Abstract

To accomplish agrarian reform (RA) which aims to improve people's welfare by rearranging the structure of land tenure along with community empo¬wer¬ment, organizational elements with solid synergy are required. The Rejang Lebong Regency Government, BPN, the Alliance of Indigenous Peoples of the Archipelago (AMAN), and other elements of the Agrarian Reform Task Force (GTRA) supported by the Presidential Staff Office (KSP) have been trying to carry out this mandate since 2017. This paper aims to provide an overview of the implementation of RA, the challenges faced by the RA institutions in Rejang Lebong Regency. The method used is descriptive qualitative research. The collected data and information is then analyzed into several categories, namely the settlement of potential land objects for agrarian reform (TORA), agrarian conflict resolution, asset management which is followed up with com¬munity empowerment as outlined in the Kampung Reforma Agraria Project, and the role of RA institutions. The findings in this study are that the implementation of RA in Rejang Lebong Regency, which is fully supported by the commitment of the local government, initiatives from the community, and support from the ministry of vertical institutions (especially the Ministry of ATR/BPN, KLHK, and KSP), answers various challenges that arise, especially in terms of cross-sectoral coordination. However, there needs to be a more operational implementing regulation as a derivative of Perpres no. 86 of 2018 as a supporter and reinforcement of the policies issued by GTRA.

Abstract

An electronic certificate (Sertipikat-el) results from a series of electronic land registration activities in electronic documents that should be digital eviden­ce. This paper describes the infrastructure of Sertipikat-el and offers steps that can be taken so that Sertipikat-el does not lose its essence as evidence of ownership and not ruled out in evidence at trial. Sertipikat-el in electronic documents does not violate the laws and regulations. Unfortunately, the electronic system used to create and manage Sertipikat-el does not meet all requirements so that it can guarantee that each component and the integration of all electronic systems continue to operate properly by minimizing the failure of electronic systems. Although Sertipikat-el has been determined in electronic documents, it has not been further regulated regarding data input and information. For this reason, there is a need for a complete revision of ministerial regulations and imple­men­tation related to electronic land registration at the technical level in the field. To ensure the used electronic system's essential function to create and manage the Sertipikat-el continues to run even in the event of a disaster or disruption, the electronic system needs to be registered. A reliability test and an audit from the competent agency are carried out. In addition, the system must also have archival functionality and be defined from the beginning whether the creation and management of Sertipikat-el are carried out in an electronic system or not because it will affect the method of presenting Sertipikat-el data as digital evidence at the trial.

Abstract

Jumlah Rencana Detail Tata Ruang hingga saat ini masih dikategorikan minim, yaitu sebanyak 260 produk per Januari 2023 dari target sebanyak 2.000 produk pada tahun 2024. Hal ini ditengarai oleh belum teraksesnya data spasial pertanahan tersebut oleh para penyusun dokumen RDTR di daerah. Keterbatasan aksesibilitas data di Indonesia tersebut tidak terjadi di Belanda, yang notabene telah memanfaatkan data spasial pertanahan untuk berbagai hal termasuk untuk penyusunan rencana tata ruang. Berdasarkan kedua hal tersebut, peneliti ingin mengetahui kondisi berbagi pakai data spasial pertanahan di Belanda dan di Indonesia. Metode kajian yaitu kualitatif deskriptif dengan pendekatan pada studi literatur, yang berfokus pada lima variabel penyusun Infrastruktur Data Spasial (IDS) yaitu teknologi, sumber daya manusia, baku standar data, kebijakan/peraturan, dan data. Hasil kajian menunjukkan bahwa berbagi pakai data pertanahan untuk berbagai kepentingan, terutama untuk penyusunan rencana tata ruang, telah terwujud di Belanda karena kelima variabel penyusun IDS telah mendukung terwujudnya berbagi pakai data pertanahan. Kondisi demikian belum mampu diwujudkan di Indonesia karena masih ada beberapa kendala dalam hal teknologi, sumber daya manusia, implementasi kebijakan, dan kualitas data.

