Abstract

The 1945 Constitution established constitutional rights for citizens and emphasized the need for public participation to safeguard these rights. Citizen lawsuits serve as a form of public participation, but the absence of a legal basis in Indonesia has created uncertainty in their implementation. This study aims to examine the mechanism of citizen lawsuits within the Indonesian legal system, presenting it as a juridical alternative for protecting citizens' constitutional rights. The author utilized a normative legal research method with a qualitative and case-based approach through literature review. Citizen lawsuits enable citizens to take legal action against state officials who have neglected their rights. Courts have relied on jurisprudence and guidelines for handling environmental cases, such as the Chief Justice of the Supreme Court of the Republic of Indonesia Decree Number 36/KMA/SK/II/2013. Unlawful acts falling under the executive's jurisdiction serve as the subject of citizen lawsuits. Research on various citizen lawsuit cases demonstrates their effectiveness in defending citizens' constitutional rights. However, financial and knowledge limitations pose obstacles. Financial challenges can be addressed through community collaborations, pooling resources. To overcome knowledge limitations in filing citizen lawsuits, a dedicated regulation outlining the mechanism should be established.

Abstract

The 1945 Constitution acknowledges and protects the existence of indigenous communities. However, the existence of customary court has been abolished through Emergency Law No. 1/1951, and its legal authority is still not recognized to this day. This creates ambiguity in the administration of the justice system. Therefore, an assessment of the urgency of reconstructing Indonesia's justice system to achieve recognition of customary justice institutions is needed. In addressing this, there is a need to answer the issues concerning customary court and how the state can reconstruct the justice system. The author employs a normative legal research method with a qualitative and case study approach through literature review. Through this method, it is found that non-binding legal force of customary court decisions leads to negative consequences for indigenous people and customary law itself. Therefore, a strong legal framework is required through the enactment of the Indigenous Community Bill. Collaboration between law enforcement and indigenous people is also essential in resolving indigenous cases.

Abstract

Copyright protection in Indonesia is governed by Law No. 28 of 2014 (Law 28/2014), encompassing moral and economic rights. This law imposes limitations on the use of works for education, law enforcement, or technological development as long as such use does not harm the legitimate interests of the rightholder. The development of generative AI (GAI) poses challenges in determining the legality of using copyrighted works for GAI training. This study examines copyright regulations concerning GAI through normative, conceptual, and comparative legal approaches, including case studies on lawsuits against OpenAI and Perplexity AI. The findings indicate that the legality of using copyrighted works depends on the data input process and output (responses). Data scraping is considered an economic right of the rightholder, classified as reproduction under Article 9 of Law 28/2014. If such acts are conducted without the rightholder’s consent and for commercial purposes, they are deemed unlawful under Indonesia’s current copyright law. GAI outputs may also infringe copyright if: (1) the source is not cited, violating Article 7 on copyright management information; (2) substantial portions of the work are reproduced, violating the rightholder's economic rights under Article 9; or (3) the work is distorted in a way that harms the rightholder’s honor, infringing on moral rights under Article 5. To accommodate AI development, specific regulations integrating AI transparency principles outlined in SE Kominfo 9/2023 are required. These regulations could include obligations for AI companies to release summaries of training datasets, include Uni EropaLAs that define the responsibilities of AI developers and users, and provide disclaimers regarding AI's limitations. Regarding the fulfillment of rightholders’ economic rights, a non-exclusive blanket license through Collective Management Organizations (CMOs) as stipulated in Permenkumham 15/2024 is necessary. These regulations should be synchronized with related policies to establish legal certainty that adapts to technological advancements.

Abstract

Pemilihan kepala daerah merupakan salah satu pilar demokrasi di Indonesia yang diatur dalam Pasal 18 ayat (4) UUD 1945. Penyelesaian sengketa pemilu saat ini menjadi kewenangan Mahkamah Konstitusi. Namun dalam implementasinya, muncul berbagai tantangan terkait efektivitas dan efisiensi dalam menciptakan iklim demokrasi yang sehat. Hal ini mendorong gagasan untuk membentuk pengadilan khusus pemilu yang diharapkan dapat mengatasi tantangan-tantangan ini. Tujuan penelitian ini adalah untuk mengkaji urgensi dan legalitas pembentukan pengadilan khusus Pemilu beserta sistem dan bentuknya. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum yuridis normatif dengan memanfaatkan data sekunder dan pendekatan perundang-undangan. Penyelesaian sengketa pemilu di Indonesia telah menunjukkan inkonsistensi dalam penegakan hukum. Pembentukan lembaga peradilan khusus pemilu telah diamanatkan dalam Undang-Undang Nomor 8 Tahun 2015, namun amanat tersebut dibatalkan melalui Putusan Mahkamah Konstitusi Nomor 85/PUU-XX/2022 karena tidak adanya tindakan nyata untuk membentuk lembaga tersebut. Namun penyelesaian sengketa oleh Mahkamah Konstitusi dinilai inkonstitusional dan cacat karena tidak sesuai dengan UUD 1945 dan tidak memenuhi kebutuhan geografis Indonesia. Oleh karena itu, perlu dibentuk pengadilan khusus Pemilu sebagai satu-satunya pengadilan yang berwenang menangani sengketa pemilu, yang terdiri dari hakim ad hoc.
