Abstract

This study investigates the influence of green infrastructure investment, capital structure, and operational efficiency on the financial performance of companies operating in Central Java. A quantitative research approach was employed, utilizing survey data collected from 173 companies across various industries. The data were analyzed using Partial Least Squares Structural Equation Modeling (PLS-SEM), with hypothesis testing conducted to assess the significance of the relationships between the variables. The results indicate significant positive associations between green infrastructure investment, capital structure, operational efficiency, and financial performance. Specifically, companies that prioritize sustainability initiatives, maintain optimal capital structures, and enhance operational efficiency tend to achieve superior financial performance outcomes. These findings highlight the multidimensional nature of value creation within organizations and underscore the importance of integrating environmental and operational considerations into strategic decision-making processes. The implications of the study extend to policymakers, business leaders, and stakeholders seeking to enhance the financial sustainability and resilience of companies in Central Java.

Abstract

This study examines the regulation of online content and its impact on the right to freedom of speech on digital platforms in Indonesia, utilizing a juridical normative analysis. With the rapid growth of digital platforms, concerns over the balance between regulating harmful content and safeguarding free expression have intensified. The research explores the legal frameworks governing online content in Indonesia, analyzing how these regulations align with constitutional guarantees of freedom of speech. The findings reveal significant tensions between state interests in maintaining public order and individual rights to free expression, highlighting the potential for regulatory overreach and the chilling effect on public discourse. The study underscores the need for a more balanced approach to content regulation, advocating for clearer legal guidelines and independent oversight to ensure that regulations do not undermine democratic principles. This research contributes to the ongoing debate on the legal and ethical dimensions of content regulation in the digital age, offering insights for policymakers, legal practitioners, and digital platform operators.

Abstract

This paper examines the application of Law Number 12 of 2022 on the Crime of Sexual Violence in addressing cases of gender-based violence (GBV) within Indonesia’s creative economy. Using a juridical analysis approach, the study explores the effectiveness of the law in protecting victims, prosecuting offenders, and preventing future incidents of sexual violence in a sector characterized by informal employment and unique workplace dynamics. Case studies of sexual violence incidents in the creative economy reveal challenges in reporting, barriers in legal processes, and the critical role of industry stakeholders in mitigating or enabling GBV. While the law offers comprehensive protections, including victim support and criminal sanctions, its effective implementation requires enhanced law enforcement training, workplace safety policies, and accessible reporting mechanisms. The study concludes with recommendations to strengthen the application of Law Number 12 of 2022, ensuring greater protection for creative industry workers from gender-based violence.

Abstract

The enactment of Law No. 27 of 2022 on Personal Data Protection marks a pivotal moment in Indonesia’s regulatory framework, particularly for industries that handle significant amounts of personal data, such as the financial technology (fintech) sector. This study provides a normative juridical analysis of the PDP Law and examines its impact on the fintech industry. The research focuses on the law’s key provisions, including consent requirements, data breach notification, and data security obligations. Additionally, the study explores the operational challenges fintech companies face in complying with the law, such as the costs of compliance, technical requirements, and the need for employee training. While the PDP Law enhances consumer trust by offering greater protection and transparency, it also presents hurdles that fintech firms must overcome to ensure compliance. The analysis concludes with recommendations for fintech companies to balance legal obligations with innovation to maintain competitiveness in Indonesia’s evolving digital economy.

Abstract

This paper explores the concept of "piercing the corporate veil" within the context of Indonesian corporate law, focusing on the misuse of legal entities for personal interests. In Indonesia, the separation of a corporation's legal identity from its shareholders and directors typically shields them from personal liability. However, in cases of fraud, misconduct, or abuse, the legal doctrine of piercing the corporate veil allows courts to disregard the corporate entity and hold individuals personally accountable. Through a normative juridical analysis, this study examines relevant legal statutes, judicial decisions, and case law to assess the application of this principle in Indonesia. The paper identifies key factors influencing the decision to pierce the corporate veil, such as fraud, misrepresentation, and evasion of obligations. It also compares Indonesia's approach with international practices, highlighting areas for improvement. The findings indicate that while the concept of piercing the corporate veil is applied in Indonesia under exceptional circumstances, its inconsistent application and lack of a comprehensive legal framework pose challenges to corporate governance and accountability. The study concludes with recommendations for legal reform and enhanced enforcement mechanisms to better address corporate abuse and protect public and stakeholder interests.

Abstract

Penelitian ini melakukan analisis yuridis normatif terhadap penerapan keadilan restoratif dalam tindak pidana ringan di Indonesia. Keadilan restoratif menekankan rekonsiliasi antara pelaku dan korban, dengan fokus pada perbaikan kerusakan dan pembinaan keharmonisan masyarakat. Meskipun sejalan dengan nilai-nilai budaya Indonesia, penerapan keadilan restoratif menghadapi berbagai tantangan, termasuk ketidakjelasan hukum, keterbatasan sumber daya, dan resistensi dari praktisi hukum tradisional. Studi ini mengidentifikasi kerangka hukum utama yang mendukung keadilan restoratif, seperti UU No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, namun menyoroti perlunya pedoman yang komprehensif dan peningkatan kapasitas bagi para praktisi. Dengan membuat perbandingan dengan praktik-praktik internasional, penelitian ini memberikan rekomendasi untuk meningkatkan efektivitas keadilan restoratif di Indonesia. Memperkuat mekanisme keadilan restoratif dapat mengurangi penumpukan kasus di pengadilan, meningkatkan rehabilitasi pelaku, dan mendorong kohesi sosial, sehingga menjadikannya sebagai pendekatan yang penting untuk menangani kejahatan ringan.

Abstract

Studi ini menyajikan analisis hukum komparatif antara sistem civil law dan common law dalam konteks perlindungan data pribadi, dengan fokus pada kerangka hukum Indonesia yang terus berkembang. Sebagai negara dengan sistem civil law, pendekatan Indonesia dicirikan oleh undang-undang yang terkodifikasi, khususnya Undang-Undang Perlindungan Data Pribadi (UU No. 27 Tahun 2022), yang memberikan regulasi dan kepastian hukum yang komprehensif. Sebaliknya, yurisdiksi common law seperti Inggris, Amerika Serikat, dan Australia menggabungkan ketentuan undang-undang dengan preseden yudisial, sehingga memungkinkan fleksibilitas dan kemampuan beradaptasi terhadap tantangan privasi yang muncul. Dengan menggunakan metode penelitian hukum yuridis normatif dan komparatif, makalah ini mengkaji sumber hukum, mekanisme penegakan hukum, peran peradilan, dan kemampuan beradaptasi terhadap perubahan teknologi di kedua sistem tersebut. Temuan menunjukkan bahwa meskipun model hukum perdata Indonesia menjamin kejelasan dan keseragaman, model ini kurang responsif terhadap perkembangan yang tidak terduga, sedangkan sistem common law memberikan kemampuan beradaptasi namun dapat menciptakan ketidakpastian. Studi ini menyimpulkan bahwa Indonesia dapat mengambil manfaat dari mengintegrasikan elemen-elemen common law yang selektif, seperti undang-undang berbasis prinsip dan interpretasi yudisial yang diperluas, untuk meningkatkan rezim perlindungan data pribadinya di era digital.
