Abstract

Government Regulation instead of Law No. 2 of 2022 concerning Job Creation (Perppu Cipta Kerja) narrows the community's space for movement and injustice in preparing an Environmental Impact Analysis (AMDAL). To answer this, the principle is reduced Sustainable Development Goals, which is believed to be able to answer various problems and challenges of environmental development and development. This study aims to determine the nature of community participation in the EIA process according to the principles of sustainable Development Goals. This research process will use a normative juridical method, with an approach statute approach and a conceptual approach. The presence of the Job Creation Perppu places limitations on the role of the community in preparing the EIA, which is contrary to the concept of Sustainable Development Goals.

Abstract

Dalam konstitusi Indonesia pada Pasal 24 ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 1945) bahwa, kekuasaan kehakiman dilakukan oleh sebuah Mahkamah Agung dan badan peradilan yang berada di bawahnya dalam lingkungan peradilan umum, lingkungan peradilan agama, lingkungan peradilan militer, lingkungan peradilan tata usaha negara, dan oleh sebuah Mahkamah Konstitusi. Peradilan tata usaha negara (PTUN) merupakan salah satu pelaksana kekuasaan kehakiman yang memiliki tugas serta wewenang untuk memeriksa, memutus, dan menyelesaikan sengketa Tata Usaha Negara. Dalam hal menangani kasus mengenai perbuatan melawan hukum (PMH) yang dilakukan oleh Badan dan/oleh Pejabat Pemerintahan (Onrechtmatige Overheidsdaad) selama ini diadili pada peradilan umum secara perdata. Namun terjadi pergeseran paradigma pada kompetensi absolut PTUN sejak hadirnya Undang-Undang Nomor 30 Tahun 2014 Tentang Administrasi Pemerintahan yang mana pada tertuang pada Diktum E bagian Kamar Tata Usaha Negara butir 1 huruf b Surat Edaran MA RI No. 4 Tahun 2016 menyatakan bahwa PTUN berwenang mengadili perbuatan melanggar hukum oleh pemerintah, yaitu perbuatan melanggar hukum yang dilakukan oleh pemegang kekuasaan pemerintahan (Badan dan/atau Pejabat Pemerintahan) atau onrechtmatige overheidsdaad. Lebih lanjut melalui Peraturan Mahkamah Agung Republik Indonesia Nomor 2 Tahun 2019 kembali dipertegas mengenai kewenangan PTUN dalam menangani kasus Onrechtmatige Overheidsdaad. Namun pada prakteknya masih ada beberapa perkara Onrechtmatige Overheidsdaad yang diadili pada peradilan umum yang mana membuktikan bahwa peradilan umum masih menganggap mengadili perkara Onrechtmatige Overheidsdaad masih merupakan kewenangannya.

Abstract

The circulation of illicit money is still a concern for Indonesia in realizing equitable welfare for all people. One of the sources of illicit money circulating in Indonesia comes from tax evasion, where the source can come from within or outside the country. Tax evasion is actually inseparable from money laundering, which is a sophisticated crime that requires special treatment in its enforcement. This research tries to examine mutual legal assistance (MLA) as an instrument in law enforcement on cross-border tax evasion. This study uses normative legal research methods with a statute approach and a conceptual approach and is descriptive research.  This research shows that the crime of tax evasion cannot be separated from money laundering and can be carried out across countries. To overcome this, MLA is one of the recommendations for the prevention and eradication of anti-corruption from transnational tax crimes in Indonesia. Unfortunately, this MLA approach has not been implemented effectively and efficiently because Indonesia does not have strong regulations related to asset confiscation.

Abstract

Law Number 4 of 2023 on the Development and Strengthening of the Financial Sector (UUP2SK) has provided changes to all regulatory and supervisory authorities over the operationalisation of cryptocurrencies, which were previously in the hands of the Commodity Futures Trading Supervisory Agency (Bappebti) to the jurisdiction of the Financial Services Authority (OJK). After the enactment of UUP2SK, the authority to regulate and supervise crypto assets is now under the purview of OJK, with the transition of taking over all responsibilities related to crypto assets, but there is no regulation that regulates in detail the procedures for the transfer of authority.

Abstract

Penerapan perjanjian internasional di Indonesia telah mengalami pergeseran pemaknaan di dalam penerapannya, dimana Pasal 11 ayat 2 dan 3 perubahan ketiga Undang-Undang Dasar Negara Indonesia Tahun 1945 (Pasal 11 Perubahan Ketiga UUD 1945), telah memberikan penegasan untuk merumuskan suatu Undang-Undang tentang perjanjian Internasional. Undang-Undang Nomor 24 Tahun 2000 tentang Perjanjian Internasional, hadir untuk menjawab atas penegasan Pasal 11 Perubahan Ketiga UUD 1945, namun terdapat ketidakkonsistenan didalam pengertian, status dan definisi tentang perjanjian internasional didalam sistem hukum Indonesia. Penelitian ini ditujukan untuk menjelaskan penerapan dari perjanjian internasional dalam sistem hukum di Indonesia dengan dianalisis terhadap doktrin Transformasi dan Inkorporasi. Metode penelitian ini menggunakan yuridis normatif dengan pendekatan undang-undang, doktrinal dan konseptual. Hasil penelitian menunjukkan bahwa terdapat dua aliran yang mempengaruhi penerapan hukum internasional kedalam hukum nasional melalui monisme dan dualisme. Di Indonesia dalam memaknai persoalan penerapan tersebut telah diputuskan melalui Putusan Mahkamah Konstitusi No. 13/PUU-XVI/2018 yang menjelaskan peran Dewan Perwakilan Rakyat dalam ratifikasi untuk melibatkan kepentingan publik. Dalam praktiknya, Indonesia menerapkan doktrin transformasi guna menerapkan suatu perjanjian internasional dalam hal ini hukum internasional yang telah ditetapkan menjadi hukum nasional Indonesia melalui proses legislasi di Dewan Perwakilan Rakyat.

Abstract

The fulfillment and recognition of indigenous peoples are in line with the human rights contained in the 1945 Constitution of the Republic of Indonesia. 11 of 2020 concerning Job Creation seems to be a legal umbrella for the legitimacy of indigenous peoples' rights by basing it on Article 33 of the 1945 Constitution of the Republic of Indonesia and TAP MPR RI Number IX/2001 concerning Agrarian Reform and Natural Resource Management. The government's responsibility is to provide certainty on the recognition, protection, and fulfillment of the rights of indigenous peoples until now have not been fulfilled by the state. This is contrary to the constitutional mandate as stated in Article 18B paragraph (2) of the Constitution of the Republic of Indonesia.
