Abstract

The state as a protector of the guarantee of the rights of citizens is the essence of the purpose of the establishment of a state. The guarantee of halal products for food and beverages is one form of such protection. This has been manifested in the formation of laws and regulations related to halal product guarantees in addition to Law Number 8 of 1999 concerning Consumer Protection which was promulgated earlier. Halal Product Guarantee is implemented in Halal Certification which aims to provide legal certainty and legal protection for consumers, especially Muslim consumers. Halal-certified Product Guarantee is regulated in Law Number 33 of 2014 concerning Halal Product Guarantee (JPH). The existence of this law is important in the midst of free trade that is currently happening. This policy is expected to stop the supply of food that is not clearly halal. This protection is very relevant to the purpose of the implementation of Islamic law, which is to protect religion, protect the soul, protect the mind, protect offspring and protect property. This study will examine five things that are protected in Islamic law. So it will appear that the implementation of the Halal Product Guarantee is very much needed for the sustainability of human life.Keywords: Halal Guarantee, Legal Protection

Abstract

With the existence of a new legal regime known as cyber law or telematics law, the transaction system makes it easier for users. Cyber law or cyber law is used by utilizing information and communication technology which is a manifestation of the convergence of telecommunications law, media law and information law. The legal problems that are often faced are related to information, communication and/or transactions, especially in terms of evidence related to legal actions carried out by electronic systems. This writing aims to provide legal protection for consumers with online transactions. The research method used is normative juridical research, which involves analysis of theories, concepts, legal principles and statutory regulations relevant to this research topic. The legal problems that are often faced are related to the delivery of information, communi cation and/or transactions electronically, especially in terms of evidence and matters related to legal actions carried out through electronic systems. The results of this research can be concluded: First, in the form of legal protection for consumers who make online transactions as regulated in Law Number 11 of 2008 concerning Information and Electronic Transactions as well as provisions for legal protection for consumer users with online transactions or e-commerce. Second, in the form of responsibility for parties involved in online transactions or e-commerce as stated in Law Number Article 12 paragraph 3 concerning Information and Electronic Transactions, it is explained that every person who violates the obligation to carry out electronic transactions must be responsible for all losses and the resulting legal consequences.

Abstract

Kasus plagiarisme pada karya Alternative Universe (AU) di media sosial merupakan salah satu fenomena yang terus berkembang di era digital. Fenomena ini menjadi permasalahan hukum karena melibatkan hak cipta dan perlindungan karya kreatif. Penelitian ini bertujuan untuk menganalisis aspek yuridis terhadap plagiarisme AU antar platform media sosial, dengan fokus pada implikasi hukum bagi kreator dan pengguna yang terlibat. Dalam penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Sumber data yang digunakan meliputi literatur hukum, regulasi terkait hak cipta, dan kasus-kasus plagiarisme yang terjadi di media sosial. Penelitian ini juga menganalisis kesesuaian pengaturan hukum hak cipta di Indonesia dengan kebutuhan perlindungan hukum bagi pencipta karya AU. Hasil penelitian menunjukkan bahwa terdapat celah hukum dalam peraturan khusus AU tentang plagiarisme. Hal ini menyatakan bahwa perlindungan terhadap karya penulis masih kurang memadai. Oleh karena itu, pembaruan legislatif dibutuhkan karena perkembangan teknologi digital selalu meningkat setiap harinya. Selain itu, terdapat rekomendasi untuk meningkatkan literasi hukum pencipta karya AU dan pengguna media sosial mengenai hak cipta dan plagiarisme.

Abstract

Birth registration is a basic right of every child guaranteed by national and international law. A birth certificate is required to access basic services and basic human rights. The sooner a child's identity is recorded, the sooner their existence is protected and their protection by the state is guaranteed. However, in practice, there are many children in Indonesia whose births have not been registered, even after the time limit specified by laws and regulations is a maximum of 60 days. This article aims to analyze the form of legal protection for children who experience delays in birth registration and the obstacles faced in the process. The research method used is normative juridical with a legislative approach and case studies. The results of the study indicate that delays in birth registration can have an impact on obstructing children's access to basic civil rights, such as education, health services, and legal protection. The state has an obligation to provide legal protection through a birth registration mechanism outside the administrative time limit or through a court decision. To obtain birth registration beyond the time limit by obtaining a decision from the head of the local implementing agency by fulfilling the requirements and procedures as well as the procedures stipulated in Presidential Regulation Number 96 of 2018 concerning Requirements and Procedures for Population Registration and Civil Registration. In addition, there needs to be a simplification of procedures and increased socialization to the community regarding the importance of timely birth registration as a form of fulfilling children's rights. Abstrak Pencatatan kelahiran merupakan hak dasar setiap anak yang dijamin oleh hukum nasional dan internasional. Akta Kelahiran diperlukan untuk mengakses layanan dasar dan hak asasi manusia yang mendasar. Semakin cepat identitas anak dicatat, semakin cepat pula keberadaannya dilindungi dan perlindungannya oleh negara terjamin. Namun, dalam praktiknya, tidak sedikit anak di Indonesia yang belum tercatat kelahirannya, bahkan setelah melewati batas waktu yang ditentukan oleh peraturan perundang-undangan yaitu maksimal 60 hari. Artikel ini bertujuan untuk menganalisis bentuk perlindungan hukum bagi anak-anak yang mengalami keterlambatan pencatatan kelahiran serta kendala-kendala yang dihadapi dalam proses tersebut. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan studi kasus. Hasil penelitian menunjukkan bahwa keterlambatan pencatatan kelahiran dapat berdampak pada terhambatnya akses anak terhadap hak-hak sipil dasar, seperti pendidikan, layanan kesehatan, dan perlindungan hukum. Negara memiliki kewajiban untuk memberikan perlindungan hukum melalui mekanisme pencatatan kelahiran di luar batas waktu secara administratif maupun melalui penetapan pengadilan. Untuk memperoleh pecatatan kelahiran yang melampaui batas waktu dengan cara mendapatkan keputusan dari Kepala Instansi Pelaksana setempat dengan memenuhi persyaratan dan prosedur serta tata cara yang diatur dalam Peraturan Presiden Nomor 96 Tahun 2018 tentang Persyaratan dan Tata Cara Pendaftaran Penduduk dan Pencatatan Sipil. Selain itu, perlu adanya penyederhanaan prosedur dan peningkatan sosialisasi kepada masyarakat mengenai pentingnya pencatatan kelahiran tepat waktu sebagai bentuk pemenuhan hak anak.
