Abstract

Hakim sebagai unsur utama dalam pengadilan yang menempatkan profesinya tersebut sebagai wakil tuhan, sebab tugas hakim adalah untuk menentukan hukum dan keadilan dalam masyarakat, sehingga tanggung jawab yang diembannya sangatlah berat namun mulia. Oleh karena itu kekuasaan yang begitu besar dimiliki oleh profesi hakim, maka hakim dituntut dengan keseimbangan sikap yang penuh rasa tanggungjawab pada hati nurani serta nilai-nilai etik terhadap profesinya. Namun jika melihat kenyataan saat ini, terjadi penurunan kualitas hakim tidak hanya dalam putusanya namun juga menyangkut penurunan aspek moral. Penguatan etika dalam profesi hakim menjadi keharusan dan kewajiban bagi penyelenggara negara sebab etika menjadi koridor utama bagi hakim dalam mengemban tugasnya agar tetap menjalankan profesinya secara profesional tanpa mengesampingkan nilai-nilai kejujuran serta moralitas. Hal tersebut sebagai upaya dalam mewujudkan penegakan hukum yang berkeadilan. Metode penelitian yang digunakan dalam penelitian ini adalah metode normatif dengan pendekatan konseptual dan pendekatan peraturan perundang-undangan. Hasil penelitian ini adalah hakim harus mampu mengejawantahkan nilai-nilai etika dan moral sebagaimana yang telah dirumuskan dalam kode etik profesi hakim, yakni dengan menyelami rasa keadilan yang dianut masyarakat. Dengan landasan etika dan moral melalui kode etik profesi hakim, maka hakim akan mewujudkan penegakan hukum yang berkeadilan.

Abstract

The judge as the main element in the court places his profession as a representative of God, because the judge's job is to determine law and justice in society, so the responsibility he bears is very heavy but noble. Therefore, the profession of judges has such great power, that judges are required to balance an attitude that is full of responsibility to conscience and ethical values ​​towards their profession. However, if you look at the current reality, there has been a decline in the quality of judges not only in their decisions but also in regards to a decrease in the moral aspect. Strengthening ethics in the profession of judges is a necessity and obligation for state administrators because ethics is the main corridor for judges in carrying out their duties so that they continue to carry out their profession in a professional manner without putting aside the values ​​of honesty and morality. This is an effort to realize fair law enforcement. The research method used in this study is a normative method with a conceptual approach and a statutory approach. The results of this study are that judges must be able to embody ethical and moral values ​​as formulated in the code of ethics for the profession of judges, namely by exploring the sense of justice held by society. With an ethical and moral foundation through the professional code of ethics of judges, judges will realize fair law enforcement.

Abstract

Goal 8 of the Sustainable Development Goals aims to promote inclusive and sustainable economic development, provide full and productive employment, and ensure decent work for all individuals. Regrettably, in Indonesia, the concept of decent work encompassing social security, workers' rights, social dialogue, and employment is exclusively applicable to the formal economic sector, neglecting the informal economic sector, which comprises unregulated wage workers, employers, and homeworkers. Indeed, informal economic development is a fundamental foundation of the nation's economy. Achieving this type of decent work is a goal for sustainable development and would help support a lasting economy, as stated in Article 28, paragraph (2) of the constitution. This research seeks to examine the legal safeguards for labor and decent work, the realization of labor rights post-labor legislation, and the correlation between employment and sustainable development. The research methodology used is normative, using both a conceptual framework and an analysis of laws and regulations. This study's findings indicate a correlation between employment and sustainable development. An adept workforce may expedite the nation's developmental trajectory, enabling it to compete with more advanced nations. The results will positively influence the process of entering new markets.

Abstract

In practice, pretrial hearings in Indonesia often fail to be an effective instrument for protecting the rights of suspects and victims in the Pro Justitia process. Many cases show that the imbalance between law enforcement officials' authority and individual rights remains an unresolved. This situation differs from that in Germany and South Korea, where constitutional complaints have become an important instrument in the constitutional system for controlling and correcting state actions that violate citizens' constitutional rights, including within the criminal justice system. This study examines the extent to which the absence of a constitutional complaint mechanism in the Indonesian criminal justice system affects the protection of citizens' constitutional rights. Using a normative legal research method, with a statute, conceptual, and comparative approach, this study found that Indonesia has yet to implement a constitutional complaint mechanism as a corrective measure against state actions that violate citizens' constitutional rights. Preliminary hearings still have limitations in accommodating constitutional rights in criminal proceedings. The absence of this mechanism creates a void in the constitutional protection system in the judicial process in Indonesia as a whole. The implementation of constitutional complaints should be considered to strengthen the protection of constitutional rights and ensure the implementation of the Pro Justitia process in line with the principles of the rule of law
