Abstract

Government Regulation in Lieu of Law (Perppu) No. 2/2017 on Mass Organizations was issued by President Joko Widodo on 10 July 2017. This Perppu amends several provisions in Law Number 17 of 2013 concerning Community Organizations, in response to the activities of mass organizations that are considered to threaten national unity and national security. In this research, the theoretical framework used is Lawrence M. Friedman's Legal Culture Theory, which emphasizes the substance, structure, and culture of law. This Perppu reflects the influence of cultural and historical factors in its formation, with efforts to create social justice through the regulation of mass organizations. The integration of legal philosophy, legal sociology, and historical approaches in the juridical analysis of this Perppu results in a holistic and in-depth perspective, essential for effective and equitable implementation in society. This research argues that the integration of these approaches helps to develop legal policies that are more just, contextual, and responsive to social change, and avoid potential abuse of power.

Abstract

Model Quadruple Helix berperan krusial dalam integrasi dualitas perizinan antara pendaftaran merek dan sertifikasi halal dengan melibatkan empat aktor utama: pemerintah, industri, akademisi, dan masyarakat sipil. Pemerintah menetapkan regulasi dan menyediakan dukungan bagi pelaku usaha, sementara industri berkolaborasi dengan lembaga sertifikasi untuk memastikan produk memenuhi standar. Metodologi penelitian ini dirancang untuk mengeksplorasi integrasi antara pendaftaran merek dan sertifikasi halal dengan menggunakan model Quadruple Helix. Berdasarkan hasil analisis, penelitian ini akan menyimpulkan peluang dan tantangan yang dihadapi oleh pelaku usaha serta memberikan rekomendasi untuk meningkatkan sinkronisasi antara sertifikasi halal dan pendaftaran merek dalam konteks bisnis syariah. Kolaborasi melalui sistem terintegrasi dapat mempercepat dan menyederhanakan proses pendaftaran merek dan sertifikasi halal. Sebelumnya, pendaftaran merek dan sertifikasi halal dilakukan secara terpisah sehingga prosesnya menjadi kompleks dan memakan waktu lebih lama. Dengan adanya sistem terintegrasi, proses pendaftaran merek dan sertifikasi halal digabungkan dalam satu sistem terpadu yang memungkinkan koordinasi lebih baik dan pengelolaan data yang efisien. Sistem ini membuat proses perizinan menjadi lebih sederhana dan cepat dengan persetujuan merek dan halal yang terpadu. Dengan demikian, sinkronisasi regulasi halal dan merek tidak hanya menjadi langkah administratif, tetapi juga refleksi responsivitas ekosistem bisnis terhadap dinamika global, sebagaimana tercermin dalam kesuksesan adaptasi pariwisata halal di negara-negara non-muslim.

Abstract

The issuance of Government Regulation (PP) No. 39 of 2021 concerning the Implementation of the Halal Product Guarantee Field and Minister of Religion Regulation No. 20 of 2021 concerning Halal Certification for MSEs. Self Declare independent halal application service helps businesses to obtain halal certification effectively and efficiently. But in its implementation, there are several differences in the process of issuing halal certification and legal guarantees for registered products. In this study the authors used a legal methodology system Descriptive analysis method used for specifications. The data collection techniques used are direct observation and documentary research. Data conducted through empirical juridical data analysis strengthens the validity of the research to test the effectiveness and legal security of the self-declared halal certification process.
