Abstract

This study critically examines the existence of indigenous peoples within the framework of promoting cultural rights in Indonesia. The main reason for this study is that the Indonesian Law on Advancement of Culture enacted in 2017 did not explicitly include indigenous peoples as a crucial aspect of preserving cultural activities. Consequently, there has been no significant policy reform from the Indonesian government to maintain the rights and existence of indigenous peoples, primarily their cultural rights. From a human rights perspective, culture shapes indigenous peoples' collective identity and political force, hence Indonesia is responsible for protecting and fulfilling their collective rights. Based on the discourse analysis, this study examines two questions: First, to what extent does the recognition of indigenous peoples in the Law on the Promotion of Culture ensure the promotion of the cultural rights of indigenous people? Secondly, what government policies are directed to fulfill indigenous peoples' rights? The finding of this study is that the partial recognition of cultural rights for indigenous peoples affected the undisputable conflicts surrounding sacred rites, which affected the promotion of the collective identity of indigenous people. Abstract

The policy rule, or beleidsregel, is a legal instrument derived from a discretionary legal authority known as freies Ermessen. Unlike legislation and decisions, which are grounded in formal legal principles, policy regulation is based on the principle of discretion. However, in the evolution of administrative law in Indonesia, the use of discretionary power has become more formalized, blurring the lines between policy rules based on discretion and statutory regulations. Despite this, the review and testing of policy regulations continue to rely on general principles of good governance. This reliance makes it challenging for judicial institutions to review or annul policy regulations if they infringe upon citizens' rights. This paper employs a juridical-normative method, incorporating conceptual-theoretical, statutory, and comparative approaches, to evaluate and propose how the state can safeguard citizens' rights violated by policy rules. It also examines whether the judiciary should have the authority to review policy rules. The study concludes that an appropriate mechanism should be established between the reviewing body and the standards for evaluating policy rules. Furthermore, the judiciary should have the discretion to determine the standards for policy regulations, whether by applying general principles of good governance or by also considering laws and regulations that a policy regulation might violate.

Abstract

Citizenship Status is a human right and is crucial for people to receive protection from the state. Human rights are a fundamental element of the state, and citizenship status creates a mutual relationship between citizens and their country. Everyone must have citizenship because the relationship between the state and the citizen grants legal certainty. This study aims to determine and analyze the legal protection of stateless persons living and settling in Indonesia. Additionally, this article examines what legal remedies are available to stateless persons to obtain citizenship status in Indonesia. This research is normative research based on societal norms. The research type is based on the absence of regulation concerning non-stateless persons in Indonesia in Law No. 12 of 2006 concerning Citizenship and Government and Regulation No. 2 of 2007 concerning the Procedure to Obtain, Lose, Cancellate, and Retrieve Indonesian Citizenship. Based on the research results, it can be concluded that stateless persons in Indonesia (pid) are protected by the principles of anti-apatride and the concept of maximum protection. Consequently, the government has the discretion to ensure that former citizens and their descendants who lost Indonesian citizenship can recover their status as Indonesian citizens. Abstract

Artikel ini bertujuan untuk mengkaji persoalan Komisi Yudisial (KY) sebagai komisi independen yang mempunyai kewenangan terbatas terhadap cabang peradilan. Dengan adanya putusan Mahkamah Konstitusi, kewenangan Komisi ini dalam memilih hakim pengadilan tingkat pertama dihilangkan. Konsekuensinya, pada tahun 2019, dari 130 sanksi yang direkomendasikan KY, hanya 10 sanksi yang ditegakkan oleh MA. Penelitian ini membahas dua permasalahan. Pertama, pemberian kewenangan memilih pengangkatan hakim pertama kepada KY. Kedua, memberikan kewenangan menjatuhkan sanksi kepada hakim yang melanggar kode etik kepada KY. Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan konseptual-komparatif untuk menganalisis bahan hukum. Kajian menemukan bahwa undang-undang telah menempatkan KY sebagai lembaga etik sekaligus pengawas kekuasaan kehakiman, namun pada praktiknya banyak kewenangan KY yang belum dapat dilaksanakan secara maksimal karena belum adanya regulasi dan pemahaman teknis dengan Mahkamah Agung sebagai puncak peradilan. di Indonesia. Sangat penting untuk mengembalikan kewenangan KY dalam mengangkat hakim tingkat pertama dan meningkatkan kewenangan KY dalam menjatuhkan sanksi etik kepada hakim yang melanggar etika.Kata Kunci: Komisi Yudisial; Pengangkatan Hakim; Sanksi Etik.This paper aim to examine issues regarding Komisi Yudisial (KY) as an independent commission with limited authorities over judicial branch. As the Constitutional Court decision, this Commission’s authority in selecting first-level court judges was eliminated. The consequences is that in 2019, from 130 sanctions recommended by KY, only 10 sanctions were enforced by the Supreme Court. This research discuss two issues. First, granting the authority to select the first judge’s appointment to KY. Second, giving the authority to impose sanctions on judges who violate the code of ethics to KY. This study uses a juridical-normative method with a conceptual-comparative approach to analyze the legal materials. The study found that the law has placed KY as an ethical institution as well as a supervisor of judicial power, but practically, many KY authorities cannot be implemented optimally because of the lack of regulation and technical understanding with the Supreme Court as the pinnacle of justice in Indonesia. It is very important to restore KY authority in appointing first-level judges and increase KY authority in imposing ethical sanctions on judges who violate ethics.Keywords: Komisi Yudisial; Judges Appointment; Ethical Sanction.

Abstract

The post-pandemic economic landscape has witnessed the emergence of a worldwide sharing economy system, commonly known as the ‘gig economy’. This system represents a significant transformation in labor and services exchange characterized by short-term jobs, freelance, or on-demand work arrangements facilitated by digital platforms. Recently, the gig economy has emerged as a highly promising employment preference due to its flexibility. However, it has also led to significant inequality issues for traditional workers. Moreover, this sharing economy system also exerts substantial impacts on the environment.
