Abstract

Campaign problems occur throughout the election from year to year, resulting in unrest in public opinion. Manipulation to sabotage is carried out to bring down legislative opponents of other candidate pairs that cause elections to occur haphazardly and override the correct campaigning provisions under the law. The emergence of sabotage carried out to seek the popular vote during the campaign casts doubt on the existence of clean and safe elections. Parties that should be considered neutral during the campaign until the election show their support for one of the competing legislative candidate pairs, which makes the neutrality of certain parties doubtful during the election. The occurrence of a haphazard campaign can damage the image of the election in the eyes of the public by realizing the view that campaigns and elections are meaningless as long as the ruling party uses its power to create a good image for one candidate as a competitor. Efforts to prevent dirty campaigns can be started by stopping sabotage carried out by supporters or candidates themselves to weaken opponents' voices armed with campaign Education and minimize the spread of false news during the campaign. Law enforcement should be maximized. The rules must be perfected.

Abstract

Pemilihan Umum Presiden dan Wakil Presiden Indonesia 2024 atau dikenal sebagai Pilpres 2024, adalah pemilihan umum kelima di Indonesia untuk memilih Presiden dan Wakil Presiden Republik Indonesia. Pemilihan umum ini bertujuan untuk menentukan pemegang jabatan presiden dan wakil presiden untuk periode 2024–2029. Penelitian ini bertujuan untuk menganalisis atas kontroversi yang muncul sejak awal pencalonan Gibran sebagai calon wakil presiden Prabowo, karena Gibran tidak memenuhi syarat usia minimal 40 tahun untuk pencalonan. Meskipun telah dilakukan judicial review dan muncul Putusan Mahkamah Kostitusi Nomor 90/PUU-XXI/2023, keputusan ini tetap memicu perdebatan karena dianggap melanggar aturan yang ada. Penelitian ini menggunakan metode pendekatan yuridis normatif, penelitian ini berupaya mengkaji kembali norma-norma hukum yang terperinci yang terkandung dalam peraturan perundang-undangan yang ada termasuk putusan Mahkamah Konstitusi Nomor 90/PUU-XXI/2023 yang menuai pro dan kontra di masyarakat. Penelitian ini menyimpulkan bahwa putusan Mahkamah Konstitusi Nomor 90/PUU-XXI/2023 diwarnai dissenting opinion dari tiga hakim konstitusi dan terus menjadi bahan perdebatan. Putusan Mahkamah Konstitusi membawa dampak pada bidang politik, yaitu munculnya pemerintahan baru. Pesta demokrasi telah selesai, namun masyarakat masih terbelah kpada yang pro dan kontra.

Abstract

A clean and competent government applies the general principles of good government. Neutrality is one of the general principles of good government that every state official must uphold. Neutrality of public officials means not taking sides or engaging in practical political interests, especially in elections. This study aims to analyze the problems related to public officials' neutrality in Indonesia and provide solutions to ensure that neutrality. This study uses qualitative methods with a normative approach. The data used are secondary in the form of legislation, official documents, literature, and relevant previous research results. The results showed that the main problems related to public officials' neutrality in Indonesia are public officials' low awareness and understanding about the importance of neutrality, weak supervision, sanctions against neutrality violations, and the pressure and intervention of certain interested parties. Solutions that can be provided to ensure the neutrality of public officials in Indonesia are to increase socialization and education about neutrality, strengthen monitoring and enforcement mechanisms against neutrality violations, and build a culture of integrity and professionalism among public officials. Vigorous law enforcement is the solution.

Abstract

Ombudsman of the Republic of Indonesia (ORI) oversees public services and prevents maladministration, yet its recommendations, despite a strong legal basis, are often treated as non-binding, resulting in persistent non-compliance. This study aims to assess the effectiveness of the Ombudsman’s authority in preventing maladministration and to propose normative and institutional measures to enhance bureaucratic compliance. The research employs a normative legal methodology, focusing on the analysis of key regulatory frameworks, particularly Law No. 25 of 2009 on Public Services and Law No. 37 of 2008 on the Ombudsman of the Republic of Indonesia. Data were collected through a comprehensive literature review and analyzed using descriptive-analytical techniques. The findings reveal that weak compliance with Ombudsman recommendations is primarily driven by bureaucratic resistance, political interference, and institutional capacity constraints. The novelty of this study lies in its argument for strengthening the Ombudsman through legislative reform, including the introduction of limited executive authority, enhanced institutional autonomy, and proactive supervisory mechanisms. The study concludes that reinforcing the legal and institutional position of the Ombudsman is essential not only to improve administrative accountability but also to reflect the state’s genuine commitment to the rule of law, democratic governance, and effective public service delivery.
