Abstract

Children are often become victims of sexual crimes that cause the pregnancy. Not infrequently abortion is chosen as a way in overcoming Unwanted Pregnancy (KTD). The Criminal Code prohibits abortion. In Law No. 36/2009 concerning Health in Article 75 allows for abortion but Article 76 indicates that when the abortion is not in accordance with the requirements in Article 76, then a child who is a rape victim who has an abortion can be subject to a criminal offense under Article 194 of the Health Law. The type of this research is normative legal research. Normative legal research is research that focuses on positive legal norms. Abortion in certain cases can be justified when it is an abortion that is medically recommended by the treating doctor, for example because the pregnant woman suffers from an illness and to save the woman's life, the pregnancy must be aborted.

Abstract

Pulau Batam merupakan pulau yang terbesar yang terdapat di Kepulauan Riau. Pulau Batam pertama kali dihuni oleh orang melayu yang tinggal di pulau Batam yang tersebar di 37 titik. Masyarakat melayu tersebut disebut sebagai masyarakat kampung tua yaitu masyarakat yang ada sebelum terbentuknya Otorita Batam. Otorita Batam terbentuk pada tahun 1973 yaitu melalui Keputusan Presiden Nomor 41 Tahun 1973 yang menyatakan bahwa Otorita Batam selaku pemegang Hak Pengelolaan di Kota Batam yang kemudian diubah menjadi BP Batam setelah dikeluarkannya peraturan pemerintah Nomor 46 tahun 2007. Sebagai pemegang hak pengelolaan atas Kota Batam, BP Batam mempunyai hak dalam mengelola seluruh area tanah di Kota Batam termasuk dalam memberikan status hak atas tanah dan bangunan yang berdiri diatas hak pengelolaan serta menerbitkan dokumen lahan berupa SKEP, SPJ, Faktur UWT dan Pecah Lokasi sebagai dokumen lahan yang dapat dijadikan dasar pengikatan jual beli bagi tanah dan bangunan yang belum bersertipikat. Tahun 1983 Pulau Batam ditingkatkan statusnya menjadi kotamadya berdasarkan Peraturan Pemerintah Nomor 34 tahun 1983. dengan ditetapkannya sebagai maka pemerintah Kota mempunyai kewenangan dalam pengelolaan tanah di Kota Batam, khususnya dalam bidang pertanahan yaitu adanya dinas pertanahan yang bertanggung jawab langsung kepada walikota Batam. Terhadap tanah dan bangunan yang berdiri di diatas hak pengelolaan BP Batam hanya dapat mempunyai status hak pakai, hak guna bangunan dan hak guna usaha. sedangkan terhadap kampung tua tanah dan bangunan dapat diberikan hak milik, hak pakai dan hak guna bangunan. dalam hal pemberian status hak milik tersebut berdasarkan surat rekomendasi yang dikeluarkan oleh BP Batam.

Abstract

The position of secured creditors in Indonesian bankruptcy law raises critical issues regarding the limits of execution rights and the protection of stakeholders’ interests. This study specifically examines these dynamics through the case study of Decision Number 20/Pdt.Sus-Gugatan Lain-Lain/2023/PN.Niaga.Smg. Using a normative juridical approach, the research analyzes the execution rights of secured creditors, particularly holders of security rights, within the framework of prevailing bankruptcy law. The findings reveal that although secured creditors enjoy privileged rights, their enforcement is subject to strict legal procedures, including a 90-day execution moratorium following the bankruptcy ruling. These results highlight a shift in Indonesian bankruptcy law toward a more responsive and adaptive system, functioning not only as a debt resolution mechanism but also as an instrument to maintain economic balance and social justice Keywords: Bankruptcy; Separatist Creditors; Mortgage Rights

Abstract

Dalam hukum positif di Indonesia, masalah ganja pada sebagian masyarakat masih dikategorikan sebagai barang terlarang, karena ganja digolongkan narkotika golongan I. Undang-Undang Narkotika Nomor 35 Tahun 2009 tentang Narkotika. Dalam penulisan ilmiah ini, metodologi yang dipergunakan adalah yuridis normatif. Sebagaimana diketahui, bahwa ganja medis memiliki perbedaan dengan ganja rekreasional atau ganja yang biasa dipakai untuk narkoba, bahwa ganja memang memiliki banyak jenis. Ganja medis banyak dipakai untuk hal-hal yang berhubungan dengan kesehatan. Jenis ganja terdapat perbedaan. Bahwa di dalam ganja terkandung cannabidinol (CBD)yang dapat menjadi obat terapi bagi berbagai macam penyakit. Sedangkan terkait dengan ganja rekreasional, menerangkan bahwa ganja rekreasional mengandung tetrahidocannabinol (THC) yang tinggi. Kandungan tersebut yang menyebabkan seorang pengguna dapat mengalami sensasi “high” atau “fly.”. Dengan demikian dapat ditarik kesimpulan, bahwa pada dasarnya ganja secara medis dapat dipergunakan sebagai alternatif pengobatan.

Abstract

AJB is an authentic document whose validity is highly dependent on the manufacturing process that must meet legal provisions, one of which is the presence of the parties and PPAT when making and signing the Acte. The presence of PPAT is absolute because it acts as a state official who guarantees the formal and material truth of the contents of the Acte and explains the legal consequences of the transaction to the parties. This type of research is normative law research, with a study of legal materials containing normative legal rules. This research relates to legal norms that exist in society and in legislation and court decisions. In Indonesia Civil Code Clause 1338 Verse 3, good faith is only mentioned in relation to the making of treatys, but is not regulated further. Therefore, in SEMA Number 4 of 2016, buyers who have good faith are given a guarantee in the form of legal protection. Good faith itself consists of two types, namely subjective, which is interpreted as honesty, and objective, which is interpreted as a form of politeness and manners, whereby a person must also comply with social norms. A buyer acting in good faith is a buyer who carefully examines the physical condition and legal data of a transfer of land rights being purchased, both before and at the time of transfer. However, if the buyer is aware of a defect in the transfer of rights process, the buyer's good faith is considered lost. Legal protection for buyers is only for buyers acting in good faith. In the cancellation of an AJB, protection for buyers is in the form of a civil lawsuit against the deed and compensation. Under certain conditions, an agreement may be cancelled, either by the parties or by court order. As a form of binding agreement, a land sale and purchase agreement contains the rights and obligations of the parties who made it, so that if the terms agreed upon in the sale and purchase agreement are violated or not fulfilled by the parties who made it, then it can be said that there has been a breach of contract. Before a sale and purchase can be carried out before an authorised official, namely the Land Deed Official (PPAT), the parties who will sell and purchase land rights must meet all the requirements stipulated for the sale and purchase of land. Requirements regarding the object of sale and purchase, for example, the land rights to be sold and purchased are legally owned by the seller, as evidenced by a land certificate or other valid proof of such rights, and the land being sold and purchased is not in dispute with other parties, and so on
