The paradigm shift from retributive justice to restorative justice has encouraged institutional awareness that restorative justice methods are alternatives that need to be strengthened both in terms of policy and practice. This has prompted law enforcement agencies to begin drafting and enforcing restorative justice policies in the criminal case settlement process. The purpose of this research is to analyze the working process of restorative justice policies through their implementation practices in each institution that focuses on various criminal justice institutions in Pontianak City. This study will describe the factors that influence the process of working in restorative justice by elaborating on the paradigm of law enforcement officers, policies at their institutions, and their experiences and practices. The method used is normative-empirical legal research as research on law enforcement in concreto. Although the paradigm of punishment has shifted towards a restorative paradigm, the findings in the field showed frequent obstacles. First, cross-sectoral regulatory factors that regulate restorative justice mechanisms with different mechanisms. Second, the weak integration of the criminal justice system as seen in practice between the Pontianak Police and the Pontianak District Attorney Office has not shown the integration of the criminal justice system in the corridor of enforcing the principle of functional differentiation. Third, the factor of criminal law policy is overcriminalistic so it is still overshadowed by the retributive and punitive colonial paradigm. Fourth, factor in the small period of time in the prosecutor's office due to tiered assessments within the structural corridors of leadership. Fifth, the legal culture factor of society is still mostly punitive. Keywords: Paradigm; Restorative Justice; Criminal Justice System

One of the tasks of criminal law reform is to consolidate criminal law provisions that are scattered in various laws and regulations. The drafting team has incorporated several special offences into the National Criminal Code as a bridge between the norms, making the National Criminal Code the epicentre. This raises normative questions about the position of special offences, especially corruption offences, when the norms are shifted to general norms in the National Criminal Code, in relation to the systematic enactment of Book I of the National Criminal Code, and whether the changes in the criminal formulation are proportional to the spirit of eradicating corruption. This research will focus on answering the above-mentioned normative concerns. This type of research is a normative research that focuses on the content analysis of legal materials in the form of Book I of the National Criminal Code, articles on corruption in the National Criminal Code and the Corruption Act. The validation process of the analysis results was presented in a forum group discussion with several legal aid organisations and university research institutions. The results of the research show that the intention of the drafting team to include corruption offences is limited to the technical consolidation of corruption offences in the National Criminal Code in the form of bridging articles. In the context of the fight against corruption, there are five crucial reservations, namely the disparity of penalties, the categorisation of fines, the powers of the State Loss Calculation Institution, the stagnation of the regulation of bribery offences and the harmonisation of the United Nations Convention against Corruption.

The legacy of past conflicts has prompted the emergence of a civil society movement with the objective of transforming Pontianak City into a Human Rights City. This movement is pursuing this goal through the drafting of a Regional Regulation on Tolerance. Nevertheless, the legislative and political process within the Regional Houses of Representatives has given rise to paradigmatic debates concerning the concept of human rights. This article aims to elucidate the paradigmatic conflict between state actors and civil society during the drafting of the Regional Regulation on Tolerance in Pontianak City. The field study presented in this article is based on active participation in public hearings and dialogues between the Regional Houses of Representatives and civil society. The study employs a socio-legal approach, which reveals a contention between two distinct paradigms: the positivist paradigm (naive realism), as represented by state actors, and the critical paradigm (historical realism), as advocated by civil society. The Regional Houses of Representatives, as state actors, oppose the institutionalization of tolerance on the grounds that the Eurocentric concept of human rights may conflict with Sharia and local culture. In contrast, civil society views tolerance as a tool for addressing structural inequalities inherited from past conflicts. The inability of the two parties to reach a consensus led to the failure to ratify the Regional Regulation on Tolerance, which prioritizes human rights. This outcome underscores that human rights have not been a primary consideration in the formulation of local regulations on tolerance. This attitude contrasts with international and national human rights law, which has the effect of neglecting the aspiration to become a human rights city. This research contributes to changes in the strategy of the civil society movement in advocating for human rights law in regional policy.

