Abstract

Restorative justice is a legal approach aimed at repairing the effects of a criminal act by involving all parties in the conflict, including the perpetrator, the victim, and the community. The High Prosecutor's Office of Gorontalo plays a crucial role in realizing restorative justice in its region. This study aims to explore and optimize the role of the High Prosecutor's Office of Gorontalo in implementing restorative justice principles. This research aims to understand and optimize the role of the High Prosecutor's Office of Gorontalo in applying restorative justice principles. The method used is empirical research utilizing field data as the primary source, such as results from interviews and observations. The research findings indicate that optimizing the role of the High Prosecutor's Office of Gorontalo in realizing restorative justice in the Gorontalo Province turns the institution into a dignified law enforcement agency that enjoys high public trust in the law enforcement process, especially in criminal matters. Nowadays, the performance of law enforcement officers often becomes the focus of public scrutiny and criticism from the community and justice seekers who have long opined that the law is sharp towards the lower class and dull towards the upper class. This research provides a significant contribution to understanding how restorative justice can be an effective tool in the criminal justice system in Indonesia. It is expected that the process of case resolution based on restorative justice in the future will importantly see the range of bureaucratic control in its resolution shortened at the regional level up to the echelon II (High Prosecutor's Office) to expedite and make the case resolution process more flexible, and to maintain the accountability of the resolution of restorative justice cases, the prosecutorial ranks should strengthen supervision functions, both functional and inherent.

Abstract

Penelitian ini bertujuan untuk menganalisis efektivitas pelaksanaan perlindungan hukum terhadap penggunaan lahan pertanian pangan berkelanjutan di Kabupaten Bolaang Mongondow Selatan, serta mengidentifikasi faktor-faktor yang menyebabkan alih fungsi lahan pertanian berkelanjutan di daerah tersebut. Untuk mencapai tujuan tersebut, penelitian ini menggunakan pendekatan campuran antara penelitian hukum normatif dan empiris. Pendekatan normatif digunakan untuk mengkaji norma-norma hukum terkait perlindungan hukum atas penggunaan lahan pertanian pangan berkelanjutan, yang berlandaskan pada peraturan perundang-undangan yang berlaku. Pendekatan empiris digunakan untuk menggali kondisi riil di lapangan mengenai penerapan perlindungan hukum tersebut. Hasil penelitian menunjukkan bahwa efektivitas perlindungan hukum terhadap penggunaan lahan pertanian pangan berkelanjutan di Kabupaten Bolaang Mongondow Selatan masih menghadapi sejumlah tantangan. Meskipun terdapat peraturan yang jelas, seperti Undang-Undang Nomor 41 Tahun 2009 dan Peraturan Daerah Nomor 18 Tahun 2021, pengawasan dan penegakan hukum yang belum optimal menjadi hambatan utama. Alih fungsi lahan untuk pemukiman dan infrastruktur yang mengancam keberlanjutan sektor pertanian dan ketahanan pangan masih terjadi di beberapa kecamatan. Untuk meningkatkan efektivitas perlindungan lahan, diperlukan pengawasan yang lebih ketat, penegakan hukum yang konsisten, serta peningkatan sosialisasi kepada masyarakat mengenai pentingnya mempertahankan lahan pertanian.

Abstract

Abstract: The purpose of this study is to determine and evaluate the form of KPU's responsibility for the use of sirekap in the 2024 Election. The research method used in this research is the normative research method by taking a statutory approach. The findings or results of this study are in the form of many mistakes that occurred in the 2024 election process due to sirekap, as for the findings, namely the Association for Elections and Democracy (Perludem) Foundation received complaints regarding the use of Sirekap which could not be accessed and could not even be used on voting day. This situation forced KPPS officers to upload C results to Google Drive, while the number of valid votes at polling stations was higher than the number of voters per polling station. Under these conditions, every upload of voting results by KPPS must go through a verification process before being displayed in the election results diagram on the KPU website. However, due to the accumulation of unverified data, some data was hampered to be displayed, so the KPU closed the temporary election result diagram on the day of the recapitulation. The issue of using Sirekap was also discussed in the election result dispute hearing held at the Constitutional Court. Sirekap mobile takes data from the C1 form. The results are made by handwriting using Optical Character Recognition (OCR) technology, but the writing on the C1 form which is handwritten by KPPS members at 822 thousand polling stations is difficult to read by OCR. The camera aspect is also a factor, because Sirekap mobile is installed on each KPPS mobile phone (hp) with different brand quality, so there are differences in the uploaded C1 form; some are clear, dim, white, or yellowish. In addition, folded paper can also cause misinterpretation by OCR.

Abstract

This study examines the effectiveness of Regent/Mayor Regulations (Peraturan Bupati/Walikota) as implementing instruments of village authority under the framework of Law No. 6 of 2014 on Villages and Minister of Home Affairs Regulation No. 44 of 2016. Using a normative legal research method with statutory and conceptual approaches, the analysis focuses on two comparative cases in Gorontalo Province. The findings reveal a stark disparity in regulatory quality: while the Gorontalo Regency regulation remains administrative and formalistic, the North Gorontalo regulation adopts a more participatory and context-sensitive approach, integrating local cultural values and traditional practices. The absence of operational technical guidelines from the central government and limited regulatory capacity at the local level have hindered the realization of the principles of recognition (rekognisi) and subsidiarity. This study concludes that a prescriptive, participatory, and locally responsive regulatory approach is essential for ensuring that Regent/Mayor Regulations function as effective instruments for actualizing village autonomy. The research recommends that future legal reforms provide clear technical guidance and promote inclusive governance frameworks that reflect the diversity of village contexts across Indonesia.

Abstract

This study aims to examine the fulfillment of citizens' constitutional rights in obtaining health services through BPJS Kesehatan membership and identify what factors hinder the health services of BPJS Kesehatan participants. Using an empirical juridical research method that focuses on the implementation of Law Number 24 of 2011 concerning BPJS and Law Number 17 of 2023 concerning Health. The main data used questionnaire, interview and observation data. The results of the study concluded that the fulfillment of citizens' constitutional rights in the health sector, such as promotive, preventive and curative efforts, has been carried out in accordance with existing regulations. Limited facilities and community conditions are an inhibiting factor. Suggestions in the research, so that BPJS Kesehatan can optimize BPJS Mobile services and educate the public to register for BPJS Kesehatan Online. Further research is suggested to analyze the empirical juridical aspects related to the effectiveness of mobile BPJS services for rural communities.

Abstract

Divorce lawsuit is the termination of a marriage bond which is the result of a petition by the wife to the Religious Court, where the husband gives his consent, so that his petition is granted by the Religious Court. This study aims to determine how to fulfill women's living rights after a divorce lawsuit. This study uses an empirical research method (field research) or field research, namely research whose objects are regarding symptoms, events, and phenomena that occur in society, institutions or the State which are non-library by looking at. With Research Results The results of the study show that the fulfillment of women's rights in SEMA No. 3 of 2018 has not been effective until now. This is because social and cultural factors have not been running well. It can be seen from the conditions of the people of Gorontalo City, the majority of whom are not aware or understand the rules for fulfilling women's rights after a divorce lawsuit in SEMA No. 3 of 2018, besides that the people of Gorontalo City have not obeyed and implemented these rules. This happens because the lack of sensitivity to education also affects the mindset of the community who do not consider carefully before deciding to file for divorce in Court
