Abstract

Peran lembaga arbitrase dirasa belum optimal. Tulisan ini mengkaji faktor-faktor yang mempengaruhi kinerja Lembaga Arbitrase dan upaya pemberdayaan lembaga arbitrase dalam penyelesaian sengketa bisnis di Indonesia. Berdasarkan ada pendekatan yuridis-sosiologis, dapat diketahui bahwa terdapat beberapa faktor yang mempengaruhi peran lembaga arbitrase, yaitu rendahnya pemahaman masyarakat terhadap hukum, khususnya arbitrase; budaya litigasi masih dominan di masyarakat; sistem hukum (khususnya substansi hukum) yang masih bersifat fakultatif; serta keberadaan lembaga arbitrase yang terbatas hanya di kota besar saja. Upaya untuk memberdayakan Lembaga arbitrase adalah dengan melakukan pendidikan hukum, khususnya bidang arbitrase; membangun paradigma non-litigasi; membangun (substansi) norma hukum imperatif; serta memperkuat dan memperbanyak lembaga arbitrase.Empowering the Role of Arbitration Institution for Business Dispute Settlement in Indonesia AbstractThe article aims to examine and determine the factors that affect the level of operation in Arbitration Institute and to understand how empowering efforts of arbitration institution in dealing with dispute resolution in Indonesian business. Under the socio-juridical approach, there are several factors which affect the function of arbitration institutions, namely: poor public understanding of the law, particularly on arbitration; litigation culture is still dominant in society; legal system (particularly legal substance) is still voluntary; arbitration institutions are limited in big cities. The efforts to empower arbitration institutions are: conducting legal education, especially in the field of arbitration; building a non-litigation paradigm; construction (substance) imperative legal norms; as well as strengthening and multiplying the arbitration institution. DOI: https://doi.org/10.22304/pjih.v4n1.a7

Abstract

Pendidikan hukum di indonesia cenderung menghasilkan lulusan yang berpikiran positivistik—yang mendorong para penegak hukum berpikir dan bertindak dengan cara legalitas hukum. Selain itu, hakim akan menjadi corong dari peraturan perung-undangan, sehingga mereka tidak bisa memenuhi rasa keadilan masyarakat. Penelitian ini akan menganalisis aturan hukum terkait dengan pendidikan hukum di masyarakat. Hasil penelitian ini menunjukkan bahwa sistem hukum terkait dengan pendidikan hukum di masyarakat masih bernuansa positivisme yang berkesan represif dan tidak responsif. Kondisi ini berpengaruh terhadap corak penegakan hukum yang bersifat legal positivistik. Secara ideal ke depan pendidikan hukum mengintegrasikan pendekatan sosiologis dan prinsip-prinsip keadilan, sehingga penegak hukum yang dihasilkan dari pendidikan hukum menjadi berorientasi kepada keadilan subtantif.The legal education in Indonesia tends to produce graduates who believe in legal positivism that encourages law enforcers to think and act in any legal formalistic way. In addition it places judges as the mouthpiece of the law who cannot express to make decisions that satisfy a sense of social justice and substantive justice. This article is based on the socio-juridical approach by underlying the analysis of the law and regulations which are related to the application of legal education in the community. The legal education is oriented to legal positivism that results in law enforcement with the understanding of law based on the abstract values, not on the values that live and thrive in society, so that the understanding of the law in a legal sense is more repressive, and not responsive. Law is understood as infunctional and unpragmatic thing, therefore understanding of law is the law that merely protects the elite group of citizens, in such a way that equality before the law and the rule of law don’t work. Legal education in the future should be based on the sociological aspects of prioritizing the principles of social justice and the benefits for the community, instead of legal certainty only. Legal education will produce a responsive law enforcement that put substantive fairness and social justice as a legal purpose.

Abstract

Permasalahan yang dihadapi oleh Museum Batik Yogyakarta, yaitu perlindungan peninggalan sejarah batik melalui penggunaan Batikmark di era digital, belum sepenuhnya dipahami oleh pengelola museum batik, produsen batik, dan masyarakat umum sebagai konsumen. Dinas Kebudayaan (Kundha Kabudayan) Daerah Istimewa Yogyakarta Tahun Anggaran 2021 memiliki kegiatan pembinaan dan pengelolaan permuseuman. Salah satu kegiatannya bertajuk “Jumpa Sahabat Museum” dengan menyelenggarakan seminar dengan tema “Perlindungan Peninggalan Sejarah Batik di Indonesia di Era Digital” yang berkoordinasi dengan Lembaga Penelitian, Publikasi, dan Pengabdian Kepada Masyarakat Universitas Janabadra. Kegiatan pengabdian masyarakat menggunakan metode diskusi kelompok terpumpun yaitu dilakukan dengan cara tim pengabdi melaksanakan diskusi bersama perwakilan Museum Batik Yogyakarta bersama peserta seminar berkaitan dengan materi edukasi. Hasil dari kegiatan ditunjukkan dengan meningkatnya pemahaman tentang pentingnya Batikmark sebagai wujud certification mark yang bertujuan untuk memberikan jaminan mutu batik Indonesia, meningkatkan kepercayaan konsumen dalam negeri maupun luar negeri terhadap mutu batik Indonesia, memberikan perlindungan hukum dari berbagai persaingan tidak sehat di bidang Hak Kekayaan Intelektual dalam perdagangan dalam negeri maupun internasional, dan memberikan identitas batik Indonesia agar masyarakat Indonesia dan asing dapat dengan mudah mengenali batik buatan Indonesia.

