Abstract

Education budget management is a vital instrument in realizing the constitutional right to education and improving the quality of Indonesia's human resources. However, reality shows that disparities in allocation, weak supervision and rampant irregularities reduce the effectiveness of the budget. Presidential Instruction No. 1 of 2025 comes as a normative response to strengthen education budget governance, but its implementation cannot be separated from juridical complexities and coordinative challenges in the field. This study aims to juridically analyze the opportunities and challenges of implementing Presidential Instruction No. 1 of 2025 in education budget management in Indonesia. The method used in this research is juridical-normative research, by analyzing secondary data from primary, secondary, and tertiary legal materials. The results show that Presidential Instruction Number 1 Year 2025 has great potential in improving the efficiency and equity of education budget management in Indonesia. However, its implementation faces serious legal challenges, especially related to the unsynchronized regulations between the center and the regions and weak supervision. Therefore, continuous legal reforms, improved regional managerial capacity and a more integrated monitoring system are needed to support the effectiveness of this policy

Abstract

Realita sosiologis-yuridis di Indonesia pernah mengalami keberlakuan bermacam-macam Undang-Undang Dasar (UUD) di antara UUD tersebut adalah UUD Tahun 1945 dan Undang Undang Dasar Sementara (UUDS) 1950. Pada awal kemerdekaan juga pernah diusulkan  rancangan Undang Undang Dasar dari kelompok yang mengklaim  sebagai kelompok Republik Persatuan Indonesia (RPI). Penelitian ini bertujuan untuk mengetahui dan menganalisis perbandingan muatan Hak Asasi Manusia (HAM) dalam UUD Tahun 1945 dalam rancangan kelompok RPI. Metode penelitian ini menggunakan jenis penelitian hukum normatif dengan hukum perbandingan yang melibatkan analisis terhadap berbagai aspek hukum, seperti undang-undang, putusan pengadilan, regulasi, dan sistem peradilan di negara-negara yang menjadi subyek penelitian. Penelitian ini menyimpulkan muatan HAM dalam UUDS 1950 tertuang di bagian V menyatakan bahwa hak-hak dan kebebasan-kebebasan dasar manusia dirinci dalam 27 pasal dan dilanjutkan dalam 6 pasal yang mengatur tentang asas-asas dasar warga negara. Hal yang sama  diusulkan oleh RPI yang diuraikan dalam 26 pasal, pada intinya cenderung ke arah demokrasi yang lebih terbuka  dan menyangkut semua unsur HAM namun dalam perspektif  Islam. UUD 1945 baru memasukkan konsep HAM setelah mengalami amandemen HAM dinyatakan dalam 10 pasal di bawah Bab XA.  Secara historis di Indonesia   mengalami dinamika pemikiran yang intens   dalam menuangkan muatan HAM dalam UUD. Perbandingan tentang muatan HAM dalam UUD menunjukkan adanya dinamika pemikiran bahkan perdebatan, namun pada akhirnya UUD NRI memasukkan muatan HAM melalui amandemen.

Abstract

Child Labor is a serious problem that has attracted national and international public attention. The purpose of writing this article is to analyze in depth the review of the fulfillment of child Labor rights based on maqashid sharia. This article's research method uses a type of normative legal research using secondary data obtained through literature study. The collected data was then analyzed descriptively qualitatively using a conceptual approach, namely the concept of maqashid sharia. The results and findings in this article are that Islam places the fulfillment of children's rights as an important thing to realize. The general aim of Allah SWT in sending down the Shari'a is to bring about benefits. The basic concept of benefit is realizing benefits and preventing harm. The practice of child Labor is prohibited, because it conflicts with the five main principles of maqashid sharia, namely the protection of religion, soul, mind, property and descendant, which are primary needs (dharuriyyah) that must be fulfilled in humans. The priority of a child's age is to fulfill the rights of religion, soul, reason and heredity rather than fulfilling the need for wealth.
