custom-based natural resource management in an effort to improve the welfare of indigenous Papuans.

Abstract

Perlindungan hukum bagi korban mencakup hak restitusi yang tidak hanya berfungsi sebagai upaya untuk mengembalikan keadaan korban sebelum terjadinya kejahatan, tetapi juga sebagai bentuk keadilan restoratif yang mengedepankan peran aktif korban dalam proses hukum. Meskipun Undang-Undang terkait restitusi terhadap korban memberikan perlindungan hukum bagi korban, namun restitusi ini belum dilaksanakan dalam skala besar dan tidak dirasakan oleh korban kejahatan. Tujuan dari artikel ini adalah untuk mengetahui kendala restitusi dalam perlindungan hukum pada korban tindak pidana di Kejaksaan Negeri Mungkid. Penelitian ini merupakan penelitian hukum normatif dan empiris. Sering kali, korban kejahatan tidak menerima restitusi untuk memulihkan situasi mereka, baik itu kerugian materiil maupun non-materi. Sistem peradilan pidana tidak menciptakan kepastian mengenai penegakan kewajiban restitusi. Oleh karena itu, untuk menghemat biaya dan meringankan beban korban tindak pidana, diperlukan ketentuan khusus tentang pemberian ganti rugi dengan memberikan layanan kepada korban untuk mewakilinya dalam tuntutan restitusi kepada kejaksaan.

Abstract

Gunungsari Village, Windusari District, is one of the areas facing quite serious challenges in efforts to develop basic literacy in school-age children. The main problems faced are low interest in reading, limited access to adequate reading materials, and learning methods that are still conventional. These conditions have implications for many children who are not able to read and write fluently despite having received an elementary school education. In response to this situation, the community service team took the initiative to implement a literacy program that uses an interactive learning approach through the development of a literacy park. This program is not only designed to be a learning platform, but also to create a learning atmosphere that is fun, contextual, and involves the active participation of children. Various activities are implemented, including storytelling, the provision of a reading corner, educational games such as math games, vocabulary quizzes, and the provision of simple rewards to maintain high learning motivation. This program activities are carried out periodically with the involvement of the school, the surrounding community, and also the village government, so that its sustainability has the support of various parties. The results of the implementation show a significant increase in children's literacy skills. Not only are they reading more fluently, but they are also better able to comprehend story content and write simple ideas. Furthermore, the children appear more confident in expressing themselves, are more active in every learning activity, and are beginning to demonstrate positive reading habits. A culture of literacy is also slowly growing through the existence of child-friendly and inclusive literacy parks. This proves that a fun, community-based literacy approach is highly relevant in rural areas with limited resources and can be a simple yet impactful means of educational transformation for children's futures.
