Abstract

Actually, many public sectors are directly related to the age of marriage, namely, the issue of population rates (infant birth rate and maternal mortality); raising the level of education; early-age marriage; until efforts to anticipate the level of divorce. Therefore, from the classical to the contemporary era, the age of marriage is indeed something that must be considered in legal policy. This aspires to achieve marital goals and help structure modern society. The data shows that there were 332,489 cases of sued divorce and 133,971 cases of divorce were submitted to religious courts during 2015 throughout Indonesia. The total number of divorce cases in PA during the year was 466,460 cases. This means that there are 1,277 divorce cases per day or 53 divorce cases every hour. Therefore, the upstream problem needs to be considered, in this case the dilemma of the minimum age of marriage. The age of marriage is also one of the themes of family law reform in various Muslim countries. There are variations in numbers and attitudes from various countries.

Abstract

This study examines the legal considerations in settling inheritance disputes involving land distribution in Selong Religious (Islamic) Court of West Nusa Tenggara. The data in this study were obtained from interviews and court decision analysis. This study shows that the practice of granting property before the death of the muwārith (testator) can cause inheritance-based land disputes in the future. Disputes usually arose when the land was distributed only to particular heirs, neglecting the others, especially the daughters and their descendants. In deciding the land disputes in inheritance cases, judges evermore considered the legal validity of the land distribution. Besides that, the judges use Islamic legal sources such as the Quran, Hadith, opinions of scholars, and fiqh in their legal considerations. However, the use of these multiple references does not necessarily lead to a diverse outcomes.  Abstrak: Penelitian ini mengkaji bagaimana pertimbangan hukum hakim dalam memutus perkara sengketa hibah tanah di Pengadilan Agama Selong, Nusa Tenggara Barat. Data pada penelitian ini diperoleh dari wawancara dan analisis putusan. Penelitian ini menunjukkan bahwa kebiasaan masyarakat menghibahkan harta sebelum kematian pewaris cenderung menjadi pemicu sengketa tanah berbasis waris di kemudian hari. Sengketa biasanya muncul dari pembagian tanah yang hanya kepada sebagian ahli waris dan merugikan sebagian ahli waris yang lain, terutama bagi anak perempuan dan keturunannya. Dalam memutus sengketa hibah tanah dalam kewarisan, hakim selalu mempertimbangkan keabsahan hukum hibah tanah dalam kasus yang diajukan. Selain itu, hakim juga menggunakan ayat-ayat al-Qur’an, hadis, pendapat ulama, dan kaidah fikih sebagai pertimbangan hukumnya.

Abstract

Medical disputes in Indonesia are regulated by a host of laws. However, the important question that needs to be asked is whether the laws have guaranteed justice for patients and doctors. This normative legal study aims to analyze the urgency of restorative justice in medical disputes. It examines secondary data which is collected through a literature study. The study focuses on legal principles with a doctrinal approach. It concludes that restorative justice is urgent to use in medical disputes for both criminal and civil cases. This is evident in the will of the Health Law which prioritizes mediation as the first mechanism before being brought to trial. Furthermore, the use of restorative justice in medical dispute resolution is driven by the presence of three conditions: First is structural challenges among law enforcers and their limited capabilities in dealing with complex medical cases; Second is the condition of Indonesian correctional institutions which is overburdened and unable to provide maximum output, and the third is the relatively low number of Indonesian health workers. (Sengketa Medis di Indonesia telah diatur dalam beberapa peraturan perundang-undangan. Namun, pertanyaan penting yang perlu diajukan yaitu apakah peraturan yang ada telah menjamin kedilan bagi pasien dan dokter. Penelitian ini bertujuan untuk menganalisis urgensi prinsip keadilan restoratif dalam penyelesaian sengketa medis. Penelitian ini merupakan penelitian hukum normatif yang mengkaji data sekunder. Pengumpulan data dilakukan dengan studi pustaka (library research), yaitu kegiatan pengumpulan data yang berasal dari berbagai literatur. Penelitian ini fokus pada asas-asas hukum dengan pendekatan dokrinal. Kesimpulan dari penelitian ini adalah bahwa prinsip keadilan restoratif penting diterapkan dalam kasus medis, pidana, maupun perdata. Ini misalnya dapat dilihat dari i’tikad baik dalam Hukum Kesehatan yang mempriorotaskan mediasi sebagai mekanisme pertama sebelum dibawa ke pengadilan. Dalam konteks sengketa medis, prinsip keadilan restoratif menjadi urgen untuk diterapkan sedikitnya karena tiga hal; pertama adalah tantangan struktural di kalangan para penegak hukum serta kemampuan mereka yang terbatas dalam menghadapi kasus medis yang biasanya kompleks. Kedua, kondisi lembaga pemasyarakatan Indonesia yang over kapastias sehingga tidak mampu memberikan output yang maksimal; dan ketiga adalah jumlah tenaga kesehatan di Indonesia yang relatif rendah.

Abstract

Education is the constitutional right of every citizen, as mandated in the 1945 Constitution of the Republic of Indonesia, so that that good education management will support the progress of a nation. The tug of war on government affairs in education carried out by the central government to local governments from districts to provinces has further distanced public services. The type of research used in compiling this research is empirical legal research. The results showed that education management had implications for the ineffective management of senior secondary education in the North Kolaka district, from budget management, management of facilities and infrastructure, and management of human resources, no longer running effectively. This situation forced the provincial government to establish a branch office in the North Kolaka district to support administrative arrangements in the North Kolaka district.Keywords: Education; Transfer of Authority; Regency and Province.

