Abstract

Communal land is the identity of indigenous communities whose existence is protected by the Constitution. Customary land is not only used for the purposes of indigenous peoples, but also exploited by the outsiders. This study examines how the pattern of the legal relationship between the indigenous people and to outsiders by using socio-legal research. This study was conducted in West Sumatera by limiting the study to the four natural resource sectors, namely plantations, water resources, mining and forestry. The results of this study indicate that the legal relationships that are not obvious to trigger disputes between indigenous people and outsiders. Tanah ulayat merupakan identitas masyarakat hukum adat yang diakui dan dilindungi keberadaannya oleh UUD 1945. Tanah ulayat tidak hanya digunakan untuk keperluan masyarakat hukum adat, namun juga dimanfaatkan oleh pihak luar. Penelitian ini mengkaji bagaimana pola hubungan hukum antara masyarakat hukum adat dengan pihak luar dalam pemanfaatan tanah ulayat dengan menggunakan pendekatan yuridis empiris. Penelitian ini dilakukan di Sumatera Barat dengan membatasi kajian pada 4 (empat) sektor sumberdaya alam, yaitu perkebunan, sumberdaya air, pertambangan dan kehutanan. Hasil penelitian ini menunjukkan bahwa ketidakjelasan hubungan hukum menjadi pemicu munculnya sengketa antara masyarakat hukum adat dengan pihak luar di dalam pemanfaatan tanah ulayat.

Abstract

Nagari Sumaniak has so much potential in various aspects that it can be developed. This potential has been utilized well, but there is still some potential that has not been fully utilized. In the aspect of governance, it was identified that the Sumaniak government had difficulties in drafting nagari regulations due to the lack of information obtained by the nagari governments related to the preparation of nagari regulations. Meanwhile, the readiness of human resources (governments) is needed as actors in the regions in carrying out government affairs. For this reason, it is necessary to increase the capacity of the nagari governments in drafting nagari regulations through legal drafting training for the nagari governments. The aim of this activity is to increase the understanding and ability of the nagari governments through drafting regulations in the nagari. The activity was carried out in 2020-2021 at Nagari Sumaniak. The target of this activity is the entire Nagari government in Sumaniak. The method used in this activity is the PRA (Participatory Rural Appraisal) method to prepare a CAP (Community Action Plan). Activities are carried out through various stages, such as FGD / brainstorming with nagari governments, revision and drafting of nagari regulations, as well as training related to legal drafting for nagari governments. From the various activities that have been carried out, it can be seen that there is motivation throughout the nagari governments to make a real contribution in providing ideas and support in the preparation of the nagari. Then, increase the capacity of the nagari governments in preparing the nagari after the training. All resources are committed to being able to assist in the development of the nagari. It is recommended for the nagari government to always carry out regular training and improve its quality and capacity in carrying out work professionally. Then, it is hoped that the local governments can provide further understanding to the community, especially regarding the nagari governments in making a nagari regulations.

Abstract

Abstract

As other territories in Indonesia, theusing of communal land by privateenterprise has been also creatingdisputes in West Sumatra. Accordingto the law of land procurement inIndonesia, for getting land, a privateenterprise should contact the landowners (or traditional communities)as the subject of communal land formaking contract directly. As amatter of fact, they have got the landfrom the Local Government not fromthepeople.Thecommunitiesprotested to the corporate activitieson their land. Beside that, the privateenterprises have got agrement withcommunities, but they did not followit, for instance building plasmaplantation for the communities. Thecorporates have been doing disputessettlements, but it is not effisien tosolve the problem. The communitieshave also done everything forstruggling their land, such asnegotiation even into the court. But,they have not got their rights yet. Abstract

