Abstract

In the management of regional finances often occurs management that is not in accordance with the procedure and substantially there has been abuse of authority by officials who have authority in the field of regional financial management resulting in local financial management cannot be accounted for. Based on this, the author propose the problem of how is the normative function af administrative law in local financial governance that includes planning, implementation, administration and accountability area. This research aims to analyze the extent to which the normative function of administrative law can realize good local financial governance. The research result indicate that if the normative function of administrative law which includes the aspects of authority, procedures and substances in the field of management of regional goodness that is in accordance with the legislation, the principle of governance, and the principles of financial management, both can realized. In order to realize it, then it needs to strengthen in the field of legislation related to the management of regional finances and consistent in its implementation.Keywords: Normative Function, Administrative law, and Local Financial

Abstract

Selama ini masih banyak masyarakat (konsumen) khususnya mahasiswa di Kota Palu yang belum mengetahui tentang regulasi yang mengatur dan melindungi hak-hak mereka sebagai konsumen. Oleh karena itu, perlu adanya pengetahuan dan pemahaman untuk mengatasi permasalahan tersebut, agar kedepannya masyarakat terhadap hukum semakin baik, dan pada akhirnya dapat meminimalisir tindakan pelaku usaha yang dapat merugikan konsumen. Pengabdian ini laksanakan yang menghadorkan mahasiswa yang tergabung dalam Ikatan Pemuda Pelajar Mahasiswa Kabupaten Luwu Timur (IPPMK-Lutim). Dengan metode yang dilakukan yakni metode ceramah dan diskusi dengan mahasiswa yang hadir. Hubungan hukum dalam perlindungan konsumen merupakan hubungan hukum segitiga dengan menempatkan konsumen dan pelaku usaha sebagai pelaku utama dalam proses transaksi barang dan/atau jasa. Hubungan ini dalam ranah hukum privat dimana kedua belah pihak memiliki kedudukan yang setara. Hubungan hukum terjadi berdasarkan asas kebebasan berkontrak dan asas konsensualitas. Selain konsumen dan pelaku usaha, terdapat pihak ketiga yaitu pemerintah yang berperan sebagai regulator dalam mengatur pola hubungan hukum antara konsumen dengan pelaku usaha. Oleh karena itu, mahasiswa dipelolopri sebagai motivator yang diharapkan akan dapat lebih paham dalam regulasi perlinddungan konsumen terlebih dalam kondisi pandemi ini.

Abstract

Bawaslu is an institution that is given the authority to resolve election / election administration violations. The nature of Bawaslu's decisions and recommendations for administrative violations must be followed up by the KPU and its officials, this is confirmed in the provisions of Article 462 of Law No. the administration issued by Bawaslu is not obeyed by the institution implementing the decision / recommendation. Identification of problems: first, what is the nature of mandatory norms in the provisions of the Election / Pilkada Law? Related to follow-up on decisions / recommendations of Bawaslu Administrative Violations? Second, how is the Compliance with the Decision / Recommendation of Administrative Violation of Bawaslu? Third, what factors influence compliance with Bawaslu Administrative Violation Decisions / Recommendations? This research is a normative juridical study with a focus on analyzing decisions / recommendations for administrative violations of Bawaslu. in this study using a statutory approach, a case approach, and a conceptual approach. Abstract

The Indonesian Broadcasting Commission (KPI) is an independent institution in Indonesia whose position is at the same level as other state institutions that function as a regulator of broadcasting in Indonesia. The KPI consists of the Central Indonesian Broadcasting Commission (KPI) and the Regional Indonesian Broadcasting Commission (KPID) that work at the provincial level. The authority and scope of duties of the Broadcasting Commission covers broadcasting arrangements organized by Public Broadcasting Institutions, Private Broadcasting Institutions, Subscriber Broadcasting Institutions and Community Broadcasting Institutions. Radio is a media facility that still exists in Palu City. Radio media is a place for audio connoisseurs to accompany work and even travel. It is undeniable that radio is a powerful means of providing information. With a distinctive way of presentation, radio is still the main attraction. Radio listeners are served small talk and accompanied by songs. In this regard, radio broadcasters do not escape the status of a profession that is bound by a code of ethics. The Regional Indonesian Broadcasting Commission (KPID) of Central Sulawesi is an independent state institution that is responsible for controlling broadcasting behavior in each broadcasting institution, including radio. This problem is the background for the author to discuss it in research, first, how is the authority of the Central Sulawesi KPID towards the broadcasting code of ethics in radio broadcasting institutions. Second, how is the standard of behavior of radio broadcasting institutions in Palu. Duties and responsibilities, the authorities possessed by the Regional Indonesian Broadcasting Commission (KPID) of Central Sulawesi have indirect responsibilities with the State.

