Abstract

Abstract: design creation of Destination Branding tourist area B-29 is promotional efforts, provide information about natural attractions inside are cultures that can be preserved and can become one of the new tourist attractions in Indonesia The study was conducted using qualitative methods is by doing interviews, observation ,documentation, and literature to obtain data used as drafting the manufacture of Destination Branding. Concept or keyword obtained through data analysis, keyword analysis performed Based on the acquired keyword is "Panorama Suci Gunung Bromo" keyword is defined operationally and conceptually. Those keywords have 3 words that panorama, sacred, Mount Bromo. Meaning panorama according to KBBI natural landscape broad definition of operational panorama can be conceptualized as natural beauty, which is described as seeing Mount Bromo sacred significance display of the ritual performed residents in the area B-29, where the ritual process is laden with religious values that based on the sainthood. KBBI interpreted in the holy purity or cleanliness as a heart and something holy. Abstract

This study aims to determine the optimal number of workers in accordance with the needs of the company and determine the standard time needed for the brick making process. The method used in this study is the stopwatch time study method in which this method is applied to work that lasts briefly and repeatedly (repetitive. Based on the results of the study shows that the optimal amount of labor that should be employed in accordance with the needs of companies in making stone brick press at each work station that is 2 workers with details of workers at the clay excavation station labor that should be employed that is amounting to 2 people, the station put clay into the press machine labor that should be employed that is amounting to 2 people, printing station power the work that should be employed is numbered 2 people, the work station compiles the printout into the wheelbarrow the manpower that should be employed is amounting to 2 people, and the work station compiles the press bricks to the place where the workforce should be employed which is the sum 2 people where the actual number of workers is only 3 people where of the three workers concurrently doing work activities, with the addition of the workforce at each station 1 workforce is expected to achieve production targets and can meet product demand every month at UD. Three Sets of Nagan Raya Regency. The standard time needed for the clay excavation station is 54.78 minutes, the standard time required for the station to enter clay into the press is 41.43 minutes, the standard time required for the brick press molding station is 43.03 minutes, the standard time needed at the work station to compile the printed material into the wheelbarrow is 55.86 minutes, while the standard time required at the work station to compile the brick press to the drying area is 50.17 minutes.

Abstract

Banyaknya permasalahan hukum yang melibatkan Notaris terhadap akta autentik yang dibuatnya menyebabkan Notaris berurusan dengan hukum pidana. Hukum pidana yang seharusnya digunakan sebagai upaya terakhir (ultimum remedium), namun pada praktiknya dijadikan sebagai pilihan utama (primum remedium), sehingga tidak ada perlindungan hukum terhadap Notaris dalam menjalankan jabatannya sebagai pejabat umum yang menjalankan sebagian kekuasaan negara di bidang hukum privat yang mempunyai peran penting dalam pembuatan akta autentik. Tujuan penelitian ini adalah menjawab implementasi ajaran dualistis hukum pidana dalam menyelesaikan perkara pidana di bidang kenotariatan. Metode penelitian yang digunakan adalah metode penelitian hukum normatif dengan bersumber pada studi pustaka/data sekunder. Data sekunder terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Dari hasil penelitian ditemukan bahwa implementasi ajaran dualistis dalam menyelesaikan perkara pidana terhadap Notaris dalam menjalankan jabatannya masih minim diterapkan oleh hakim (pengadilan). Hakim masih memandang bahwa Notaris yang melakukan perbuatan sesuai rumusan tindak pidana (actus reus) layak dipidana, tanpa mempertimbangkan keadaan batin (mens rea) sebagai unsur kesalahan Notaris. Sehingga dalam hal ini tidak ada pemisahan antara perbuatan dengan pertanggungjawaban pidananya.

