Abstract

Perkawinan merupakan bagian hidup yang sakral, karena harus memperhatikan norma dan kaidah hidup dalam masyarakat. Dengan berbagai alasan pembenaran, perkawinan dilakukan melalui berbagai model seperti kawin bawa lari, kawin kontrak hingga perkawinan yang populer di masyarakat, yaitu kawin siri. Perkawinan yang tidak dicatatkan itu dikenal dengan istilah lain seperti ‘kawin bawah tangan’ atau nikah agama, yaitu perkawinan yang dilakukan berdasarkan aturan agama atau adat istiadat dan tidak dicatatkan di kantor pegawai pencatat nikah (KUA).Perkawinan siri banyak menimbulkan dampak buruk bagi kelangsungan rumah tangganya. Akibat hukum bagi perkawinan yang tidak memiliki akte nikah, secara yuridis suami/isteri dan anak yang dilahirkannya tidak dapat melakukan tindakan hukum keperdataan berkaitan dengan rumah tangganya. Anak-anak hanya diakui oleh negara sebagai anak luar kawin yang hanya memiliki hubungan keperdataan dengan ibu dan keluarga ibunya. Isteri dan anak yang ditelantarkian oleh suami dan ayah biologisnya tidak dapat melakukan tuntutan hukum baik pemenuhan hak ekonomi maupun harta kekayaan milik bersama.Dampak buruk dari perkawinan siri merupakan akibat dari pemahaman yang tidak komprehensif terhadap Undang-Undang Perkawinan dan lemahnya penegakan hukum untuk melindungi para korban. Seyogyanya pemerintah segera mengamandemen semua produk Hukum Perkawinan disesuaikan dengan kondisi riil masyarakat yang melindungi semua golongan dan kepentingan.

Abstract

This study aims to determine and analyze the implementation of the provision of land dowry in marriage according to national defense law, as well as the legal protection status of ownership of land rights in marriage dowry in Tanralili District, Maros Regency. In addition, it also aims to find out and analyze legal protection for women who receive dowry land in marriage in Tanralili District, Maros Regency. In addition to field research, namely open interviews with a number of local government officials such as the Head of BPN Maros Regency, Tanralili Sub-District, Head of KUA Tanralili District, as well as questions and answers with several residents who married with land as their dowry, a literature study was also conducted (Library Research) by studying related laws and regulations, books, journals, and articles obtained through the internet. Data analysis is carried out using qualitative and normative analysis techniques. The result of this study is that the implementation of dowry in marriage of national land law is valid or permissible as long as legal certainty in terms of certificates is submitted at the time of marriage contract if and according to national land law if registered with the national land office by first proving by a deed of grant made by the Land Deed Making Officer (PPAT). And Legal protection for women who receive land, the provision of dowry in marriage in Tanralili District, Maros Regency, which is the strongest on land, is a certificate made by the local land office, further suggestion that the granting of dowry in marriage can be recognized for its implementation according to national land law.

Abstract

Divorce in Manipi Village, Pana District, Mamasa Regency still uses customary Law. Mamasa is where there is no need to bring a divorce suit to court, but it can be carried out according to custom; apart from that, there are also customary sanctions for perpetrators of divorce. This writing uses nonmatof research with a statutory and conceptual approach. Divorce according to custom in Manipi Village, Pana Subdistrict, Mamasa Regency, namely through customary judges and the local government, and giving Mamasa customary divorce sanctions (Kapaa) based on Tana' (caste) where the customary sanctions are in the form of buffalo and pigs, but due to developments the times, the payment of Kapaa at this time is by the agreement of the family in a case in the form of money or anything that costs a pig or buffalo.

Abstract

This study aiming For analyze pattern connection law between the parties namely perpetrator business, party consumers, and influencers who advertise and to analyze protection law consumer to product dangerous promoted? celebrity through endorsements on Instagram. The method used in study that is method law normative. In research this , material the law used differentiated into two, namely primary and secondary. The results of the research show that activities carried out between perpetrator business, celebrity, and consumer cause existence connection law Agreement Work as regulated in 1601a of the Civil Code. The perpetrator business and consumers have connection law, namely agreement sell purchase as regulated in Article 1457 of the Civil Code. Abstract

The digital era is driving significant transformations in the protection of intellectual property rights, including patent rights. The emergence of blockchain technology, with its characteristics of decentralization, immutability, and transparency, offers new opportunities to strengthen patent protection, but also raises legal challenges related to validity, jurisdiction, and data privacy. This study is to evaluate the legal ramifications of patent infringement in the digital age and investigate the prospective implementation of blockchain technology within Indonesia's patent protection framework. The method used is normative juridical with a statutory approach and qualitative analysis of primary and secondary legal materials. The results show that blockchain has great potential in creating a more efficient and transparent patent protection mechanism, but its implementation requires legal reform and recognition of digital evidence. This study underscores the importance of a flexible and comprehensive legal framework to ensure that patent protection in Indonesia remains responsive to advancements in digital technology.