Abstract

The large proportion of forest area in Banyuwangi Regency, which reaches 30%, has triggered many conflicts over land control by the community. This conflict has been going on for 20 years without resolution. The Ministry of Environment and Forestry reorganized forest area boundaries in 2023 through the Land Tenure Settlement in Forest Area Management (PPTPKH) program, and removed 725.81 hectares from forest area status through Decree No. 1004/MENLHK/SETJEN/PLA.2/9/2023 (Blue Decree). The momentum for the availability of land for agrarian reform objects from the release of forest areas is the starting point for land redistribution in agrarian reform, providing legal certainty to the community. The first quarter of 2024 saw the electronic issuance and submission of 10,323 land certificates. This research uses descriptive qualitative methods. The triangulation method was carried out to ensure the validity of the data and information obtained. This research revealed that the Agrarian Reform Task Force members actively participate in the largest land redistribution strategy in Indonesia. The acceleration of agrarian reform in Banyuwangi Regency serves as a valuable lesson for the completion of land redistribution in Indonesia.   Besarnya proporsi luas kawasan hutan di Kabupaten Banyuwangi yang mencapai 30%, memicu banyak konflik penguasaan tanah oleh masyarakat. Konflik ini telah berlangsung selama 20 tahun tanpa penyelesaian. Pada 2023, melalui program Penyelesaian Penguasaan Tanah dalam Penataan Kawasan Hutan (PPTPKH) oleh Kementerian Lingkungan Hidup dan Kehutanan, batas kawasan hutan ditata ulang, dan 725,81 hektar dikeluarkan dari status kawasan hutan melalui SK No. 1004/MENLHK/SETJEN/PLA.2/9/2023 (SK Biru). Momentum ketersediaan tanah objek reforma agraria dari pelepasan Kawasan hutan ini menjadi titik awal redistribusi tanah dalam reforma agraria, memberikan kepastian hukum kepada masyarakat. Sebanyak 10.323 sertifikat tanah diterbitkan dan diserahkan secara elektronik pada kuartal pertama tahun 2024. Penelitian ini menggunakan metode kualitatif deskriptif. Metode triangulasi dilakukan untuk menjamin validitas data dan informasi yang diperoleh. Penelitian ini menemukan bahwa strategi percepatan redistribusi tanah yang disebut sebagai yang terbesar di Indonesia ini melibatkan peran aktif dari pemangku kepentingan yang tergabung dalam Gugus Tugas Reforma Agraria. Berpijak dari percepatan Reforma Agraria yang dilaksanakan di Kabupaten Banyuwangi, strategi kolaboratif ini layak menjadi pembelajaran yang baik (lesson learned) untuk penyelesaian redistribusi tanah di Indonesia.

Abstract

The use of information technology in public services, especially in local government agencies in the land sector, has a positive impact on administrative efficiency. This study focuses on the implementation of a digital archive system for managing land acquisition documents at the Yogyakarta City Land and Spatial Planning Service. Conventional methods that have been used so far have caused various problems, including process inefficiencies, document security vulnerabilities, and difficulties in tracking archives. To overcome these problems, an E-Archive application was developed by implementing the Waterfall system development model consisting of the following stages: (1) needs analysis, (2) system design, (3) implementation, (4) testing, and (5) maintenance. This system was built using the PHP programming language for the backend and CSS for the frontend. The results of black box testing showed that all system functions operated according to the specified requirements. The implementation of this system succeeded in increasing data accessibility by 40% and reducing administrative workload by 35%. This study not only presents technical solutions for archive digitization but also provides a digital transformation model that can be adopted by other local government agencies. Pemanfaatan teknologi informasi dalam pelayanan publik, khususnya di instansi pemerintah daerah bidang pertanahan, memberikan dampak positif terhadap efisiensi administrasi. Penelitian ini berfokus pada implementasi sistem arsip digital untuk pengelolaan dokumen pengadaan tanah di Dinas Pertanahan dan Tata Ruang Kota Yogyakarta. Metode konvensional yang selama ini digunakan menimbulkan berbagai masalah, termasuk inefisiensi proses, kerentanan keamanan dokumen, dan kesulitan dalam pelacakan arsip. Untuk mengatasi masalah tersebut, dikembangkan aplikasi E-Arsip dengan menerapkan model pengembangan sistem Waterfall yang terdiri dari tahap: (1) analisis kebutuhan, (2) perancangan sistem, (3) implementasi, (4) pengujian, dan (5) pemeliharaan. Sistem ini dibangun menggunakan bahasa pemrograman PHP untuk backend dan CSS untuk frontend. Hasil pengujian black box menunjukkan seluruh fungsi sistem beroperasi sesuai dengan persyaratan yang ditetapkan. Implementasi sistem ini berhasil meningkatkan aksesibilitas data sebesar 40% dan mengurangi beban kerja administratif hingga 35%. Penelitian ini tidak hanya menyajikan solusi teknis untuk digitalisasi arsip, tetapi juga memberikan model transformasi digital yang dapat diadopsi oleh instansi pemerintah daerah lainnya.

