Abstract

Adanya fakta tindak pidana kekerasan dalam rumah tangga yang terjadi di kabupaten Majene yang menciderai asas penghormatan hak asasi manusia, keadilan dan kesetaraan gender, nondskriminasi serta perlindungan kepada korban. Penelitian ini bertujuan untuk mengidentifikasi implementasi budaya malaqbiq dalam pencegahan tindak pidana kekerasan dalam rumah tangga di Kabupaten Majene. Tipe penelitian yang digunakan yaitu penelitian hukum empiris yang terdiri dari penelitian terhadap identifikasi dan penelitian terhadap efektivitas hukum. Hasil penelitian menujukkan bahwa terdapat 31 (tiga puluh satu) kasus kekerasan dalam rumah tangga di Kabupaten Majene dalam kurun waktu tahun 2018 hingga tahun 2023 yang mencerminkan degradasi nilai-nilai budaya malaqbiq sehingga memerlukan peran stakeholder untuk melakukan sosialisasi tekait pentingnya implementasi budaya lokal antara lain budaya malaqbiq pau, malaqbiq kedo serta malaqbiq gauq dalam pencegahan kekerasan dalam rumah tangga di Kabupaten Majene.

Abstract

The fact that child marriages occurred in the territory of Majene district increased the prevalence of child marriages. The method used was normative way. The findings showed that the child, as the golden generation and successor of the nation, has the right to survive, grow and develop, and to participate optimally in accordance with the dignity and dignity of humanity, to be protected from violence and discrimination. Therefore, the study aims to analyze the causes and prevention efforts of the prevalence of child marriage in the district. The type of research used is empirical law research which consists of research into the identification and effectiveness of law. The results of the study showed that there were 20 (twenty) applications for marriage dispensation cases registered with the Majene Religious Court in the period from January to August 2023.

Abstract

The urgency that the BPJS Employment program is held with the aim of providing death benefits to the heirs and benefits so that the heirs can meet the basic needs of a decent life when the participant dies. This research is a normative legal. The results showed that in the provision of death benefits to the heirs must have the status of a spouse (widow or widower) or child of the participant. If the spouse or child does not exist, the heirs are blood descendants in a straight line up and down to the second degree or siblings or in-laws or parties designated in the will by the participant. This is in line with the inheritance system according to the Civil Code, where there are two ways to obtain inheritance, namely first, obtaining inheritance based on the provisions of the law and second, obtaining inheritance based on the will.

Abstract

Land acquisition for public interest development in Indonesia is rife with conflicts and challenges, both in legal, social, and economic aspects. This research aims to analyze the implementation of the law in the land acquisition process, focusing on aspects of transparency, justice, and dispute resolution.The research employs a qualitative approach with a normative juridical method.It analyzes land acquisition for public interest development in Indonesia. The results indicate that while the law offers a robust legal foundation to safeguard landowners' rights, its implementation is marred by deficiencies, including insufficient socialization, the presence of land mafia, inconsistencies in land valuation, and protracted dispute resolution processes.This study underscores the imperative for enhanced coordination among government agencies, fortified supervisory mechanisms, and enhanced protection for affected communities to optimize the efficacy and fairness of the land acquisition process. In conclusion, the findings of this study offer a series of recommendations to enhance the efficacy of implementing the Land Acquisition Law, thereby facilitating the realization of equitable development objectives.

Abstract

This community service activity aimed to enhance the understanding of the people in Lembang Subdistrict, Majene Regency, regarding the culturally based handling of sexual violence. Through a participatory socialization approach, the activity involved various community elements, including women's and youth groups, to build collective awareness in preventing and addressing sexual violence. The methods used included counseling sessions, interactive discussions, and case handling simulations that integrated customary mechanisms with the formal legal system. This approach enabled participants to understand the steps of reporting and the significant role of traditional institutions in mediation and rehabilitation. Evaluation results showed a significant increase in community knowledge and readiness in dealing with cases of sexual violence, as well as the formation of communication networks between the community and related institutions. The activity recommends the need for culturally based approaches as preventive strategies to create a safe and inclusive environment for all community members.

Abstract

This study aims to analyze the role of Malaqbiq cultural values in the prevention of narcotics abuse in Majene Regency through a socio-cultural approach. Malaqbiq, which emphasizes personal honor, shame toward immoral behavior (siri’), and collective responsibility, functions as a form of informal social control that can shape moral awareness and preventive behavior, particularly among the younger generation. This research employs an empirical legal method with a qualitative approach, using observation, interviews, and document analysis. The findings show that the internalization of Malaqbiq values within families, customary communities, and education holds great potential in strengthening social resilience against drug abuse. However, these values are increasingly eroded by globalization, digital media, and the weakening of traditional socialization agents. Meanwhile, Law Number 35 of 2009 concerning Narcotics provides a comprehensive legal framework but requires reinforcement through local wisdom-based strategies to ensure more effective prevention. Integrating Malaqbiq values into educational programs, public outreach, and regional policies is recommended as a contextual and sustainable approach in combating narcotics abuse in Majene. This study underscores the importance of balancing formal legal mechanisms with culturally grounded preventive models to address the complex challenges of drug-related crime in contemporary Indonesian society.