This study aims to provide understanding and legal counseling regarding child abuse in Singkawang City, West Kalimantan, with a focus on bullying, sexual violence, and child marriage. The counseling activity was carried out by the Faculty of Sharia at IAIN Pontianak at MAN Kota Singkawang and SMAN 2 Kota Singkawang in 2023. The implementation method consisted of three stages: preparation and administrative processes, field activities, and reporting the results. The delivery of the material was conducted through an interactive model and dialogue, interspersed with clips from the film A Silent Voice and reflections on the song Satu Satu. The results of the activity showed that participants gained an understanding of perpetrators, victims, and witnesses in cases of child abuse, as well as appropriate prevention and reporting mechanisms. Feedback from participants revealed that bullying and sexual violence are relevant issues in the school environment, with the main focus on prevention starting from oneself and the importance of building a healthy, equal, and inclusive friendship environment.

Systems regarding the legal remedy of communication interception can be found in several regulations. However, those systems are not supported by horizontal harmonization since each regulation governs the mechanism differently, so there is a disparity among interception regulation. This paper analyzes the harmonization of wiretapping regulations in Indonesia from a law enforcement perspective with an inventory of regulations governing the current mechanism of interception. The results concluded that first, the disparity in intercepting authority of communication interception practice regulated by several institutions in the same form of crime eradication authority must be reformulated to restore overlapping regulations. Secondly, the interception regulation as a coercive force that derogates the right to privacy must contain detailed provisions in terms of a permit request and the wiretapping authority. The permit application must contain the purpose of the request for wiretapping permission descriptively. Moreover, these provisions must explicitly regulate legal subjects that are authorized to conduct wiretapping practice in the form of clear mechanisms and coordination with the direct superiors and court supervision regulating the interception procedure as well as the cooperation between law enforcement officials and telecommunications service providers. Third, prospectively interception regulations can be assessed from the political will of the legislators. The decision of the Constitutional Court No. 5/PUU-VIII/2010 mandates the need for horizontal harmonization of interception regulations in the form of the Interception Bill, which is also included in the 2019 National Legislation Program.

Prinsip Miranda Rules merupakan prinsip fundamental yang imperatif sifatnya di dalam prosedur peradilan pidana. Prinsip tersebut melekat pada hak-hak tersangka atau terdakwa sebagai bagian dari manusia seutuhnya. Salah satu yang menjadi bagian dari prinsip tersebut adalah adanya hak tersangka atau terdakwa untuk didampingi oleh penasehat hukum yang dibarengi dengan kewajiban penegak hukum untuk menyediakan akses bantuan hukum sebagaimana ketentuan Pasal 56 KUHAP. Namun, implementasi pasal 56 KUHAP belum sepenuhnya ditegakkan. Salah satunya di Pengadilan Negeri Sungguminasa melalui Putusan Nomor 03/Pid.B/2015/PN.Sgm yang di dalamnya menyebutkan bahwa terdakwa tidak didampingi oleh penasehat hukum. oleh karena itu penelitian ini ingin mengungkapkan problematika terdakwa di dalam putusan tersebut tidak didampingi oleh penasehat hukum selama proses persidangan berlangsung. Selain itu, penelitian ini juga ingin mengungkap faktor-faktor yang menyebabkan terdakwa tidak didampingi oleh penasehat hukum. Metode yang digunakan di dalam penelitian ini adalah penggabungan antara penelitian yuridis normatif dan penelitian yuridis empiris. Sifat penelitian ini adalah deskriptif dengan menganalisisnya secara kualitatif. Hasil penelitian mengungkapkan bahwa terdakwa berdasarkan perkara a quo tidak didampingi oleh penasehat hukum dikarenakan terdakwa menolak didampingi oleh penasehat hukum sehingga Hakim Pengadilan Negeri Sungguminasa merasa kewajiban Pasal 56 KUHAP menjadi gugur. Adapun faktor-faktor yang mempengaruhi keadaan terdakwa tidak didampingi oleh penasehat hukum adalah terbitnya SP2DPH sejak saat penyidikan berlangsung, pemahaman konotatif terdakwa mengenai penasehat hukum, kekuatan daya mengikat norma di dalam Pasal 56 KUHAP rendah, kurangnya koordinasi antara Pengadilan dengan Posbakum, pandangan aparat penegak hukum yang masih memandang inferior profesi advokat.