Abstract

Social media can be understood that media is a tool used in communication activities. The dissemination of learning information is something that must be considered so that learning activities become more optimal and the objectives of learning can be achieved. The dissemination of information has so far experienced obstacles due to limited communication space. Various social media features used by the community, especially student students, to get learning materials in online learning activities. Fake news or hoaxes are now widely encountered on a daily basis and often even use provocative sensational titles. Based on that description, the problem is what efforts must be made in order to prevent the spread of hoax information with the knowledge and understanding of high school students in filtering information through social media. This service activity provides education to high school students about the importance of knowledge and understanding in preventing the spread of hoax information through social media for everyone. The service location will be carried out at SMA Negeri 1 Palu with the target of school students. The method of implementation is by lectures and discussions.

Abstract

Management rights are the controlling rights of the State whose implementing authority is partially devolved to the holder, such authority includes the authority to use the land for its business purposes and hand over parts of the land to third parties. There are problems in the transfer of land rights over land management rights as well as legal settlement efforts to solve the problem of land transfer. This problem of state land management then gives rise to a separate right, namely the right to state land management. PT Sari Dewi Membangun with the Palu City Government. The problem to discuss it is how to analyze the legal analysis of the management rights dispute between PT Sari Dewi Membangun and the Palu City Government. This research was conducted by research methods with empirical juridical analysis. By using a general foundation race on the Theory of Legislation, the Theory of Authority and Government Action. As well as identifying with a statutory and conceptual approach. The transfer of rights to management land carried out without the consent of the holder of the Management Right cannot be said to be valid according to law, it is determined that any transfer of the use of land that is part of the management rights land to a third party by the holder of the management right, whether accompanied or not accompanied by the erection of buildings on it, must be carried out by making a written agreement between the party holding the management right and the third party that  Concerned.

Abstract

Sejak diberlakunya Undang-Undang Republik Indonesia Nomor 6 Tahun 2014 tentang Desa yang disertai dengan Peraturan Pemerintah Nomor 43 Tahun 2014 tentang Peraturan Pelaksanaan UU Nomor 6 Tahun 2014 tentang Desa, maka Desa memiliki kewenangan sebagai daerah otonom. Desa diberikan kesempatan yang besar untuk mengurus pemerintahan sendiri, termasuk melaksanakan Pengelolaan Keuangan. Pengelolaan keuangan Desa kemudian diatur dalam Peraturan Menteri Dalam Negeri Nomor 20 tahun 2018 tentang Pengelolaan Keuangan Desa yang dananya bersumber dari APBN dan sumber lainya. Desa yang tidak terbiasa dengan sistem keuangan Negara dikhawatirkan belum siap melakukan pengelolaan keuangan desa dengan baik. Olehnya itu diperlukan sosialisasi atau penyuluhan kepada masyarakat desa dan pemerintahan desa. Adapun tujuan dilakukan penyuluhan yakni meningkatkan pemahaman kepala desa dan aparat desa terkait pertanggungjawaban hukum pengelolaan dana desa. Metode yang digunakan adalah ceramah dan diskusi yang dihadiri masyarakat dan aparat desa. Hasilnya adalah peningkatan pengetahuan tentang tanggung jawab hukum bukan hanya pemerintah desa melainkan juga untuk masyarakat desa. Pemahaman tentang pengelolaan dana desa sebaiknya digunakan untuk kemanfaatan bersama guna meningkatkan kesejahteraan desa.

Abstract

The Central Government makes full use of the resources assigned to the region in order to support the realization of regional autonomy, the effectiveness of the national economy, and the application of the principles of good governance, transparency, and accountability. The government increases professionalism, transparency, and responsibility in its administration as a manifestation of regional financial management. There is no denying that managing a nation and its government takes a lot of resources. How to handle regulations and issues pertaining to financial management in Central Sulawesi Province is the issue. The examination of statutory and doctrinal literature was prioritized in this research, which was undertaken utilizing normative legal research and analysis techniques. Deciding on policies while making use of legislative documents, contextual methods, and case approaches, as well as the broad concepts of the philosophy of power and government action. The community, as well as managers, supervisors, and regulators, work together to supervise regional financial management. The conclusion is that in order to achieve good governance and the involvement of local governments and people in achieving regional development goals, regional financial management strategies must incorporate openness and accountability.

Abstract

The purpose of this article is to determine and analyze the application of good governance principles in land registration services in Parigi Moutong Regency. The findings showed that the law that covers the land certificate policy states that land can be owned by people either alone or jointly with other people and legal entities. By using empirical juridical research methods and using the theory of the rule of law and general principles of good governance as well as identifying with legal and conceptual approaches. It is concluded that the implementation of good governance in the performance of land registration public services in Parigi Moutong based on regulations can be measured through the elements of productivity, responsiveness and accountability. The element of responsiveness to the implementation of BPN Parigi Moutong's performance still has a less than optimal attitude towards parties applying for land permits.
