Abstract

Pembagian waris bagi non-Muslim merupakan isu yang kompleks dalam konteks hukum Islam. Artikel ini menelaah perspektif hukum Islam tentang pembagian waris bagi non-Muslim dengan merujuk pada hadis dalam kitab Shahih Bukhari Muslim serta Kompilasi Hukum Islam (KHI). Pembahasan meliputi aspek teologis, hukum perdata, dan implikasi sosial dari perspektif hukum Islam terkait dengan pembagian waris bagi non-Muslim. Terdapat perbedaan pendapat di kalangan ulama terkait apakah non-Muslim boleh menerima waris dari Muslim, dengan beberapa aliran mengizinkannya dalam batasan-batasan tertentu, sementara yang lain menolaknya secara tegas. Kompilasi Hukum Islam menjadi panduan utama dalam menyusun regulasi terkait hal ini di banyak negara dengan mayoritas penduduk Muslim. Dalam konteks masyarakat multikultural, penting untuk memperhatikan keadilan dan kesetaraan dalam pembagian waris, sambil mempertimbangkan prinsip-prinsip hukum Islam dan nilai-nilai kemanusiaan universal. Studi ini memberikan kontribusi pada pemahaman lebih lanjut tentang implikasi hukum Islam terhadap non-Muslim dalam konteks pembagian harta warisan. Ketika memahami teks hukum dalam bentuk ayat Al-Qur’an, maka asbab al-nuzul (sebab turun) ayat itu harus dipertimbangkan dengan baik dan jika teks hukum itu berbentuk Hadits, maka menurut Tajul Arifin aspek-aspek yang terkait dengan riwayah dan dirayah-nya harus dipertimbangkan dan dianalisis secara cermat. Dalam melakukan reinterpretasi terhadap teks-teks hukum Islam yang bertujuan untuk mewujudkan kemaslahatan dalam kehidupan sebagaimana dikehendaki oleh Syara’ dapat dilakukan dengan menggunakan pendekatan apapun sepanjang mengaplikasikan epistemologi yang dibenarkan oleh jumhur ulama karena menurut Tajul Arifin keabsahan metode yang digunakan akan mempengaruhi natijah (simpulan) yang dihasilkan.

Abstract

This study explores resistance to bullying through a reflective-narrative approach that examines the tension between care and social unawareness within a school context. Drawing on the experience of an anti-bullying seminar conducted at a junior high school, the research analyzes students’ narratives, observations, and anonymous reflections as social texts that reveal moral positions and everyday practices. The findings indicate that care emerges as a subtle form of moral resistance, expressed through empathy, listening, and symbolic support for victims, while unawareness is sustained through normalization, cultural expectations, power relations, and digital interactions. Reflective processes enable students to reinterpret joking, silence, and conformity as practices that may contribute to harm, generating cognitive and ethical shifts. Rather than viewing resistance as a single act, the study highlights it as a gradual process rooted in reflection and relational awareness. By connecting personal experiences with ethical principles and human dignity, this research contributes to broader discussions on bullying as a structural and moral issue. The study underscores the importance of reflective spaces in education to foster critical awareness and sustainable anti-bullying cultures.

Abstract

The expansion of the gig economy business model in Indonesia has generated complex legal issues concerning the validity of the “partner” status assigned to online transportation drivers. This classification places drivers outside the protective framework of Law No. 13 of 2003 on Manpower, resulting in the deprivation of fundamental labor rights such as minimum wages and social security. This study examines the legal validity of partnership agreements under Article 1320 of the Indonesian Civil Code, with particular emphasis on defects of consent, and compares the findings with the rationale of the Uber BV v Aslam decision in the United Kingdom. Employing a normative juridical method with statutory, conceptual, and comparative law approaches, the study finds that existing partnership agreements suffer from fundamental legal defects due to violations of the principle of contractual balance and the presence of abuse of circumstances (misbruik van omstandigheden), both economically and psychologically. Furthermore, algorithmic control exercised by platform operators fulfills the element of authority (gezag) that characterizes an employment relationship, rendering the “partner” status legally invalid. Accordingly, the study recommends the adoption of a sui generis regulatory framework to ensure social protection for gig workers while preserving labor market flexibility.
