Abstract

Integritas seorang aparat penegak hukum adalah kunci utama dalam mewujudkan pelayanan yang adil bagi masyarakat sebab diperlukan adanya kejujuran dan kepatuhan terhadap aturan yang telah berlaku. Namun dalam praktik di lapangan, masih ditemui adanya praktik pungli dalam ranah pelayanan publik, salah satunya dalam proses pembuatan SIM yang berada dalam wilayah hukum Polda NTT. Penelitian ini menggunakan metode penelitian yuridis empiris yakni penelitian yang mengkaji secara langsung fenomena pungli pembuatan SIM yang terjadi di lapangan, proses penegakan hukum, dan hambatan dalam penegakan hukum dengan melakukan wawancara dengan Perwira Urusan SIM Polda NTT, petugas Kepolisian Bidang Profesi dan Pengamanan Polda NTT, juga masyarakat sebagai korban pungli pembuatan SIM. Hasil penelitian menunjukkan: (1) Penegakan Hukum Terhadap Anggota POLRI yang Melakukan Pungli dalam Pembuatan SIM di Wilayah Hukum Polda NTT terdiri dari (a) Pemeriksaan pendahuluan, untuk mengetahui ada atau tidaknya dugaan pungli pembuatan SIM; (b) Pemeriksaan Selanjutnya, dengan melakukan pemanggilan orang-orang yang terlibat dan melakukan gelar perkara; (c) Pemberkasan, yaitu pelimpahan berkas perkara kepada ankum; (d) Persidangan; (e) Pemberian sanksi hukuman disiplin; (f) Pelaksanaan hukuman; (g) Pemulihan dalam bentuk pengembalian hak-hak oknum anggota Polri. (2) Hambatan yang dihadapi dalam Penegakan Hukum Terhadap Anggota Polri yang Melakukan Pungli dalam Pembuatan SIM di Wilayah Hukum Polda NTT yaitu faktor perundang-undangan dimana aturan yang ada masih belum tegas, faktor penegak hukum dimana pelakunya adalah aparat penegak hukum, faktor sarana/fasilitas yaitu jaringan dan ketiadaan fasilitas komputer, faktor masyarakat takut untuk melapor, faktor budaya yang telah mendarah daging, dan faktor geografis sehingga kesulitan membangun komunikasi dengan Propam di daerah.

Abstract

This study examines the Restorative Justice system in BNNP NTT, particularly focusing on the rehabilitation of drug addicts. Issues such as stigma, labeling, limited social support, mental health challenges, and post-rehabilitation job access constraints are identified. By integrating the Transtheoretical Model Theory and Reintegrative Shaming Theory, the research delineates six stages of behavior change at the Rehabilitation Center of BNNP NTT. Recommendations include enhancing education, social support, and collaboration. The research methodology employed is normative research, meaning it involves an examination of relevant laws and other legal sources. Primary legal materials, secondary legal materials, and tertiary legal materials are utilized. Social reintegration can be improved through effective awareness campaigns via social media and community activities. In conclusion, BNNP NTT needs to intensify efforts to support the Restorative Justice System, emphasizing education, social support, and collaboration to enhance the rehabilitation of drug addicts.

Abstract

The role of the police in combating street crime, particularly extortion, is a crucial issue in maintaining public order and ensuring economic stability in Kupang City, Indonesia. This study focuses on the preventive and repressive measures implemented by the Kupang City Police to address extortion targeting kiosks and shop owners in Liliba Village. Using an empirical legal research method, data were collected through field observations and interviews with relevant stakeholders, including police officers and victims of extortion. The findings reveal that the Kupang City Police employ various strategies such as routine patrols, community engagement programs, and technology like CCTV to mitigate these criminal acts. Challenges faced include societal issues such as alcohol consumption, economic disparity, limited trust in law enforcement, and low legal awareness among residents. Despite these hurdles, implementing integrated law enforcement measures, supported by educational programs and technological advancements, has shown progress in reducing criminal activities. This study underscores the importance of collaboration between law enforcement agencies and the community to ensure sustainable crime prevention. Recommendations include strengthening patrols, enhancing community trust, and providing consistent legal education to effectively address societal and systemic challenges.