Abstract

The purpose of constitutional amendments is to grant the Supreme Court the authority to review laws and regulations in accordance with the law. However, the arrangement did not function optimally due to the government's persistent assumption of the authority to cancel Regional Regulations. In an era of regional autonomy, the purpose of this study is to examine the implementation of the ranking of laws and regulations regarding the repeal of regional legal products. This is a normative legal study utilizing secondary data. The results demonstrated that the concept of implementing the ranking of laws and regulations on the repeal of regional legal products during the era of regional autonomy was not carried out in accordance with the constitution and should have been limited while it was still in the form of draft regional regulations.

Abstract

Conservatism on Islamic Law has been widely discussed by scholars, be it in printing media (such as fiqh works of traditional ulama, and Islamic self-help books) or in online media (such as on social media platforms containing Islamic dakwah). Their studies portray the diffusion of conservative  Islamic thought from one media to another. However, among  existing works, it can be said that there has not been much discussion about how this conservatism is transmitted by a mubalig (Muslim preacher) particularly about Islamic law. Considering the function of a preacher in Indonesia is significant because has long been the main mouthpiece of Islamic teaching, this paper discussed the conservatism of Islamic family law in the Mamah dan Aa Beraksi preaching program. By using qualitative content analysis, this paper argues that the sermons in the Mamah dan Aa Beraksi contain conservative view of  Islamic family law. This conservatism is indicated by the sermons which tends to refer to traditional fiqh with a gender bias characteristic. This conservatism seems latent through the way the lecturers present her fatwa using short textual interpretations that represent traditional thinking more than modernism. [Konservatisme Hukum Islam telah banyak dibicarakan oleh para ulama, baik di media cetak (seperti literatur karya fikih ulama tradisional, dan buku swabantu Islami) maupun di media online (seperti di platform media sosial yang memuat dakwah Islam). Kajian mereka mempotret difusi konservatisme pemikiran Islam dari satu media ke media lainnya. Namun, di antara karya-karya yang ada, dapat dikatakan bahwa belum banyak pembahasan tentang bagaimana konservatisme itu ditransmisikan oleh seorang mubalig khususnya tentang hukum Islam. Mengingat fungsi mubalig di Indonesia cukup signifikan karena telah lama menjadi corong utama ajaran Islam kepada masyarakat, tulisan ini bertujuan untuk membahas konservatisme Hukum Keluarga Islam dalam program Mamah dan Aa Beraksi. Dengan menggunakan analisis isi kualitatif, tulisan ini berpendapat bahwa ceramah dalam program Mamah dan Aa Beraksi mengandung konservatisme Hukum Keluarga Islam. Konservatisme ini terlihat dari materi ceramah yang cenderung mengacu pada fikih tradisional dengan ciri bias gender. Konservatisme ini tampak laten melalui cara penceramah memaparkan argumentasi hukumnya dengan menggunakan interpretasi secara tekstual yang singkat, nan lebih merepresentasikan pemikiran tradisional daripada modernis.]

Abstract

The government has established a policy of utilizing abandoned land to develop halal tourism. However, the critical question is whether this policy, based on siyasah fiqh, impacts Indonesia's economic development. The research analyzed land reform policies, which determine abandoned land for managing halal tourism destinations based on Fiqh siyasah. This study employed normative legal studies and secondary data. The research indicated that the use of abandoned land for halal tourism development is not grounded in Islamic jurisprudence, and it potentially violates the provisions of Article 27 paragraph (2) and Article 28D paragraph (1) of the 1945 Constitution of the Republic of Indonesia, leading to violations of human rights.

Abstract

For more than five decades (since 1972), the world has increasingly directed its attention toward sustainable development, one of which encompasses the domain of green tourism. Indonesia and China stand as two nations committed to the Sustainable Development Goals and green tourism. Nevertheless, it remains uncertain whether the legal framework on green tourism in both countries has achieved comprehensiveness and the extent of its implementation's effectiveness. This article aims to explore the regulations on green tourism in Indonesia and China, along with their respective impacts. Drawing on a statute approach, this article argues that Indonesia has established multiple levels of regulations concerning green tourism as a part of its commitment to sustainable development and China. In practice, both Indonesia and China have implemented these regulations, leading to discernible positive effects on societal welfare. However, conventional regulatory overlap persists in Indonesia, and the implementation appears less than optimal. In another context, China adopts a streamlined regulatory framework and appears to have achieved greater effectiveness in the implementation of green tourism.

Abstract

Artificial intelligence changes how tourist destinations operate, provides better service to visitors, and provides long-term benefits for local communities and the environment. However, it is essential to question whether governments can effectively resolve data privacy and cybersecurity challenges when deploying these technologies. This study aims to analyze issues related to the role of artificial intelligence policy in promoting Indonesia's digital tourism. This research employs a normative legal approach, drawing from both statutory and historical sources. This research concludes that Indonesia promotes artificial intelligence in tourism by investing in AI technology research and development, collaborating between the government and the private sector to implement AI solutions, and establishing a supportive regulatory framework to ensure the ethical use of AI in tourism. The impact of digitalization policies on digital tourism includes increasing accessibility and convenience for tourists through online ordering systems and digital payment methods, developing smart destinations with Internet of Things technology and data-based insights, and enhancing tourist experiences through augmented reality applications and virtual reality.
