Abstract

Penyelenggaraannya Badan Usaha Milik Desa yang dilakukan oleh setiap desa ini tidaklah selalu berjalan sesuai harapan. Dari beberapa unit usaha yang dijalankan oleh Desa Ile Boli tidak semua berjalan dengan lancar dikarenakan adanya beberapa kendala yang dimana disebapkan oleh beberapa anggota yang bekerja pada badan usaha milik desa tidak semata-mata hanya bekerja disana, namun mereka juga memiliki pekerjaan lain seperti berkebun yang dimana merupakan mata pencarian utaman untuk mereka,factor lain yang juga mempengaruhi yaitu kurangnya partisipasi masyarakat yang secara aktif dalam meningkatkan usaha yang dimiliki oleh desa mereka sendiri, kemampuan karyawan dalam menjalankan tugas yang dimana terkadang tidak sesuai dengan kemampuan yang mereka miliki, yang akan menjadi masalah utama dalam penelitian ini adalah (1)Bagaimana pengelolaan Badan Usaha Milik Desa Ile Boli dalam meningkatkan kesejahteraan masyarakyat Desa Ile Boli? (2) Apa faktor penghambat dari pengelolaan Badan Usaha Milik Desa dalam meningkatkan kesejahteraan masyarakyat Desa Ile Boli? Untuk mengidentifikasi permasalahan dalam penelitian tersebut peneliti menggunakan jenis penelitian hukum empiris yang fokus kajiannya adalah untuk melihat pengelolaan badan usaha milik desa yang dimana dalam hal ini untuk mengetahui pengelolaan badan usaha milik Desa Ile Boli dalam meningkatkan kesejahteraan masyarakat. Pendekatan yang digunakan dalam penelitian ini yaitu pendekatan lapangan. Hasil dari penelitian ini menunjukan bahwa pengelolaan badan usaha milik desa yang ada di Desa Ile Boli pada awalnya berjalan dengan baik jika dianalisis dari beberapa faktor yaitu perencanaan, pengorganisasian, pelaksanaan dan evaluasi, namun seiring dalam beberapa waktu terakhir beberapa unit usaha yangdijalankan mengalami beberapa masalah yaitu penyebaran wabah covid-19, kurangnya kepercayaan dari pengurus badan usaha milik desa terhadap masyarakat desa, kurangnya minat dari masyarakat untuk membeli perabotan rumah tangga serta kurangnya peralatan perbaikan yang ada di bengkel motor. Faktor penghambat dalam pengelolaan yaitu rendahnya sumber daya manusia dan rendahnya sosialisasi, partisipasi masyarakat desa dan kurangnya akses terhadap teknologi.

Abstract

Education plays an important role in shaping the character and personality of the younger generation, including in the school environment. One of the social problems that often occurs in schools is bullying, which has a negative impact on the mental and physical well-being of the victim. Bullying can affect the mental health of the victim, causing anxiety, depression, and physical disorders, as well as disrupting the learning atmosphere. Waikabubak Christian Middle School, as an educational institution in West Sumba Regency, plays an important role in creating a safe and comfortable school environment. Therefore, socialization was carried out to prevent bullying, by involving students and teachers and educating them about the dangers of bullying, the importance of mutual respect, and children's rights protected by the Child Protection Law. The implementation of this socialization used an interactive approach such as seminars, group discussions, and ice-breaking games to increase student awareness. The results of the socialization showed that most students previously considered bullying to be normal, but after being given further understanding, they began to realize its negative impacts, both for victims and perpetrators. It is hoped that this activity can create a school environment that is free from violence and supports the optimal development of students.

Abstract

This research was carried out in Maulafa District, Kupang City in November 2023 until completion. The formulation of the problem in this research is: How are Presidential Regulation Number 72 of 2021 concerning the Acceleration of Stunting Reduction and its Implementation in Maulafa District, Kupang City, and What are the efforts of the Maulafa District Government in handling Stunting.This research uses normative juridical and empirical juridical research methods. The data collection techniques used are: Interviews, Study of documents/literature in the form of books, legislation, journals and other written materials related to the research topic. The data analysis technique is, all information that has been processed is analyzed using normative juridical and empirical juridical methods in accordance with the data obtained while still paying attention to theories, principles and legal rules relating to Presidential Regulation Number 72 of 2021 concerning the Acceleration of Stunting Reduction and its Implementation in Maulafa District, Kupang City. Suggestions in this writing: The government needs to make additional regulations or efforts in handling cases of stunting. Based on the data obtained, it is stated that the low level of community participation in preventing stunting is one of the causes of the high stunting rate in Maulafa sub-district.

