Abstract

The problem of abuse and illicit trafficking of Narcotics in Indonesia is still exacerbated by the process of Law Enforcement, Eradication of distribution and circulation illegal narcotics in this country. Law Number 35 of 2009 concerning Narcotics has clearly and clearly stated that perpetrators of illicit trafficking of Narcotics (narcotics syndicates) are subject to death penalty. Death penalty is one of the oldest types of punishment, as old as mankind. Death penalty is also the most interesting form of punishment studied by experts because it has a high value of contradiction or conflict between those who agree with those who disagree. In the decision being reviewed, namely decision number 203/Pid.Sus/2019/PN.Bls, that by taking into account, Article 114 paragraph (2) Jo. Article 132 paragraph (1) of the Law of the Republic of Indonesia Number 35 of 2009 concerning Narcotics and Law Number 8 of 1981 concerning Criminal Procedure Code and other relevant laws and regulations, the Panel of Judges sentenced the Defendant Suci Ramadianto Als Suci Als Iir Bin Subandi with death penalty.

Abstract

This study discusses the unclear regulation regarding legal remedies for lawsuits in resolving customs disputes in Indonesia, as well as its impact on the legal system and protection of the rights of the parties involved. Although the Customs Law has regulated objection and appeal channels, there are no clear regulations regarding the lawsuit mechanism as a follow-up legal remedy. This ambiguity has the potential to cause legal uncertainty, hinder the dispute resolution process, and reduce protection of the rights of the parties involved, such as importers, exporters, and other related parties. This study also compares it with the legal systems of other countries and provides recommendations for improving regulations in order to create legal certainty, justice, and efficiency in resolving customs disputes. This study suggests that lawsuit regulations be included in the Customs Law to strengthen the supervision and law enforcement system, and increase public trust in the customs system in Indonesia.

Abstract

Drug abuse by police officers not only raises legal issues, but also ethical issues in the police profession. In this case, criminal and ethical liability are two interrelated aspects. Criminal liability relates to legal actions that must be taken against police officers who are proven guilty of drug abuse, while ethical liability relates to violations of the police code of ethics that reflect the morals and integrity of the profession. The formulation of the problem is 1) How are the legal regulations related to drug abuse by police officers in Indonesia? 2) How are the criminal and ethical liabilities for police officers involved in drug cases? The approach method used in this legal research is to use the normative legal approach method. The results of the research are legal regulations related to criminal acts committed by members of the police, namely regulated in several regulations, Law Number 2 of 2002 concerning the Republic of Indonesia Police, Law Number 35 of 2009 concerning Narcotics, Law Number 36 of 2009 concerning Health and criminal and ethical responsibility for police members involved in narcotics cases, Criminal sanctions that can be given in the form of imprisonment and fines according to the crime committed.

Abstract

This study aims to examine the judge's legal considerations regarding perpetrators of child sexual abuse, specifically in Decision Number 989/PID.SUS/2022/PN.BDG in conjunction with Decision Number 86/PID.SUS/2022/PT.BDG involving defendant Herry Wirawan. The method used is normative legal research with a prescriptive approach through analysis of statutory regulations, legal principles, and relevant court decisions. The results show that the judge's legal considerations in issuing the decision are based on three aspects: juridical, sociological, and philosophical. The judge not only refers to written legal norms but also considers the social and psychological impact on the child victim and the purpose of sentencing, which is to provide a deterrent effect and protect the community. In the case studied, the judge imposed a life sentence and determined that restitution to the victim was borne by the state through the Ministry of Women's Empowerment and Child Protection. This decision demonstrates maximum protection for child victims while simultaneously enforcing the law firmly against the perpetrator.

Abstract

The importance of maintaining environmental balance and dealing with complex issues such as forest fires in Indonesia requires attention to the relevant legal aspects. The concept of the environment involves the human area and the accumulation of its activities, with forests playing a central role in maintaining ecosystems and providing benefits for society. Law Number 32 of 2009 concerning Environmental Protection and Management is a strong legal basis for dealing with this problem. This research method applies a normative approach and literature study to analyze legal aspects related to forest fires. Within this framework, the statutory approach is used to collect all laws and regulations that are relevant to the legal issues being studied, especially in the context of enforcing criminal law against forest fires as an environmental crime. The results reveal the importance of effective law enforcement in the environmental context, which is regulated by Article 98 of Law Number 32 of 2009. This article outlines criminal sanctions for those who violate air, water, or environmental damage criteria.

