Abstract

This study offers a novelty specifying climate change as the legislation results in the European Parliament (EP) as an indicator of the consistency of political groups in realising their Euromanifestos. The article aims to investigate precisely the prospects and future of climate change policies in the EU post the 2019 general election. This study adopted qualitative legal research methods by studying the Euromanifestos of political groups in the European Union that competed in the 2019 European elections. Environmental issues, particularly climate change, were a significant focus in the study of these manifestos. Based on data from Euromanifesto, this study selected five EU Regulations as indicators of realising such political promises. In addition, the record of legislation and the results of voting during the establishment of the regulation was also applied as a data source in this study. In general, the cohesion between political groups in the EP is excellent. Based on a manifesto study, there are three essential findings; namely, most political groups in the EP make environmental issues, especially climate change, a politicised issue in elections. The second finding is that there are specific intersections between political groups, so it has implications for making the issue of climate change a common interest, and the results of the vote showed that a majority of Member of European Parliament members supported the establishment of the regulation. Finally, the solidarity of the EP political group cohesion in establishing regulations related to climate change is the last finding in this research.

Abstract

PT Shopee International Indonesia is a company that focuses on digital applications, especially e-commerce, and is one of the largest online marketplaces in Indonesia. This online shopping system offers the latest innovations in credit-based payment methods without collateral, such as pay later, along with the advancement of the digital world. This research seeks to find out the procedures for implementing transactions, resolving non-performing loans, and legal protection provided to Fintech Lending (financial technology) organizers in Shopee Pay-Later. This includes identifying the rights and obligations of the parties involved, as well as the legal consequences of the Shopee Pay-later credit financing agreement. The research uses an empirical legal research method, which uses a problem-solving approach to data collected from observations and study findings. The research findings show that in order to finance a Shopee Pay-later unsecured credit agreement, buyers must electronically sign an agreement confirming that they accept its terms. The parties are obligated by the terms of the agreement, under which they must not contravene the relevant laws and regulations and must fulfil their rights and obligations according to the financing agreement. The district court or arbitration can be used to sue either party if they commit a default, as specified in Article 1243 of the Civil Code, or violate the law, as specified in Article 1365 of the Civil Code.   Abstrak Shopee International Indonesia adalah perusahaan yang fokus pada aplikasi digital, terutama e-commerce, dan merupakan salah satu pasar online terbesar di Indonesia. Sistem belanja online ini menawarkan inovasi terbaru dalam metode pembayaran berbasis kredit tanpa agunan, seperti bayar di belakangan, seiring dengan kemajuan dunia digital. Tujuan dari penelitian ini adalah untuk mengetahui tata cara pelaksanaan transaksi, penyelesaian kredit macet, dan perlindungan hukum yang diberikan kepada penyelenggara Fintech Lending (financial technology) di Shopee Pay-later. Hal ini termasuk mengidentifikasi hak dan kewajiban para pihak yang terlibat, serta akibat hukum dari adanya perjanjian pembiayaan kredit Shopee Pay-later. Penelitian menggunakan metode penelitian hukum empiris, yaitu dengan menggunakan pendekatan pemecahan masalah terhadap data yang dikumpulkan melalui pengamatan dan temuan studi. Temuan penelitian menunjukkan bahwa untuk membiayai perjanjian kredit tanpa jaminan Shopee Pay-later, pembeli harus menandatangani perjanjian secara elektronik yang mengonfirmasi bahwa mereka menerima persyaratannya. Para pihak diwajibkan oleh ketentuan perjanjian, yang berarti mereka tidak boleh bertentangan dengan hukum dan peraturan yang relevan dan harus memenuhi hak dan kewajiban mereka sesuai dengan perjanjian pembiayaan. Pengadilan negeri atau arbitrase dapat digunakan untuk menuntut salah satu pihak jika mereka melakukan wanprestasi, seperti yang ditentukan dalam Pasal 1243 KUH Perdata, atau melanggar hukum, seperti yang ditentukan dalam Pasal 1365 KUH Perdata.