Abstract

Proses lelang memiliki dua metode pelaksanaan: metode luring (offline) dan metode yang menggunakan media daring (online). Perkembangan lelang online ini didorong oleh tingginya jumlah kredit bermasalah saat ini, sehingga diperlukan inovasi agar proses lelang dapat berlangsung lebih cepat. Lelang yang dilakukan melalui media daringd diatur didalam Peraturan Menteri Keuangan No. 213/PMK.06/2020 tentang Pedoman Pelaksanaan Lelang dengan Penawaran Secara Tertulis Tanpa Kehadiran Peserta Lelang Melalui Internet. Pada penelitian ini permasalahan yang diangkat ialah Bagaimanakah Peran Balai Lelang Swasta pada kegiatan pelelangan dengan obyek fidusia Sesuai Surat Edaran Sekretaris Jendral an. Menteri Keuangan nomor SE-7/MK.1/2020 tertanggal 23 Maret 2020 Mengenai Pembatalan Pelaksanaan Lelang Terkait Upaya Pencegahan Penyebaran Covid-19 yang mempengaruhi aktivitas lelang?dan Bagaimana Mekanisme Pelaksanaan Lelang Eksekusi dan Lelang Sukarela Terhadap Objek Jaminan Fidusia serta Dampaknya terhadap Pemenuhan Kepentingan Para Pihak yang Terlibat dan Untuk menjawab permasalahan tersebut Pendekatan perundang-undangan dan konseptual digunakan dalam metode penelitian normatif yuridis dan hasil penelitian dapat di simpulkan BahwaBalai Lelang Swasta perlu secara aktif beradaptasi dengan kondisi krisis dengan mengimplementasikan teknologi dan inovasi untuk menyelenggarakan lelang secara daring, serta menyesuaikan prosedur fisik sesuai dengan protokol kesehatan yang diberlakukan oleh pemerintah. Bahwa Balai Lelang Swasta dalam menentukan mekanisme pelaksanaan lelang eksekusi dan lelang sukarela memiliki peran yang signifikan dalam pemenuhan kepentingan para pihak yang terlibat.

Abstract

The issue of responsibility in the transfer of workers' wages in a limited liability company that is bankrupt is an important issue in employment and bankruptcy law. When a limited liability company (PT) is declared bankrupt, there are significant challenges related to workers' rights, especially regarding unpaid wages. This study aims to analyze the legal responsibility in the transfer of workers' wage payment obligations from a bankrupt company to other parties, such as a third party or a replacement company. The methodology of this study uses a qualitative approach with case studies of several companies that are bankrupt. Data were collected through literature reviews, interviews with legal practitioners, and analysis of applicable laws and regulations. The findings of this study indicate that responsibility in the transfer of workers' wages depends not only on existing legal provisions, but also on the agreement between the parties involved in the bankruptcy process. The results of this study reveal that in practice, the transfer of responsibility for workers' wages often creates uncertainty for workers, especially in terms of certainty of payment. Recommendations provided include the need for clearer regulations regarding the transfer of wage obligations, as well as increasing legal protection for workers affected by company bankruptcy.

Abstract

This study analyzes the implementation of Law No. 23 of 2004 concerning the Elimination of Domestic Violence (KDRT) in Karang Suraga Village, Cinangka, Serang, Banten. The main focus of the study is to identify the effectiveness of the implementation of the law in the context of a village community that still strongly adheres to a patrilineal system. Using a qualitative approach with a normative-empirical legal research method, this study combines analysis of legal aspects and social realities in the field. Data collection was conducted through in-depth interviews with community leaders, law enforcement officers, victims of domestic violence, and village officials, and supported by non-participant observation and documentation studies. The results of the study indicate that the implementation of the Domestic Violence Law in Karang Suraga Village still faces significant challenges rooted in patriarchal cultural factors, socio-economic conditions, and the level of community education. Although the village government has established a complaint and family counseling post, its effectiveness is hampered by the view of the community that still considers domestic violence as a family disgrace. The identified impacts of domestic violence include prolonged trauma for victims and negative effects on child development. This study recommends the importance of a comprehensive approach that combines legal aspects with socio-cultural transformation to create sustainable change in efforts to eliminate domestic violence at the village level.