Abstract

As the population grows and develops, agricultural land conversion becomes an inevitable activity. In the Special Region of Yogyakarta, Sleman Regency has the most agricultural land conversion problems. A comprehensive strategy with community involvement is needed to resolve this problem. Reporting is one way for community involvement in controlling agricultural land conversion. The aim of this study is to develop a community-supported information system and reporting instrument for monitoring agricultural land conversion. Using a participatory qualitative approach, the research method adapts the waterfall method to prepare a reporting application system. Spatial analysis was carried out to understand the characteristics of land use changes at the research location. The results of the research are a reporting application and a reporting dashboard in the form of a webGIS that provides initial information as input for the regional government in implementing monitoring, evaluating, and controlling space utilization. A web-based reporting application allows the community to report agricultural land conversions suspected of violating spatial planning. The community can also find out the direction of spatial planning in their area from the spatial planning map, which is the application's base map The reporting dashboard is a webGIS interface designed to be operated by authorized agencies and contains the results of public reporting. Access is limited and may not be released until the validation procedure is complete.   Seiring bertambahnya dan berkembangnya jumlah penduduk, alih fungsi lahan pertanian merupakan suatu kegiatan yang tidak bisa dihindari. Di Daerah Istimewa Yogyakarta, Kabupaten Sleman mempunyai permasalahan konversi lahan pertanian yang paling banyak. Dibutuhkan strategi menyeluruh dengan keterlibatan masyarakat untuk menyelesaikan masalah ini. Salah satu bentuk keterlibatan masyarakat dalam mengendalikan alih fungsi lahan pertanian adalah dalam bentuk pelaporan. Tujuan studi ini adalah untuk mengembangkan sistem informasi dan instrumen pelaporan yang didukung masyarakat untuk pemantauan konversi lahan pertanian. Metode penelitian mengadaptasi metode waterfall dalam rangka penyusunan sistem aplikasi pelaporan dengan menggunakan pendekatan kualitatif partisipatif. Analisis spasial dilakukan untuk memahami karakteristik perubahan penggunaan tanah di lokasi penelitian. Hasil dari penelitian adalah aplikasi pelaporan dan dashboard pelaporan berbentuk webGIS yang memberikan informasi awal sebagai masukan bagi Pemerintah Daerah dalam pelaksanaan pemantauan serta evaluasi pemanfaatan ruang dan pengendalian pemanfaatan ruang. Masyarakat dapat melaporkan konversi lahan pertanian yang diduga melanggar tata ruang melalui aplikasi pelaporan berbasis web. Masyarakat juga dapat mengetahui arah penataan ruang di wilayahnya dari peta rencana tata ruang yang menjadi peta dasar aplikasi. Dashboard pelaporan merupakan webGIS yang dirancang untuk dapat operasikan oleh instansi yang berwenang, dan memuat hasil dari pelaporan masyarakat yang aksesnya dibatasi dan tidak boleh dirilis hingga prosedur validasi selesai.