The Assignment of members of the Indonesian National Army and the National Police of the Republic of Indonesia active as acting regional heads by the Minister of Home Affairs reaped polemics. Law Number 10 of 2016 concerning Regional Elections even though it has clearly regulated the filling of vacancies in the positions of governor, regent and mayor, where acting (Pj.) are appointed from the position of intermediate leaders for the Acting Governor and primary leaders for the Acting Regent and Mayor. However, the Minister of Home Affairs issued Minister of Home Affairs Regulation Number 4 of 2023 concerning Acting Governors, Regents and Mayors as a reference to fill the position of Acting Regional Head. Article 3 paragraph (b) of Permendagri Number 4 of 2023, contains norms stating that the acting regional head is from an ASN official or an official in a certain ASN position who occupies JPT Madya within the Central Government or within the Regional Government for candidates for Pj. Governor and occupies JPT Pratama within the Central Government or within the Regional Government for candidates for Pj. Regent and Pj. Mayor. Therefore, there is an addition of position criteria and an expansion of meaning in Permendagri Number 4 of 2023 which then becomes a gap and opportunity for the Minister of Home Affairs to appoint active TNI and Polri members to become Acting (Pj.). The formulation of the problem in this study is: (1) How is the validity of the appointment of members of the Indonesian National Army and members of the Negatra Police of the Republic of Indonesia active as Acting Regional Heads? (2) What are the criteria for the ideal official who can be appointed as Acting Regional Head? (3) What is the ideal mechanism for appointing and appointing acting regional heads to fill regional head vacancies ahead of the 2024 simultaneous regional elections? This research is a normative legal research or literature, with the research specifications used are analytical descriptive research. The results of this study are: (1) The appointment of members of the Indonesian National Army and active members of the Indonesian National Police to become Acting Regional Heads is not legally positive Indonesia at this time. (2) The position of the official who should be appointed as Pj. Regional Head shall be JPT Madya within the Central Government or within the Regional Government. (3) the ideal mechanism for the appointment and appointment of acting regional heads is to involve the people through the Senators so that the appointed PJ. still has legitimacy from the people.

Abstract

Based on Article 67 letter b of Law Number 23 of 2014 concerning Regional Government, it is explained that the Regional Head as a State Administrative Officer has an obligation to comply with all provisions of the Legislative Law including Decisions issued by the State Administrative Court. In Decision Number 11/G/2020/PTUN.PDG Regarding Dismissal of Wali Nagari Kinari by the Regent of Solok and Decision Number 23/G/2018/PTUN.PDG Concerning Dismissal of the West Pasaman Regional Secretary by the West Pasaman Regent there are forms of non-compliance committed by the Head Regions as State Administrative Officials, among others, do not revoke disputed TUN Decrees, do not revoke and do not issue new TUN Decrees. The absence of the application of strict sanctions and the low level of awareness of the TUN officials concerned are factors in the non-implementation of PTUN decisions that have permanent legal force by the Regional Head. The Administrative Court's procedural law has regulated sanctions against TUN bodies/officials who do not comply with PTUN decisions, but these arrangements are not concrete because they still depend on implementing regulations which have not been realized until now, this condition provides an opportunity for officials to disobey PTUN decisions because there is no things to worry about if you don't comply. This situation is one of the factors for weak law enforcement in Indonesia.

Abstract

Levies are a source of original regional income as regulated in Article 285 Paragraph (1) of Law Number 23 of 2014 concerning Regional Government. The authority to collect levies is regulated in Article 23A of the 1945 Constitution, then implemented by Law Number 28 of 2009 concerning Regional Taxes and Regional Levies. So far, retribution collection has been carried out in cash, and along with technological developments, this method is no longer suitable, so it has been replaced with electronic money. This provision is based on Bank Indonesia Regulation Number 20/6/PBI 2016 concerning E-Money and is reinforced by the Circular Letter of the Minister of Home Affairs Number 901/1866/SJ /2017 which regulates the Implementation of Non-Cash Transactions and Presidential Instruction Number 10 of 2016 concerning Prevention and Eradicating Corruption. West Sumatra, as one of the provinces in Indonesia, has implemented the use of E-Money facilities in 2019 through E-Money Brizzi issued by Bank Rakyat Indonesia. It's just that in practice there are deviations in implementation so that we don't get maximum results. In connection with this, the author conducted research with the title "Strengthening the Supervision Function of the Use of Brizzi E-money as a Means of Paying City/Regency Levy Fees in West Sumatra". The areas used as samples. research is Padang City, Pariaman City, and Bukittinggi City with the main problems being researched. How to strengthen the monitoring function regarding the use of e-money Brizzi as a means of paying levies in cities/regencies in West Sumatra? From the research results, strengthening the monitoring function of the use of E-Money Brizzi in City/Regency governments in West Sumatra can be carried out by the parties, namely BRI as the Issuer of E-Money Brizzi and Bapenda as the user of the E-Money Brizzi facility in collecting levies. Meanwhile, the problems found in strengthening the supervisory function for the use of these facilities are incomplete regulations as a legal umbrella to serve as technical guidance in monitoring the use of facilities at each collection agency, and there is still a lack of education and outreach to the public by the parties.