Abstract

After the Commercial Court determines the bankruptcy decision, no later than 14 days the supervisory judge must set a deadline for submitting claims by creditors to the curator for debt matching. However, if creditors only find out about the bankruptcy decision after debt matching, what efforts can creditors make? This research aims to find out the Application for Filing Creditors' Claims After the Time for Determining the Distribution of Bankruptcy Assets so that we can find out how the application for submitting creditor's bills after the time for determining the distribution of bankruptcy assets has passed so that it can provide certainty in repayment of debtors' debts as a form of protection for creditors as well as studying and knowing the consequences. request for submission of a creditor's claim after the time for determining the distribution of bankruptcy assets for either the debtor or the creditor itself has expired. This research is a type of qualitative research that follows the typology of normative legal research. Research data was collected through literature and document studies including primary, secondary, and tertiary data. The data that has been collected will be identified and arranged systematically to be relevant to related theories, written descriptively, and analyzed qualitatively. The results of the study show that submission of debt claims by overdue creditors can be done by referring to Article 133 paragraph (1) of the Bankruptcy Law and PKPU, if there are receivables that are then entered after the end of the grace period determined by the supervisory judge and have not been reconciled, then The supervising judge can match the receivables. Then through Decision Number 497 K/Pdt.Sus-Pailit/2014, the Supreme Court in its cassation rejected the creditor's claim because his position as a concurrent creditor meant that debt payments for bankruptcy cases would only be paid if there was money left to pay them.

Abstract

The capital market is a critical component of a nation's economy, facilitating capital formation and allocation. Fraudulent practices, manipulation, lack of transparency, dishonesty and injustice in capital market activities must be dealt with firmly. This is because injustice can cause losses for minority stock investors. This study aims to analyze and evaluate the minority stock investor protection system in Indonesia, as well as efforts to improve justice and equality for all shareholders and examines the existing legal frameworks designed to protect minority stock investors and assesses their efficacy in ensuring justice. This study was a normative legal study, with a State approach, a Conceptual approach and a Case approach. The results of the study indicate that in the legal protection system according to Indonesian capital market law there are several findings that can result in injustice to Minority Investors. Building corporate governance that prioritizes and upholds the principle of honesty. Enforcement of the Transparency Principle in the implementation of capital market activities, both before listing, during listing, and after listing by changing the formulation of civil sanctions in the form of fines and compensation decided by the Financial Services Authority. As well as the involvement of minority investors in making important decisions in the issuing company.

Abstract

The purpose of this research is to identify and analyze the legal protection of transportation service providers due to the government's policy of fixing fuel prices.This study uses a type of normative.Research results describe all the materials regarding the problems raised by legal protection for transportation service actors over the government's policy of fixing prices for fuel oil (BBM ).Legal protection for perpetrators of transportation services is based on the following provisions; a. Law Number 22 of 2009 concerning Road Traffic and Transportation b. Law Number. 8 of 1999 concerning Consumer Protection c. Law of the Republic of Indonesia Number 22 of 2001 concerning Oil and Natural Gas Legal protection for transportation business actors. Several factors become obstacles to legal protection for transportation service actors, government policy in setting the price of fuel oil (BBM),

Abstract

Firstly, it encourages law enforcers to think and act in any legal formalistic way. How the ideal model of legal education is formed in order to create more progressive law enforcement. This article is based on the socio-juridical approach by underlying the analysis of the law and regulations which are related to the application of legal education in the community. The legal education is oriented to legal positivism that results in law enforcement with the understanding of law based on the abstract values, not on the values that live and thrive in society, so that the understanding of the law in a legal sense is more repressive, and not responsive. Law is understood as unfunctional and un-pragmatic things therefore understanding of law is the law that merely protects the elite group of citizens, in such a way that equality before the law and the rule of law don’t work.