Abstract

Recently in the city of Kupang there are often cases of theft of handphone which greatly disturb the security and public order in the city of Kupang. Therefore, according to the author, it is necessary to take countermeasures. This countermeasure effort is the responsibility of the Kupang City Police because their duties are law enforcement and maintaining order. The purpose of writing this thesis is to find out the factors that cause someone to steal a handphone in the Kupang City Police District Law area and to find out the efforts of the Police in tackling handphone theft in the Kupang City Police District Law area. The research method used is empirical juridical research, namely examining events in the field related to handphone theft, the factors that cause someone to steal a handphone in the Kupang City Police Legal area and the Police's efforts in tackling handphone theft in the Kupang City Police Law area with techniques interviews with members of the police and then the results of the interviews were analyzed qualitatively. The results of the study concluded: The factors of the occurrence of the crime of handphone theft in Kupang City are economic factors, environmental factors and victim negligence factors. As well as the efforts made by the Kupang City Police, namely pre-emptive, preventive and repressive efforts, and it is hoped that the Kupang City government will pay more attention to the welfare of the community by providing employment opportunities, it is hoped that there will be cooperation from the Kupang City Police and the community, increasing the effectiveness of Bhabinkamtibmas, and it is hoped that the Kupang City Police will increase the effectiveness of the disclosure of handphone theft cases.

Abstract

This study examines the legal analysis of the crime of ganging up on traffic accident perpetrators in Kupang Regency. The background of this study is based on the high number of violent crimes that occur in Indonesia, even though this country was founded on the basis of law as regulated in Article 1 paragraph (3) of the 1945 Constitution. Based on the background of this study, two problem formulations were found (1) How is the legal review of traffic accidents according to Law No. 22 of 2009 concerning Traffic and Road Transportation? (2) What are the legal consequences for perpetrators of ganging up on traffic accidents according to the Criminal Code. This study aims to reveal the legal review of traffic accidents according to Law No. 22 of 2009 and analyze the legal consequences for perpetrators of ganging up on traffic accidents based on the Criminal Code (KUHP). The research methods used include field research with interviews and library research with a legal and legislative concept analysis approach. The results of the study indicate that cases of ganging up on traffic collision perpetrators often occur due to low legal awareness, the influence of alcohol, and lack of recognition from other perpetrators. This study contributes to the understanding of criminal law, especially related to the handling of ganging up crimes in the context of traffic accidents.

Abstract

Villages are a part of the Indonesian government that has a strategic role and function to assist the country's development. Despite this, many villages still face many problems related to public services, village financial management, low community participation in development, and a lack of legal understanding of good village management and governance according to applicable regulations, one of which is O'A Mate Village. To enable villages to develop and provide much better services to the community, efforts are needed to improve the capacity of village officials. This capacity building training for village officials was conducted in O'A Mate Village, Northwest Alor Sub-District, Alor Regency, and aimed to improve the knowledge and skills of village officials in the management of village governance and development, especially related to Law No. 6/2014 on Villages and the value of having good behavior. This community service activity was carried out in O'A Mate Village, Northwest Alor District, Alor Regency. The method used in this socialization is by means of face-to-face / lecture, discussion or in-depth dialogue about the material that has been presented with the participants. During the socialization, participants were quite active in asking questions about the material presented by the resource person. This was shown by active discussions and questions and answers between participants and resource persons. According to some participants, this activity showed that they had gained knowledge and understanding of the importance of increasing the capacity of village officials in carrying out their duties and responsibilities as village officials in accordance with Law No. 6/2014 on Villages. The participants acknowledged that the material presented by the service to society team was new and had never been heard or known by the community about the value of BeRAKHLAK in performing services as village officials. Finally, the service to society team can conduct socialization to improve the insights, knowledge and skills of village officials on how to manage village governance and development in a better way.