Abstract

Peraturan Desa, Peraturan Kepala Desa, dan Peraturan Bersama merupakan tiga perangkat hukum utama desa. Karena peraturan desa berfungsi sebagai landasan hukum untuk menyusun tata kelola pemerintahan desa, maka peraturan desa merupakan produk hukum yang paling tepat menggambarkan kemandirian desa di antara ketiganya. Peraturan Desa dimaksudkan untuk memenuhi kebutuhan masyarakat yang dinamis dan terus berubah, selain mengharuskan kepatuhan terhadap peraturan yang lebih ketat. Tujuan dari kegiatan ini adalah untuk membantu masyarakat Noelbaki lebih menghargai nilai partisipasi mereka dalam pembuatan undang-undang desa sehingga peraturan akhir lebih sesuai dengan kebutuhan mereka. Metode yang diterapkan dalam sosialisasi ini meliputi interaksi langsung, ceramah, serta diskusi atau dialog mendalam mengenai materi yang telah disampaikan. Selama sosialisasi, peserta menunjukkan antusiasme tinggi dengan aktif mengajukan pertanyaan kepada narasumber terkait materi yang mereka terima. Tujuan dari kegiatan ini adalah untuk meningkatkan pemahaman masyarakat terhadap proses pembuatan peraturan desa sesuai dengan Undang-Undang Nomor 6 Tahun 2014. Sebagai hasilnya, masyarakat lebih nyaman menyuarakan tujuan mereka dan memahami betapa pentingnya konsensus saat membuat peraturan desa. Masyarakat kini lebih sadar akan hak dan kewajiban mereka untuk ikut aktif dalam pembangunan desa, melalui materi yang disampaikan, seperti pembentukan peraturan desa sesuai Undang-Undang Nomor 6 Tahun 2014, peran serta dalam musyawarah desa, dan pentingnya kolaborasi antara pemerintah desa dan warga. Keterlibatan masyarakat dalam membuat peraturan desa meningkat sebagai hasil sosialisasi ini, tetapi kerja lanjutan masih diperlukan untuk menjamin keberlanjutan hasilnya.

Abstract

This study aims to examine the role of customary institutions in the development of Tengku Lawar Village and Lamba Keli Village located in Lamba Leda District, East Manggarai Regency, with the legal basis of the Minister of Home Affairs Regulation Number 18 of 2018. In this study, an empirical legal approach was used with data collection through interviews, observations, and document studies. The results of the study indicate that customary institutions have a very important role in several aspects, namely: (1) maintaining and preserving cultural identity through a series of traditional ceremonies such as Penti, Kalok, and Wagal; (2) protecting the customary rights of the community through the tente teno system; (3) encouraging the implementation of deliberation and consensus, or what is known as lonto leok; (4) resolving disputes related to customs; and (5) regulating community life in accordance with applicable customary law. However, in carrying out these functions, customary institutions face several obstacles, including limited understanding of the law, low quality of human resources (especially those with basic education), and minimal allocation of funds after the COVID-19 pandemic. This study highlights the need for collaboration between village governments and traditional institutions to integrate local wisdom with modern development.

Abstract

This research was conducted in Weri Village, Larantuka District, East Flores Regency in July 2024 until completion. The formulation of the problem is: To what extent are the duties and functions of the Lurah in public services in Weri Village, Larantuka District, East Flores Regency and What are the factors that influence the duties and functions of the Lurah in public services in Weri Village, Larantuka District, East Flores Regency. The benefits of this research are to contribute to the development of science, especially in the field of Constitutional Law and input for the Weri Village government in carrying out public services. This research uses an empirical legal research method. The data collection techniques used are: Observation, Interviews and Literature Studies in the form of books, laws and regulations, journals and other written materials related to the research topic. The data analysis technique is that all information processed is analyzed using empirical legal methods according to the data obtained by paying attention to the theory, principles and legal rules related to the duties and functions of the Lurah in public services. Suggestions in this writing: The East Flores Regency Government needs to pay attention to the Weri Village organization and the community is expected to be more active in providing feedback regarding services in Weri Village.