Abstract

The Natural Resources Conservation Agency (BKSDA) has one function, namely monitoring the illegal trade in wild animals, especially protected wild animals. The implementation of monitoring of illegal trade in protected wild animals by the West Sumatra BKSDA aims to protect protected wild animals from the danger of extinction and prevent trade in protected animals. However, the implementation of this function has not gone well, judging from temporary observation data showing that there is still a lot of trade in protected wild animals, especially pangolins. So, based on this, the author is interested in conducting research with the title Monitoring the Illegal Trade in Pangolins by the West Sumatra Natural Resources Conservation Agency (BKSDA).

Abstract

Pembatalan Sertipikat Hak Milik Kaum Nomor 1324/kandang Aur, Simpang Rumbio berdasarkan pada Putusan Pengadilan Negeri Kota Solok merupakan tindak lanjut dari permohonan penggugat yang merupakan pihak yang menang pada hasil putusan pengadilan negeri kota solok Nomor 13/Pdt.G/2023/PN Slk, yang menyatakan bahwa Sertipikat hak Milik 1324/ kandang Aur dinyatakan tidak memiliki kekuatan hukum yang mengikat. Adapun Rumusan masalah dalam penulisan ini adalah Bagaimanakah proses pendaftaran tanah milik kaum di kantor pertanahan Kota Solok ? Bagaimanakan proses pembatalan Sertipikat tanah milik kaum berdasarkan putusan pengadilan Negeri Kota Solok ? Bagaimanakah Kesiapan Kantor Pertanahan Kota Solok Menuju Kota Lengkap dan Sertipikat Elektronik dan tujuan penulisan ini adalah Untuk menganalisis proses pendaftaran tanah milik kaum di kantor pertanahan Kota Solok, untuk menganalisis proses pembatalan Sertipikat tanah milik kaum berdasarkan putusan pengadilan Negeri Kota Solok, untuk menganalisis Kesiapan Kantor Pertanahan Kota Solok Menuju Kota Lengkap dan Sertipikat Elektronik. Adapun metode yang digunakan adalah metode pendekatan yuridis empiris, dengan sifat penelitian deskriptif analitis, kesimpulan dari penelitian ini adalah dalam pendaftran tanah milik adat yang dilakukan oleh Datuk Pahlawan Garang ( dalam sertipikat hak milik nomor 1324, Simpang Rumbio pada tahun 1962) telah melakukan perbuatan hukum karena tidak mencantumkan salah satu anggota kaumnya, yang mana ini menjadi dasar gugatan bagi Misdarni selaku penggugat, Pembatalan Sertipikat diajukan secara tertulis ke kantor Pertanahan Kota Solok oleh pihak yang dinyatakan menang oleh pengadilan dan telah dilakukan gelar perkara, Saat ini Kantor Pertanahan Kota Solok sedang berupaya mewujudkan Kota Lengkap dan menerapkan setipikat elektronik, hal ini diharapkan agar tidak adalagi terjadi sengketa pertanahan yang merugikan masyarakat, bahkan hingga harus terjadinya pembatal sertipikat, dan juga diharapkan agar nantinya dalam hal pendaftaran tanah indonesia mampu menerapkan sistem pendaftaran tanah yang positif.
