Abstract

Legal aid promotes justice and human rights, which the central and local governments should provide. Unfortunately, the provision of legal aid for underprivileged communities still requires improvement. Legal aid provided by legal aid activists, institutions, mass organizations, political parties, and non-governmental organizations is still not optimal due to administrative problems and the legalization of legal aid practices. This research provides insights into the significant benefits of legal assistance for underprivileged communities. This research also proposed a novel legal perspective and reform regarding equal distribution of justice.

Abstract

Bantuan hukum dalam masyarakat sangatlah penting untuk menciptakan keadilan dalam rangka pemenuhan Hak Asasi Manusia (HAM). Kewajiban Pemerintah pusat maupun daerah untuk memberikan bantuan hukum menjadi hal yang penting untuk dapat dilaksanakan karena praktek selama ini menunjukkan, bahwa masyarakat khususnya yang tidak mampu dalam mengakses keadilan masih belum memadai.Aktivitas bantuan hukum yang dilakukan oleh penggiat bantuan hukum, dari lembaga bantuan hukum kampus, ormas, partai politik, lembaga swadaya masyarakat masih belum maksimal, karena terbentur masalah administrasi dan legalisasi praktek bantuan hukum.Penelitian ini sangatlah penting, mengingat manfaat yang sangat besar yang akan didapatkan ketika pelaksanaan bantuan hukum kepada masyarakat tidak mampu di Kota Palu dapat dilaksanakan secara efektif, selain itu juga memberikanbentuk upaya reformasi hukum dalam aspek pemerataan keadilan.

Abstract

  Lingkungan hidup yang baik, sehat, dan berkelanjutan merupakan kondisi yang memungkinkan manusia berkembang secara optimal dalam keseimbangan yang harmonis. Jaminan atas kondisi tersebut menegaskan hak setiap individu untuk menuntut peran negara dalam menjaga dan meningkatkan kualitas lingkungan, yang sekaligus menjadi kewajiban pemerintah dalam mewujudkan serta memelihara lingkungan hidup secara berkelanjutan. Meskipun pengakuan terhadap Hak Asasi Manusia telah ditegaskan dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, implementasi perlindungan dan penegakannya masih menghadapi berbagai tantangan, termasuk adanya kasus pelanggaran HAM di bidang lingkungan hidup yang belum terselesaikan. Oleh karena itu, penelitian ini bertujuan untuk merumuskan konsep yang tepat dalam mendukung terwujudnya lingkungan hidup yang baik, sehat, dan berkelanjutan yang sejalan dengan prinsip-prinsip Hak Asasi Manusia bagi masyarakat di Provinsi Sulawesi Tengah. ABSTRACT A good, healthy, and sustainable environment is a condition that enables humans to thrive optimally in a state of harmonious balance. The guarantee of such conditions affirms every individual’s right to demand that the state play a role in preserving and improving environmental quality, which simultaneously constitutes the government’s obligation to realize and maintain a sustainable environment. Although the recognition of Human Rights has been affirmed in the 1945 Constitution of the Republic of Indonesia, the implementation of their protection and enforcement still faces various challenges, including unresolved cases of human rights violations in the environmental sector. Therefore, this study aims to formulate an appropriate concept to support the realization of a good, healthy, and sustainable environment in line with human rights principles for the people of Central Sulawesi Province.

Abstract

Public trust is the primary foundation of banking activities, particularly regarding the security of customer deposits. However, in practice, various problems such as lost funds, account breaches, and system failures that result in losses for customers are still encountered. This study aims to examine and provide legal education regarding banks' legal responsibilities for the security of customer deposits based on the provisions of Indonesian laws and regulations. The research method used is normative legal research with a statutory and conceptual approach. The results show that banks have a legal obligation to maintain the security of customer funds as part of the prudential principle and consumer protection. This responsibility is regulated by various regulations, including the Banking Law, provisions of supervisory authorities, and principles of consumer protection for financial services. If a loss occurs due to negligence or error on the part of the bank, the bank is obliged to provide compensation to the customer. Therefore, legal education for the public is important so that customers understand their rights and available legal protection mechanisms. This research is expected to contribute to increasing legal awareness and strengthening public trust in the banking system.

Abstract

The mining sector in Indonesia is often associated with human rights violations, ranging from land grabbing, environmental pollution, to violence against affected communities. However, under the international legal framework, corporations have an obligation to respect human rights as stipulated in the United Nations Guiding Principles on Business and Human Rights 2011. This principle emphasizes that corporations are required to conduct Human Rights Due Diligence to prevent and address the negative impacts of their activities. This study uses a normative juridical method with a legislative and conceptual approach to examine the responsibility of mining corporations towards human rights. The analysis focuses on harmonization between international standards and Indonesian national law, specifically Articles 28A-28J of the 1945 Constitution, Law No. 39 of 1999 concerning Human Rights, Law No. 32 of 2009 concerning Environmental Protection and Management, and Law No. 3 of 2020 concerning Minerals and Coal. The results of the study indicate that although Indonesia has a regulatory framework that accommodates the principle of corporate human rights responsibility, its implementation is still weak. Key obstacles include weak oversight, limited access to justice for victims, and the widespread practice of Strategic Lawsuits Against Public Participation (SLAPPs) against environmental human rights defenders. The study concludes that strengthening mandatory due diligence mechanisms, optimizing the role of the National Commission on Human Rights (Komnas HAM), and enforcing administrative and criminal sanctions are key to ensuring the accountability of mining corporations in Indonesia.