Abstract

Tindak pidana persetubuhan terhadap anak merupakan salah satu masalah hukum yang sangat penting untuk dikaji secara mendalam dan tidak hanya terjadi di kota kota besar saja, tetapi juga terjadi dilingkup kabupaten seperti kasus yang terjadi di kabupaten Jombang ini sebagaimana Putusan Pengadilan Negeri Jombang Nomor 24/Pid.Sus-Anak/2020/PN. JBG, bahwa anak didakwa terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana membujuk Anak melakukan persetubuhan. Adapun Tujuan Penelitian ini untuk mengetahui dan menganalisis penerapan sanksi pidana Terhadap anak yang berhadapan dengan hukum dalam Tindak Pidana Persetubuhan yang dilakukan oleh anak dan Pertimbangan Hakim berdasarkan putusan Pengadilan Negeri Jombang Nomor 24/Pid.Sus-Anak/2020/PN. JBG. Jenis Penelitian ini menggunakan penelitian hukum normatif yaitu Penelitian hukum yang bertujuan untuk menggambarkan tentang penemuan-penemuan, norma-norma, asas-asas hukum positif, sistematika hukum, norma-norma, asas-asas hukum positif, sistematika hukum yang telah tersedia dan terkandung di dalam data sekunder. Simpulan pada penelitian ini adalah Penerapan sanksi pidana terhadap Tindak Pidana Persetubuhan Yang Dilakukan Oleh Anak tidak dapat diselesaikan secara diversi namun diselesaikan melalui persidangan, sehingga sanksi hukuman terhadap tindak pidana persetubuhan yang dilakukan oleh terdakwa anak terhadap anak dengan menerapkan Pasal 71 Undang-Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak dan Pertimbangan Hakim dalam putusan berdasarkan Putusan Pengadilan Negeri Jombang Nomor 24/Pid.Sus-Anak/2020/PN. Jbg adalah dengan mempertimbangkan hal yang memberatkan dan meringankan.

Abstract

A case settlement between the party who is the victim and the party who is the perpetrator is known as case dispute resolution. The process of resolving a case can take one of two forms: through litigation (in the court) or non-litigation (outside of court). Using methods from a literature review, the purpose of this study is to examine how digital justice is affected by technology and innovation in law enforcement. The application of information technology to increase the effectiveness and efficiency of time in handling case files, particularly at the Supreme Court of the Republic of Indonesia, has changed the way law enforcement operates in the ever-growing digital era. These technological developments include big data analysis, artificial intelligence, and digital forensic technology. Indonesia. This study's problem formulation is as follows: 1) How are cases resolved in court? 2) How are efforts to speed up the resolution of cases in court according to PERMA Number 4 of 2020 concerning Electronic Administration and Trial of Criminal Cases in Court? Legal behavioral products, such as reviewing laws, are used in normative case studies in normative legal research methods (normative law study). The issuance of PERMA Number 4 in 2020 will accelerate the resolution of cases in court through administrative procedures and electronic broadcasting. This could increase the effectiveness and efficiency of broadcasting principles and reduce the broadcasting of cases in court, particularly given the existence of PERMA Number 1 in 2019.

Abstract

The form of crime against life that occurs in the community, for example the crime of premeditated murder in a community that has a different background or modus operandi in carrying out the premeditated murder, this premeditated murder is also carried out by people who according to reason and thought are not expected to be able to commit a premeditated murder crime. This crime of murder is not only carried out by someone who has deviant behavior or in other words who already has a background of someone who is naughty, evil, or a former convict who is already known to the community, but this premeditated murder crime can also be carried out by people who have good behavior in their community. The problem is what is the form of the unlawful act of the passive perpetrator in the act of premeditated murder. The research method is normative legal research. The form of unlawful act of the passive perpetrator in the act of premeditated murder is that the medepleger or person who participates in it is anyone who intentionally participates (medoet) in committing a crime. Passive perpetrators occur when the actions of each participant contain all the elements of a crime. In addition, the passive perpetrator in premeditated murder must require that the actions of the participating perpetrators must be the same as the actions of a perpetrator, his actions do not need to fulfill all the formulations of a criminal act, it is enough to fulfill only part of the formulation of a criminal act, as long as the intention is the same as the intention of the perpetrator.
