Abstract

Husband’s role in the family is affected by the role of the wife. Harmonious domestic life is the desire of every couple who fostered by the head of the family both men and women. But in practice conditions many families are affected by the threat of hurricanes and the current inequality of a leadership role. The relationship between husband and wife at a given time can suffer shocks worrying. Tali marriage in Islam is a strong bond that is formed couples in order to reach the fabric of household. In al-Qur’an Allah characterization of his marriage with the term mitsaqan ghalizhan (rope solid agreement). This article attempts to explain the relationship between the holy book the Koran and the community, both of which are factors that have a dependency memenculkan different interpretations, particularly of the concept of “head of household”. In other words, changes in the condition and development is a means to understand the scope of the meaning of al-Qur’an. Keyword: Qur’an, Society, head of the family, Sura An- Nisa‘ (3): 34 .

Abstract

The tendency of people to choose the Sharia Economic Dispute Settlement Institution. The facts of the lack of sharia economic case submitted and decided by litigation and non-litigation institutions are the background of the research. This research is a kind of explorative research that uses qualitative approach to mengunggkap legal facts in the context of sharia economy. Data in the form of questionnaires / questionnaires processed only to describe the percentage percentage of the economic tendency of sharia community to choose dispute settlement institutions. This description is a preliminary data that lead researchers to explore the points of question needed in the interview between the results of quantitative data processing with the facts on the ground shows that people choose various options in solving the dispute sharia economy.

Abstract

The potential for corruption in the management of village funds and for knowing efforts to prevent corruption in managing village funds. Management of village funds after the issuance of Law number 6 of 2014 concerning Villages experiences various kinds of problems between the emergence of criminal acts of corruption regulated in law number 20 of 2001 concerning Prevention of Corruption, so that the village government is expected to carry out various kinds of prevention against criminal acts of corruption both in terms of policy making, budget allocation and in the mechanism of policy making. Prevention of criminal acts of corruption must continue to be carried out starting from the lowest level, namely the village government so that in the future there will be realized a lawful village community that will increase the structure of good governance. Corruption prevention in managing village funds is trying to identify various modes of corruption in the village, increasing the capacity building of village officials and strengthening the capacity of village facilitators.

Abstract

Bank memberikan manfaat besar bagi masyarakat sebagaimana fungsinya untuk menghimpun dan menyalurkan dana. Bank syariah menawarkan berbagai fasilitas dan produk pembiayaan dengan prinsip syariah. Akad rahn merupakan produk yang cukup diminati masyarakat yang ingin mengajukan pinjaman kepada bank syariah. Penelitian ini menggunakan metode kualitatif dengan studi kasus di lapangan. Teknik pengumpulan data dilakukan melalui observasi, wawancara dan dokumentasi. Dari hasil penelitiannya diperoleh Penjualan Barang Gadai di Bank BJB Syariah Kabupaten Kuningan menggunakan akad qard, rahn, dan ijarah.  Jenis barang gadai yang dijual bank sama dengan jenis penerimaan barang gadai yaitu berupa Logam Mulya 17-24 karat, Emas Kuning 16-24 karat, dan Perhiasan 17-23 karat.  Proses pentaksir perhiasan emas dikerjakan oleh petugas taksir dengan menggunakan peralatan khusus untuk memperoleh nilai emas, diantaranya timbangan untuk mengukur berat emas dan batu uji karatase. Harga jual emas ditaksir melalui dua cara, yaitu: menggunakan berat jenis dan diuji oleh zat kimia.Kata Kunci: Penjualan Barang Gadai, Bank BJB Syariah, Hukum Ekonomi Syariah.

Abstract

Abstract— The purpose of the dam punishment is how criminal sanctions and actions act as a criminal system that applies in Indonesia where the pattern of punishment as a reference can be immediately followed up by the established assessment system because of the guidelines made by the legislators so as not to cause confusion or overlap between the forms of sanctions from the type of criminal sanctions to the form of action, the sanctions for actions that are applied in actions considering the forms of additional sanctions are more open and more oriented to the basic ideas of criminal sanctions. The dual track system must be the basis for the policy of determining sanctions in laws and regulations, this system allows the utilization of types of criminal sanctions and proportional actions for comprehensive countermeasures. The basic idea of ??the expected double track system is that criminal sanctions and actions must be accommodated in every existing statutory regulation.

