Abstract

Development in humans and a country is a must. However, in development must apply a balance with nature and the environment. This is important because so far, development often has the potential to contribute to damage to natural resources and the environment. In Indonesia, there are several developments that provide evidence of damage to natural resources and the environment, even though Indonesia already has legal instruments to prevent and enforce violations of environmental damage. This phenomenon actually illustrates that the policies for protecting natural resources and the environment are still not optimal for the flow of development. This research examines the relevance between development and damage to natural resources and the environment. This research also analyzes law enforcement in the aspects of damage to natural resources and the environment.

Abstract

This study critically examines the existence of indigenous peoples within the framework of promoting cultural rights in Indonesia. The main reason for this study is that the Indonesian Law on Advancement of Culture enacted in 2017 did not explicitly include indigenous peoples as a crucial aspect of preserving cultural activities. Consequently, there has been no significant policy reform from the Indonesian government to maintain the rights and existence of indigenous peoples, primarily their cultural rights. From a human rights perspective, culture shapes indigenous peoples' collective identity and political force, hence Indonesia is responsible for protecting and fulfilling their collective rights. Based on the discourse analysis, this study examines two questions: First, to what extent does the recognition of indigenous peoples in the Law on the Promotion of Culture ensure the promotion of the cultural rights of indigenous people? Secondly, what government policies are directed to fulfill indigenous peoples' rights? The finding of this study is that the partial recognition of cultural rights for indigenous peoples affected the undisputable conflicts surrounding sacred rites, which affected the promotion of the collective identity of indigenous people. Abstract

This study investigates the social consequences of issuing a letter from the East Java National and Political Unity Agency (BAKESBANGPOL) Number 300/5984/209.5/2023, which ostensibly aims to manage conflicts between martial arts schools. However, it has inadvertently undermined the creative economy development program. The BAKESBANGPOL letter was a provincial government intervention to an oversimplified approach to conflict resolution by demolishing martial arts school monuments. The research uses Ethnographic methods and Foucault's perspective, which emphasizes the text's intertextuality and the diversity of social contexts. This research finds that government policy represents a failure of the power system to recognize the cultural practices of civil society. It is because the exerted power cannot fully control the subject of power or the counter-power articulated by martial arts schools. In contrast, the Madiun City Government optimizes the creative economy's potential by promoting the city as a martial art. The frequent construction of martial arts statues contradicts the demolition of martial arts monuments, highlighting the tension between disciplining and fostering the cultural economy. This contradiction raises essential issues regarding the limits of government power to construct a surveillance system and the presence of civil society subjectivity. As a result, social spaces become fields where tactics developed to negotiate the domination of the local and provincial government power. Thus, this research argues that the representation system of civil society within governance does not fully guarantee equality, consensus, or continuity. The letter highlights dynamic power relations structured through spatial politics, characterized by the inseparability between the state apparatus and elements of civil society. Hence, the government must articulate an inclusive strategy that recognizes cultural practices and allows creative economy programs to evolve.

Abstract

This study explores the leisure activities of young urban migrants in cafés, examining coffee as both a commodity and a modern mode of consumption within the framework of the culture industry. The choice of coffee and cafés is an inherent part of the identity of young people who want articulation space for cultural tastes and preferences. Thus, coffee culture and youth identity become crucial to elaborate the utilization of time conceptualized as determined by the capitalist production system. This research uses critical phenomenology to study urban migrant youth in Surabaya. It purposively determined eight informants consisting of university students from regencies in East Java, baristas, and café owners. Using mass culture analysis from the Frankfurt school, this research found that there is a standardization of space, either claimed as new or authentic, to emphasize the difference with existing cafés. Consequently, the subjectivities of young urban migrants in coffee culture settings are constructed in pursuit of novelty, popularised as ‘FoMO’. The study argues that the differentiation of cafés between urban and non-urban areas does not provide a clear distinction. Then, consumers and those who formulate the existence of cafés are faced with the need to create uniqueness or innovate to multiply profits. Instead of enjoying leisure, young urban migrants are absorbed and actively reproduce the existence of socially and virtually organized social systems.

Abstract

The discussion of state power tends to elaborate on the problem of the legitimation of using force to deliver public goods. Seminal works by Machiavellian theoreticians stand on this argument and focus on developing a strong government that can control how the power works. There is a debate continuously elaborating on the nature of state power, mainly to present the humanist power relations; however, the problems of overuse of power and the fallen victims cannot wait until academia makes a consensus. With the various governmental models, the state has a complex issue, such as the nexus between the plurality of social identity and other categories attributed to the citizens, which becomes essential to overcome the problems of unpredictable enemies with the most efficient strategist. Following these backgrounds, it is crucial to enhance knowledge about the variety of the implementation of state power to control, supervise, and docile the citizens. In doing so, first, figuring the concept of terrorism with multiple interpretations, in which states play their strategy to raise public awareness while elevating the regime of terror by creating a common enemy. Secondly, how has the technology to govern, with a technicalization of specific indicators, been used to manage the risk and possibly minimize the number of victims. Lastly, concern about this condition leads to human rights fulfillment, particularly how the state's "conduct to conduct" can ensure citizens' well-being. As a point for reflection, this essay argues that state power has a paradox in delivering sovereignty; the challenge is how to construct social spaces that can reduce the overuse of power. Abstract

The use of intimate language in public spaces is a phenomenon that emerges in the interactions of economic actors in traditional markets. Therefore, language intimacy deconstructs social norms that should not be displayed in public spaces. However, language intimacy has emerged in traditional markets for a long time in the interactions of economic actors, including sellers, buyers, porters, parking attendants, and the social gathering community. This research explores how intimate language is articulated in an economic space closely related to the ethnic identity of economic actors in traditional markets in the Jember region. The ethnic diversity in question includes Javanese, Madurese, Chinese/Chinese, and Arab. This phenomenon was researched qualitatively using a post-structuralist approach and applying Julia Kristeva's theory of intertextuality. Data analysis uses two Kristeva concepts, namely intertextuality and suprasegmental. The data is processed by looking at the text production process originating inside and outside the text. The research results show that the intimacy of language, usually used in the private sphere, has succeeded in breaking down the rigidity of language in the public sphere, besides dissolving social relations between economic actors with various ethnicities and social classes. Thus, the use of greetings in intimate language closely related to ethnic identity is experiencing development and merging with the space of familiarity and closeness built by economic actors in traditional markets.