Abstract

This study examines the effectiveness of the inheritance dispute resolution socialization program in increasing awareness of family law in Sukmajaya Village, Depok City. Using a qualitative approach with a case study method, this study involved 30 respondents consisting of families experiencing inheritance disputes, community leaders, legal practitioners, and village officials. The results of the study showed a significant increase in public understanding of inheritance law, with an average increase of 44.9% from the initial condition. Positive transformations were seen from the increasing use of family mediation from 5 to 15 cases per quarter, and the decrease in cases ending in court from 12 to 3 cases. This program succeeded in saving dispute resolution costs by up to 75% compared to litigation and contributed to strengthening social harmony. The main challenges faced include the need to develop materials for digital assets and the digital divide in certain age groups. This study recommends the development of structured modules, strengthening the monitoring and evaluation system, and integration with existing community programs for the sustainability of the program in the future.

Abstract

Dispute between the parties at dispute resolution through arbitration in the 1999 Arbitration Law can be simplified in the form of sending a letter, fax, telegram, electronic mail or other alternative type of communication that makes things easier. Meanwhile, according to the provisions in the law, The Arbitration Law 1999 declares that all examinations of disputes by arbitrators or arbitration panels are carried out behind closed doors with the intention that examination of disputes through arbitration upholds the principle of confidentiality. The purpose of this writing is to examine the legal regulations governing online ad-hoc arbitration trials, but confidentiality is maintained. This research was carried out using a normative approach. After the research was executed, there were no arrangements for examinations to be carried out by online ad-hoc arbitration, even though The 1999 Arbitration Law states the examination of the trial decision should be conducted behind closed doors due to the principle of confidentiality.

Abstract

The rising population in Indonesia has led to an increasing demand for housing, presenting opportunities and challenges for property developers. Although luxury homes yield higher profits, most consumers favor affordable housing. This study aims to optimize the quantity and type composition of homes in Pesona Arjuna Residence, Malang Regency, using the Simplex Method to maximize profits. Developers need to balance market demand and government regulations, which require including affordable and middle-income homes alongside luxury units. The Simplex Method is applied in this study to determine the ideal composition of housing units by factoring in key constraints such as available land, production costs, and market demand. The findings reveal that houses in buildings 12 type A, 18 type B, and 23 type C yield the highest profitability. The Net Present Value (NPV) of Rp 610,940,579.76 at a 10% discount rate confirms the project’s financial success, while the Internal Rate of Return (IRR) of 13.49% indicates a solid annual return on investment. A Benefit-Cost Ratio (BCR) of 1.617 further supports the project’s financial viability, though careful consideration of market fluctuations and risks is advised. This research contributes to sustainable urban planning by offering a flexible approach to housing development, enabling developers to better adapt to market trends and optimize profits while addressing community housing needs.

Abstract

The role of a Notary as a public official is very important and must be able to provide counseling and take the right steps in making authentic deeds by ensuring the formal truth of a legal act, especially a legal act in this case is the transfer of company assets based on a power of attorney to sell and without the approval of the General Meeting of Shareholders. Where the transfer of company assets should refer to the company's articles of association and Law No. 40 of 2007 concerning Limited Liability Companies. The problem raised is the validity of the power of attorney to sell in the transfer of company assets and without the approval of the General Meeting of Shareholders. The research method used is normative legal research, using secondary data consisting of primary, secondary and tertiary legal materials. This study uses a descriptive-analytical data analysis method with a qualitative approach. The results of this study are that if the subjective requirements in making a deed are not met, where the provisions in Article 1320 of the Civil Code must meet the requirements of competence in granting the power of attorney to sell, then the transfer of the asset can be cancelled. A Notary, in carrying out his duties, must be careful, thorough and adhere to the UUJN-UUPJN and KEN.
