Abstract

Interfaith marriages remain a controversial subject among scholars in Indonesia. Despite the legal prohibition, the practice of interfaith marriage continues to persist. This article analyses various legal norms, decisions of the state courts and the Indonesian Constitutional Court related to interfaith marriages, revealing disparities between legal norms and practical implementation. Employing a normative approach through a literature review, this research finds that the state legislation strictly prohibits interfaith marriage. Paradoxically, couples navigate a legal workaround, exploiting a loophole in Population Administration Law No. 23 of 2006 to formalise their marriages. They submit applications to the district court, and the court’s decisions serve as the basis for recording their union. Some couples also employ an alternative strategy by marrying abroad and subsequently registering their unions upon returning to Indonesia. The article argues that the state’s legal expression in regulating the practice of interfaith marriages in Indonesia manifests ‘double face’. This study holds significant implications, particularly in enhancing policy comprehension, providing profound insights into the legal dynamics of interfaith marriages in Indonesia, and assessing its impact on citizens’ religious freedom.

Abstract

This study aims to provide understanding and legal counseling regarding child abuse in Singkawang City, West Kalimantan, with a focus on bullying, sexual violence, and child marriage. The counseling activity was carried out by the Faculty of Sharia at IAIN Pontianak at MAN Kota Singkawang and SMAN 2 Kota Singkawang in 2023. The implementation method consisted of three stages: preparation and administrative processes, field activities, and reporting the results. The delivery of the material was conducted through an interactive model and dialogue, interspersed with clips from the film A Silent Voice and reflections on the song Satu Satu. The results of the activity showed that participants gained an understanding of perpetrators, victims, and witnesses in cases of child abuse, as well as appropriate prevention and reporting mechanisms. Feedback from participants revealed that bullying and sexual violence are relevant issues in the school environment, with the main focus on prevention starting from oneself and the importance of building a healthy, equal, and inclusive friendship environment.

Abstract

This study investigates the critical issue of Regulatory Ambiguity surrounding the iddah period, specifically examining the friction between the Indonesian Circular Letter No. P-005/DJ.III/HK.00.7/10/2021 and the persistent, widespread practice of unregistered (sirri) marriage in Pontianak City. This intersection creates a crucial challenge to the coherence of Islamic Family Law, amplifying wider theoretical debates on Legal Dualism and the effectiveness of state intervention in personal status matters, ultimately jeopardizing women's rights and the legal protection of children. The primary purpose is to systematically identify the systemic causes of this discrepancy and analyze its profound impact on legal certainty and the state's authoritative capacity regarding matrimonial enforcement. Employing a combined juridical-normative and empirical approach, the research utilized legal document analysis alongside in-depth, strategic interviews with 10 key informants, comprising both officials from the Office of Religious Affairs (KUA) and citizens directly involved in sirri marriages, thus providing credible insights into the practical realities of legal pluralism. Findings reveal a profound administrative breakdown, exemplified by the critical statistic that 93% of KUA officials demonstrate a failure to distinguish accurately between iddah talak raj'i (revocable divorce) and iddah talak ba'in (irrevocable divorce). This lack of administrative competency directly translates into a systemic vulnerability, where legal loopholes are routinely exploited, leading to the disenfranchisement of wives and children in property and inheritance claims. This article contributes significantly to the discourse on Islamic Family Law Reform, providing an evidence-based framework for jurisprudential clarity that promotes judicial authority and ensures equitable enforcement of marital rights in the long term

Abstract

Inheritance law in the Compilation of Islamic Law (KHI) and the Civil Code (KUHPer) are two written laws that regulate the division of inheritance in Indonesia. The KHI applies to Muslims, while the KUHPer applies to non-Muslims. The differences in these provisions pose challenges and complexities in enforcing inheritance law in Indonesia. This study utilizes library research with a juridical-normative method. The author found that Islamic inheritance provisions are contained in Articles 171-193, 209-214, based on the provisions of Surah Al-Nisā’ verses 7, 11, 12, 33, and 176. On the other hand, the KUHPer is regulated in Articles 839-1149. Regarding inheritance acquisition, the KHI regulates it in the form of inheritance acquisition by children, fathers and mothers, widowers and widows, and inheritance acquisition by siblings with predetermined portions in the KHI. Meanwhile, the KUHPer divides it into two major groups, namely lawful heirs without illegitimate children recognized legally and lawful heirs together with recognized illegitimate children. These differences in inheritance provisions provide clarification, regulations, dispute resolution, child protection, and harmony to raise public awareness of inheritance rules.