Abstract

Management rights are control rights from the state, part of which is given to the right holder. Management rights on customary land can contribute to the state and customary law communities by paying attention to the customary rights of customary law communities recognised by the constitution. This research explores the legal basis for the recognition of customary rights, the concept of management rights over customary rights, and how the time limit for management rights cooperated with third parties can provide justice to Indigenous peoples. The method employed is the normative legal method, utilising both statutory and conceptual approaches. The research results highlight a legal vacuum regarding the time limit of management rights when engaging with third parties, where legal protection to the parties cannot be provided due to a legal vacuum. This gap in legal protection necessitates prompt regulation to set time limits that are equitable for Indigenous communities to ensure certainty, justice and legal protection for all parties involved. Abstrak Hak pengelolaan merupakan hak menguasai dari negara yang sebagian pelaksanaannya diberikan kepada pemegang haknya. Hak pengelolaan di atas tanah ulayat dapat memberikan konstribusi bagi negara dan masyarakat hukum adat dengan memerhatikan Hak ulayat masyarakat hukum adat yang di akui oleh konstitusi. Tujuan penulisan ini untuk menganalisis  pengakuan hak ulayat, kedua konsep hak pengelolaan diatas hak ulayat, ketiga dan batasan waktu hak pengelolaan yang dikerjasamakan kepada pihak ketiga dapat memberikan keadilan kepada masyarakat hukum adat. Metode yang digunakan adalah  metode penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukan bahwa kekosongan hukum mengenai batasan waktu hak pengelolaan yang akan dikerjasamakan kepada pihak lain/ketiga, yang dimana perlindungan hukum kepada para pihak tidak dapat diberikan karena adanya kekosongan hukum, sehingga demi menjamin kepastian, keadilan dan perlindungan hukum bagi pihak ketiga, terkhusus masyarakat hukum adat, maka perlunya segera diatur batasan waktu yang berkeadilan bagi masyarakat hukum adat.

Abstract

This article critically examines how Indonesia’s legal framework for energy transition integrates human rights, particularly the right to a clean, healthy, and sustainable environment. As a Global South country balancing climate goals with socio-economic development, Indonesia is legally bound both constitutionally and internationally to pursue a just and inclusive energy transition. While prior studies often treat environmental rights and climate governance as distinct areas, this article contributes to a growing body of scholarship that bridges human rights law and energy governance in postcolonial contexts. It offers one of the first systematic legal analyses of how Indonesia’s energy laws support or fall short of its environmental rights obligations. Using a doctrinal legal research methodology, the study combines statutory and conceptual analysis to assess coherence and effectiveness in national energy legislation. It identifies three major challenges: institutional fragmentation, conflicting legal instruments, and structural fossil fuel dependence. These barriers hinder the realisation of environmental rights and expose tensions between economic imperatives and human rights commitments. The article advances the academic conversation by foregrounding climate justice and rights-based legal reform as essential for sustainable transition pathways in the Global South. It argues that without embedding human rights principles into energy law and policy, Indonesia risks perpetuating exclusion and inequality. The study calls for harmonised legislation, institutional coordination, and a rights-based approach to align the energy transition with both constitutional duties and global human rights norms.

Abstract

Indonesia's climate ambition, particularly in developing an electric vehicle ecosystem, has made significant progress since 2019 through the adoption of various legal instruments leading to mining law reform. These initiatives include establishing an electric vehicle battery industry supported by downstream mining policies. This policy ensures the availability of metal ores, such as nickel, which is a key raw material for the battery industry. However, Indigenous communities living near mining areas designated as National Strategic Projects have experienced negative impacts, including environmental damage.This study posits that environmental damage is a consequence of excluding Indigenous communities from mining policy reforms, as they traditionally serve as protectors of the environment. The primary aim of this study is to analyze the importance of Indigenous peoples’ meaningful participation and to examine the tendency of Indonesia’s mining law reforms to overlook Indigenous involvement in environmental preservation. This paper employs a doctrinal and normative approach to statutory laws.The research underscores the urgency of ensuring meaningful participation of Indigenous peoples in mining law reforms and suggests methods for restoring their right to participate through available forums and legal instruments. The paper proposes several steps to accommodate Indigenous peoples’ aspirations in legislation: first, addressing the loss of identity experienced by Indigenous peoples; second, optimizing the use of existing representative offices in each province; and third, implementing a system that allows Indigenous peoples to easily express their aspirations and complaints.

Abstract

The dynamism of the implementation of general elections in Indonesia is directly related to the legal products that regulate them. In this case, legal politics that continue to change legal products can further complicate the systems, mechanisms, and behavior of general election organizers and participants, and make them vulnerable to future general election disputes. This article aims to explain how the legal politics of the Constitutional Court's decision regarding the Regional General Election Law influences changes to the Regional Head Election Law, as well as its responsiveness to regional head general elections. This article uses a normative legal research method with a statute approach which focuses on the analysis of Constitutional Court decisions regarding regional head elections. In addition, the author presents a comparison of the legal politics of general election regulation in Indonesia and in the USA and Europe. This article finds that the Constitutional Court's authority to adjudicate regional elections has become permanent after almost a decade and a half of legal uncertainty and doubt. During that time, legal politics in several Constitutional Court decisions regarding regional head election cases had a similar character, namely producing responsive legal products. This indicates that democracy in Indonesia is built based on fulfilling human dignity, fairness, and justice. Thus, the issue of regional head general elections could have its origins in other things but not in the legal politics of the Constitutional Court's decision and its influence on related laws.

