Abstract

Artificial intelligence changes how tourist destinations operate, provides better service to visitors, and provides long-term benefits for local communities and the environment. However, it is essential to question whether governments can effectively resolve data privacy and cybersecurity challenges when deploying these technologies. This study aims to analyze issues related to the role of artificial intelligence policy in promoting Indonesia's digital tourism. This research employs a normative legal approach, drawing from both statutory and historical sources. This research concludes that Indonesia promotes artificial intelligence in tourism by investing in AI technology research and development, collaborating between the government and the private sector to implement AI solutions, and establishing a supportive regulatory framework to ensure the ethical use of AI in tourism. The impact of digitalization policies on digital tourism includes increasing accessibility and convenience for tourists through online ordering systems and digital payment methods, developing smart destinations with Internet of Things technology and data-based insights, and enhancing tourist experiences through augmented reality applications and virtual reality.

Abstract

The discourse on legalizing marijuana for medical purposes in Indonesia peaked when legislators discussed the draft law on the narcotics law amendment. Efforts to legalize marijuana for medical purposes have also been pursued by testing the narcotics law. However, through decision number 106/PUU-XVII/2020, the Constitutional Court prohibited medical marijuana as a medical treatment. From the Human Rights perspective, everyone has the right to life and health. Therefore, in society's logic, the prohibition of using marijuana for medical treatment is the same as forbidding sick people to stay alive. It means that the state has failed to guarantee its citizens' lives. But on the other hand, several countries legalized medical marijuana, such as Thailand, Turkey, Lebanon, Netherlands, and Spain. So, why is Indonesia still banning the use of medical marijuana? This research tries to find the legal reasoning of Indonesia's government in the medical marijuana case. These problems were then analyzed using the prescriptive method with a comparative approach to finding new concepts related to legalizing medical marijuana in Indonesia. This study indicates that medical marijuana may be legal in the future of Indonesia's regime. It demonstrates by Indonesian Ulema Council and the Ministry of Health's political wills. The research recommendations are to provide proper education about medical marijuana and the prospect of legalization in the future.

Abstract

Indonesia's climate ambition, particularly in developing an electric vehicle ecosystem, has made significant progress since 2019 through the adoption of various legal instruments leading to mining law reform. These initiatives include establishing an electric vehicle battery industry supported by downstream mining policies. This policy ensures the availability of metal ores, such as nickel, which is a key raw material for the battery industry. However, Indigenous communities living near mining areas designated as National Strategic Projects have experienced negative impacts, including environmental damage. This study posits that environmental damage is a consequence of excluding Indigenous communities from mining policy reforms, as they traditionally serve as protectors of the environment. The primary aim of this study is to analyze the importance of Indigenous peoples’ meaningful participation and to examine the tendency of Indonesia’s mining law reforms to overlook Indigenous involvement in environmental preservation. This paper employs a doctrinal and normative approach to statutory laws. The research underscores the urgency of ensuring meaningful participation of Indigenous peoples in mining law reforms and suggests methods for restoring their right to participate through available forums and legal instruments. The paper proposes several steps to accommodate Indigenous peoples’ aspirations in legislation: first, addressing the loss of identity experienced by Indigenous peoples; second, optimizing the use of existing representative offices in each province; and third, implementing a system that allows Indigenous peoples to easily express their aspirations and complaints.

Abstract

This article examines the regulation of online gambling in Indonesia through both positive legal frameworks and religious fatwas issued by Islamic organisations such as the Indonesian Ulema Council (MUI), Muhammadiyah, and Nahdlatul Ulama (NU). The study employs a legal research method with statutory, conceptual, case-based, and comparative approaches. The findings suggest that the eradication of online gambling must be carried out comprehensively by strengthening digital content moderation mechanisms, as regulated under various Indonesian laws. Content moderation may include blocking, reducing visibility, delisting, and adjusting content ranking systems. A critical first step is the enactment of a Cybersecurity and Resilience Law that positions content moderation as a primary tool to safeguard Indonesia’s digital sovereignty. In this context, fatwas from Islamic organisations play a strategic role in reinforcing moral and social dimensions in combating online gambling. The elimination of online gambling is an integral part of Indonesia's efforts to realise digital sovereignty, which remains vulnerable to foreign interference. The study recommends further research in the form of comparative studies in Muslim-majority countries, focusing on how religious fatwas contribute to the fight against online gambling and how such approaches can be contextualised across jurisdictions. This article contributes to the development of an integrative framework that combines positive legal approaches with religious values in strengthening online gambling eradication policies in the digital era.