Abstract

This research explores the challenges and prospects for dispute resolution through the National Sharia Arbitration Board within the Indonesian legal context. Utilizing qualitative research methods, including interviews, case studies, content analysis, and comparative analysis, the study identifies institutional challenges such as resource constraints, procedural complexities, and limited jurisdiction. Legal and cultural factors, including the harmonization of laws, cultural sensitivity, and gender equity, are examined. Case studies illustrate the Board's efficacy in family disputes while revealing challenges in handling commercial disputes. Prospects for future development encompass legal reforms, capacity building, and public awareness initiatives. A comparative analysis with global Sharia arbitration bodies provides insights into shared challenges and distinctions. The implications for the Indonesian legal system highlight the need for strategic interventions. Overall, this research contributes to a nuanced understanding of the National Sharia Arbitration Board's role and suggests pathways for its sustainable development

Abstract

This research is qualitative research with a descriptive approach, namely describing a number of things that are closely related to confiscation of assets in criminal law, criminal acts of corruption, and other things. The data used in this research is secondary data in the form of the Criminal Code, Civil Code, statutory regulations, the official website of the House of Representatives, other credible websites, and so on. The researchers analyzed the data using grammatical and systematic legal analysis techniques, namely interpreting every word in the legislation and connecting it with other secondary data or other related legislation. The result in this article show there are three major urgencies for the presence of the Law on Asset Confiscation in Indonesia, namely to provide instruments that are stricter than the current regulations because in the Criminal Code, asset confiscation is only an additional crime and not the main crime, providing a deterrent effect for corruptors and potential corruptors, and of course minimizing corruption cases in Indonesia. Under existing legal structures, state losses resulting from criminal acts of corruption cannot be recovered. Recovering state losses takes years and may not even be returned at all. What is meant to provide a deterrent effect in this research is to impoverish corruptors, change the nomenclature of words whose nature is emphasized from facultative to imperative, and change its status not only to become an additional crime, but also to become a principal crime. On this basis, researchers are of the opinion that the presence of asset confiscation laws in Indonesia can be effective in minimizing the occurrence of corruption in Indonesia.

Abstract

Technological advances provide a number of benefits in various sectors, one of which is the financial sector. Technological advances in the financial sector or commonly known as financial digitalization have made data bookkeeping more effective, easily accessible, transparent, and made it easier for employees to carry out financial reports. Based on this, this research aims to analyze the role of financial digitalization in preventing corruption in Indonesia. This research is qualitative research with a descriptive approach, namely describing the meaning of technology, technological developments, the benefits of technology, its relationship with finance, and the benefits of digitalization of technology in preventing corruption in Indonesia. The data used by researchers in this article is secondary data, namely in the form of legislation, scientific articles, books, websites and other things that are usually used in every research. The researchers analyzed these data using the stages of data collection analysis, data reduction, data analysis, and drawing Conclusion. The result in this research show that the presence of financial digitalization at least has benefits in preventing corruption because of its transparency. With the digitalization of financial tenders, financial reporting, and other things that are transparent and do not endanger privacy, they can be accessed easily by all stake holders, supervisors, partner companies, internal company parties, and so on to find out the tender winner, continuity of the tender, until completion of the tender. Apart from that, if suspicious potential for corruption is found, it can be tracked easily. Because of this, anyone who has the intention to commit corruption will be discouraged.

Abstract

Penelitian ini menyelidiki implementasi undang-undang lingkungan hidup dalam penegakan hukum terhadap pencemaran sungai di Bandung, Indonesia, dengan menggunakan pendekatan analisis kuantitatif. Penilaian kualitas air, evaluasi kerangka hukum, dan analisis penegakan hukum dilakukan untuk memahami secara komprehensif tantangan dan peluang dalam tata kelola lingkungan. Hasilnya menunjukkan adanya variasi polusi yang signifikan di berbagai lokasi sungai, yang menekankan perlunya intervensi yang ditargetkan. Kerangka hukum, meskipun komprehensif, mengungkapkan tantangan dalam hal kejelasan dan penegakan hukum, menggarisbawahi perlunya penyempurnaan peraturan. Efektivitas penegakan hukum berkorelasi positif dengan peningkatan kualitas air, yang menekankan peran penting dari intervensi peraturan. Temuan-temuan yang terintegrasi menawarkan pemahaman yang bernuansa tentang lanskap lingkungan di Bandung, yang memberikan landasan bagi rekomendasi kebijakan dan strategi tata kelola yang berkelanjutan.

Abstract

This research investigates the influence of legal, political, and social factors on religious freedom in Indonesia through a quantitative analysis. A sample of 150 participants was surveyed, and a structural equation model was employed to examine the relationships between these factors and their impact on perceptions of religious freedom. The results reveal significant positive associations between legal awareness, political dynamics, social attitudes, and religious freedom. The study contributes valuable insights for policymakers, legal practitioners, and advocacy groups seeking to enhance religious freedom in Indonesia