Abstract

The advantages of this article are discussing the Prohibition of Dynastic Politics from a Human Rights Perspective and Legal Formulas to Minimize Dynastic Politics as well as comparisons in three ASEAN countries. The research results concluded that the practice of dynastic politics cannot be separated from a human rights perspective, especially political rights for citizens. However, on the other hand, if it continues, the practice of dynastic politics can damage democratic principles. This is also based on comparisons in Singapore, Thailand and the Philippines. For this reason, in this article, the author provides a legal formula to minimize the negative excesses of dynastic politics, namely by strengthening the conditions for presidential/vice presidential candidates, gubernatorial candidates, mayoral candidates, and regent candidates in internal political parties. So that political parties will also strengthen the party system so as to avoid collusion and nepotism. To minimize dynastic politics, it is necessary to improve the culture within political parties. The reconstruction of the design of a democratic presidential candidacy is to prioritize the process of deliberation and consensus. Through the formation of the Party Consultative Assembly, it is hoped that it will be able to overcome and interpret the ideological ideals of political parties and the ideals of political leadership. This needs to be regulated in the Memorandum of Association/Articles of Association of Political Parties and the revision of the Political Party Law and Election Law. Furthermore, the analysis used normative legal research, including statutory, comparative, and conceptual methods.

Abstract

This article examines the regulation of online gambling in Indonesia through both positive legal frameworks and religious fatwas issued by Islamic organisations such as the Indonesian Ulema Council (MUI), Muhammadiyah, and Nahdlatul Ulama (NU). The study employs a legal research method with statutory, conceptual, case-based, and comparative approaches. The findings suggest that the eradication of online gambling must be carried out comprehensively by strengthening digital content moderation mechanisms, as regulated under various Indonesian laws. Content moderation may include blocking, reducing visibility, delisting, and adjusting content ranking systems. A critical first step is the enactment of a Cybersecurity and Resilience Law that positions content moderation as a primary tool to safeguard Indonesia’s digital sovereignty. In this context, fatwas from Islamic organisations play a strategic role in reinforcing moral and social dimensions in combating online gambling. The elimination of online gambling is an integral part of Indonesia's efforts to realise digital sovereignty, which remains vulnerable to foreign interference. The study recommends further research in the form of comparative studies in Muslim-majority countries, focusing on how religious fatwas contribute to the fight against online gambling and how such approaches can be contextualised across jurisdictions. This article contributes to the development of an integrative framework that combines positive legal approaches with religious values in strengthening online gambling eradication policies in the digital era. Artikel ini mengkaji pengaturan judi online di Indonesia melalui perspektif hukum positif dan fatwa-fatwa yang dikeluarkan oleh organisasi keagamaan Islam, seperti Majelis Ulama Indonesia (MUI), Muhammadiyah, dan Nahdlatul Ulama (NU). Penelitian ini menggunakan metode penelitian hukum dengan pendekatan perundang-undangan, konseptual, kasus, dan perbandingan. Temuan studi ini menunjukkan bahwa pemberantasan judi online harus dilakukan secara komprehensif melalui penguatan mekanisme moderasi konten digital yang telah diatur dalam berbagai peraturan perundang-undangan di Indonesia. Moderasi konten dapat meliputi pemblokiran, penurunan visibilitas, delisting, dan sistem pemeringkatan konten. Langkah awal yang krusial adalah pembentukan Undang-Undang Keamanan dan Ketahanan Siber yang menjadikan moderasi konten sebagai instrumen utama untuk menjaga kedaulatan digital Indonesia. Dalam konteks ini, fatwa dari organisasi Islam memiliki peran strategis sebagai penguatan moral dan sosial dalam memerangi perjudian daring. Pemberantasan judi online merupakan bagian integral dari upaya mewujudkan kedaulatan digital Indonesia, yang saat ini masih rentan terhadap infiltrasi pihak asing. Penelitian ini merekomendasikan kajian lebih lanjut dalam bentuk studi perbandingan di negara-negara berpenduduk mayoritas Muslim mengenai kontribusi fatwa keagamaan dalam memberantas judi online, guna memperoleh pendekatan yang khas dan kontekstual di masing-masing negara. Artikel ini berkontribusi dalam memberikan kerangka pemikiran integratif antara pendekatan hukum positif dan nilai-nilai keagamaan dalam penguatan kebijakan penanggulangan judi daring di era digital.