Abstract

Purpose: This study aims to analyze the impact of Constitutional Court Decision Number 90/PUU-XXI/2023 on the development of dynastic politics and its implications for democracy in Indonesia ahead of the 2024 General Election. Method: This research employs a qualitative descriptive method supported by normative legal analysis, drawing from constitutional provisions, court decisions, literature reviews, and survey data. This approach allows for a comprehensive examination of the intersection of law, politics, and democratic values. Results: The findings reveal that the Constitutional Court’s decision—permitting presidential or vice-presidential candidacy for individuals under 40 years of age if they have held an elected regional office—has intensified concerns regarding political dynasties. The public perceives this decision as favoring elite family interests, particularly the nomination of President Joko Widodo’s son, Kaesang Pangarep. This event reflects democratic backsliding and threatens the principle of equality before the law, creating imbalances in political competition and weakening public trust in the integrity of elections. Conclusion: Dynastic politics, legitimized through judicial decisions with potential conflicts of interest, pose a serious threat to Indonesia’s democracy. Although not illegal, dynastic politics undermines democratic norms, transparency, and equal opportunities in political participation. Limitations: This study is limited by its reliance on secondary data and the recent timeframe surrounding the 2024 election, which may restrict generalizability. Contributions: This study contributes to the discourse on democracy and legal politics by highlighting the urgent need for institutional reform, political party responsibility, and judicial impartiality to safeguard Indonesia’s democratic future.

Abstract

Villages are a part of the Indonesian government that has a strategic role and function to assist the country's development. Despite this, many villages still face many problems related to public services, village financial management, low community participation in development, and a lack of legal understanding of good village management and governance according to applicable regulations, one of which is O'A Mate Village. To enable villages to develop and provide much better services to the community, efforts are needed to improve the capacity of village officials. This capacity building training for village officials was conducted in O'A Mate Village, Northwest Alor Sub-District, Alor Regency, and aimed to improve the knowledge and skills of village officials in the management of village governance and development, especially related to Law No. 6/2014 on Villages and the value of having good behavior. This community service activity was carried out in O'A Mate Village, Northwest Alor District, Alor Regency. The method used in this socialization is by means of face-to-face / lecture, discussion or in-depth dialogue about the material that has been presented with the participants. During the socialization, participants were quite active in asking questions about the material presented by the resource person. This was shown by active discussions and questions and answers between participants and resource persons. According to some participants, this activity showed that they had gained knowledge and understanding of the importance of increasing the capacity of village officials in carrying out their duties and responsibilities as village officials in accordance with Law No. 6/2014 on Villages. The participants acknowledged that the material presented by the service to society team was new and had never been heard or known by the community about the value of BeRAKHLAK in performing services as village officials. Finally, the service to society team can conduct socialization to improve the insights, knowledge and skills of village officials on how to manage village governance and development in a better way.

Abstract

This study analyzes the constitutionality of Indonesia’s forest protection within the decentralization regime by combining normative and empirical approaches. Article 28H paragraph (1) of the 1945 Constitution guarantees every person the right to a good and healthy environment; however, data from 2019-2025 reveal a significant gap between constitutional norms and practice: 2,133 cases of illegal logging in Sulawesi, 22,000 hectares of forest fires in Riau, Sonokeling logging in TTU valued at IDR 600 million, and the smuggling of 55 containers of illegal timber through sea routes. The study finds that fragmented authority due to decentralization, weak inter-agency coordination, and limited enforcement capacity have created an enforcement gap that results in violations of citizens’ constitutional rights. Using the frameworks of environmental constitutionalism, multi-level governance, and the rule of law, this research argues that the state’s failure to fulfill its obligations in forest management under Articles 28H and 33 of the 1945 Constitution constitutes a denial of the public trust doctrine. The main recommendations include establishing a “Green Constitutional Authority,” creating cross-provincial task forces, harmonizing central–regional regulations, and implementing a model of constitutional-based forest governance to ensure forest protection as a constitutional commons that is ecologically just and sustainable.
