Abstract

The purpose of this study is to evaluate the legal political structure and the level of urgency of the Plea Bargaining System in the Draft Criminal Procedure Code. Normative legal research is the type of research used. The study of legal issues relating to norms is emphasized in legal research techniques. This method will concentrate on looking at legal reality from the point of view of the legal substance that regulates and is still developing. The findings of this study indicate that the Plea Bargaining system in the Draft Criminal Procedure Code is needed. This is indicated by the fact that several countries, such as Germany and France, have successfully implemented similar systems with various models and techniques. However, the Plea Bargaining system in the Draft Criminal Procedure Code does not use these strategies, but rather emphasizes that Plea Bargaining is only to alleviate the charges and accelerate the trial process. Plea Bargaining is expected to accelerate the legal process by reducing the volume of cases brought to court, saving time and money, compensating defendants who admit their guilt, and meeting the needs of the public prosecutor and defendants. With the establishment of the Special Track, Article 199 of the Draft Criminal Procedure Code describes the form of the Plea Bargaining system in its application and offers the idea of a Plea Bargaining system with a maximum penalty of 7 years as one of the options in accelerating case settlement. The use of Plea Bargaining has several advantages as follows: one, it reduces the accumulation of cases in court; two, it provides relief for defendants who admit their guilt; and the third simplifies the process for public prosecutors.

Abstract

The purpose of this research is to describe how H. M Taufan Pawe uses B. J. Habibie as a symbol of his leadership and uses it to build his image. This research uses qualitative research methods with data analysis from literature related to this research. The results of this research reveal that the use of the B. J. Habibie symbol is manifested in physical development in the form of monuments and buildings that touch the community directly. The use of the name B. J. Habibie is intended to build the image of H. M. Taufan Pawe by utilizing government media and establishing relationships with external media as a means of channeling information to the public.

Abstract

This paper discusses important issues relating to the protection of the rights of minority groups in pluralistic societies, with a particular focus on separatist groups. In the context of diverse societies, minority groups often face significant challenges, ranging from discrimination to violations of their human rights. This article examines these issues with an approach that combines international and national law and analyzes cases that reflect violations of minority rights. From an international law perspective, the protection of minority rights is regulated by various instruments, such as the Convention on Civil and Political Rights and the Declaration of Human Rights. However, its implementation is often hampered by inadequate or contradictory national policies. On the other hand, national laws that do not accommodate minority groups can worsen the situation, especially when it comes to separatist groups that are often seen as a threat to state sovereignty. This article also reviews the steps taken through international mediation and national policy reform to ensure separatist groups receive fair treatment. By reviewing a wide range of literature and case studies, this paper offers a deeper understanding of the importance of an inclusive approach to protecting the rights of minority groups and promoting harmony in pluralistic societies.

Abstract

Penelitian ini mengkaji peran teknologi kecerdasan buatan dalam mendeteksi dan mencegah tindak pidana penculikan anak perempuan yang dilakukan oleh anak, dengan fokus pada studi kasus Nomor. 60/Pid.sus/2017/PN.Makassar. Penelitian ini menggunakan pendekatan kualitatif untuk mendapatkan pemahaman yang mendalam tentang peran teknologi kecerdasan buatan dalam mendeteksi dan mencegah tindak pidana penculikan anak perempuan. Studi ini juga mengevaluasi kendala-kendala hukum dan teknis yang muncul dalam penerapan teknologi dalam konteks penegakan hukum di Indonesia. Temuan menunjukkan bahwa teknologi memiliki potensi besar dalam mendukung aparat penegak hukum melalui pemrosesan data yang cepat dan analisis pola perilaku yang mencurigakan. Namun, tantangan seperti regulasi, etika, privasi, termasuk sumber daya, ketidakpastian hukum dan tantangan teknis, perlu diatasi untuk memastikan penggunaan yang adil dan efektif. Penelitian ini memberikan rekomendasi bagi pengembangan kebijakan dan kerangka hukum yang lebih baik dalam penerapan untuk pencegahan tindak pidana di Indonesia.

Abstract

This research discusses the phenomenon of street children in Makassar City through a political sociology approach and Henri Lefebvre's theory of space production. The research identifies the causes of street children's emergence and analyzes the government's countermeasures. Massive urban development by the government and capitalists has created social inequality, dividing urban space into abstract space, which the state and capital owners utilize for business interests, and social space, which people use to live and do activities. This study aims to evaluate the effectiveness of street children handling policies through repressive and preventive approaches implemented by the Makassar City Government. This research uses a qualitative approach with a literature study method and descriptive-critical analysis. The theory of poverty and urbanization is used to explain that inequality is part of a capitalistic structure that places capital above people's social rights. The results show that government and community efforts in dealing with street children still face various structural barriers. Therefore, more inclusive and spatial justice-based policies are needed to solve this problem sustainably.

Abstract

Penelitian ini mengkaji peran teknologi kecerdasan buatan dalam mendeteksi dan mencegah tindak pidana penculikan anak perempuan yang dilakukan oleh anak, dengan fokus pada studi kasus Nomor. 60/Pid.sus/2017/PN.Makassar.