Data Kementrian Pemberdayaan Perempuan dan Perlindungan Anak mencatat pada tahun 2022 terdapat 18.250 kasus kekerasan dalam rumah tangga. Angka ini mengindikasikan tingginya tingkat kerentanan perempuan sebagai korban dalam hubungan rumah tangga. Penelitian ini bertujuan untuk menganalisis ketentuan Undang-Undang Penghapusan Kekerasan dalam Rumah Tangga dalam tinjauan maqashid syariah. Peneliti menggunakan metode penelitian kualitatif dengan jenis penelitian hukum normatif. Bahan hukum primer menggunakan Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga dan bahan hukum sekunder berasal dari berbagai literatur yang membahas maqashid syariah. Teknik pengumpulan bahan hukum dengan menggunakan studi dokumen atau studi kepustakaan yang diklasifikasikan berdasarkan bahan-bahan hukum yang relevan. Proses analisis data dilakukan secara deskriptif dan preskriptif. Bahwa peran Undang-Undang Penghapusan Kekerasan dalam Rumah Tangga adalah melindungi korban atau mencegah terjadinya kekerasan yang selaras dengan tujuan maqashid syariah yaitu hifdz al-nasl, hifdz al-nafs, hifdz al- maal, hifdz al-diin, dan hifdz al-aql yang dalam hal ini keduanya saling memiliki peran dalam menjaga tujuan kemaslahatan umat.

The purpose of this study is to analyze the extent of the legal contribution to the inclusiveness of the work environment to overcome violations of the right to work. The type of research used in this paper is socio-legal research with a statutory approach. The number of workers with disabilities is still very low. This is because there is still stigmatization that places people with disabilities as a marginalized group. The ratification of the Law on Persons with Disabilities is the responsibility of the State after the ratification of the Convention on Persons with Disabilities. The government sets mandatory work quotas as affirmative action. The law also incorporates a social ecology approach ranging from accommodation, and support structures for an equal and inclusive work environment. The government also issued a policy to reward employers who promote and protect the rights of persons with disabilities in their work environment. While Indonesia has made progress, this policy has not been fully implemented at the local government level. A recommendation that needs to be developed is the need for audits of employers to ensure how much the right to work has been fulfilled. .

Penelitian ini dilatarbelakangi adanya praktik yang masih terjadi di desa Sungai Ambangah yang didasari atas kebiasaan masyarakat zaman dahulu yaitu praktik menumpang lahan pertanian padi. Maka dari itu, peneliti tertarik untuk meneliti keabsahan dari cara praktik menumpang lahan pertanian padi tersebut ditinjau dari Kompilasi Hukum Ekonomi Syariah. Penelitian ini bertujuan untuk mengetahui bagaimana praktik menumpang lahan pertanian padi yang sebenarnya terjadi di desa Sungai Ambangah tersebut. Jenis penelitian ini adalah normatif yang diperoleh dari pihak yang melakukan akad lahan tumpangan dan kajiannya berdasarkan Kompilasi Hukum Ekonomi Syariah (KHES). Peneliti menggunakan teknik pengumpulan data dengan observasi dan wawancara langsung kepada para pihak yang berakad. Data dikelompokkan menjadi data primer yakni beberapa petani di desa Sungai Ambangah dan KHES yang mengatur kerja sama bagi hasil dan data sekunder yakni buku-buku maupun jurnal-jurnal yang berhubungan dengan topik penelitian ini. Akhirnya, penelitian ini menunjukkan bahwa praktik menumpang lahan pertanian yang dilakukan sah secara hukum walau sudah dianggap sebagai adat dan kebiasaan. Praktik muamalah ini termasuk dalam muzara’ah yang terdapat dalam KHES. Dalam penelitian ini diharapkan adanya penelitian lanjutan mengenai alternatif penyelesaian sengketa apabila terjadi permasalahan yang timbul akibat konflik internal antar masyarakat dalam praktik menumpang ini.

Penelitian ini bertujuan untuk menganalisis jawaban atas status hukum upah pekerja muslim membangun gereja di Kabupaten Sanggau menurut Komisi Fatwa Majelis Ulama Indonesia (MUI) Kabupaten Sanggau. Penelitian ini merupakan jenis penelitian hukum empiris dengan pendekatan kualitatif serta dengan sifat deskriptif analisis. Sumber data menggunakan data primer berupa wawancara dengan informan pekerja bangunan muslim dan pengurus Majelis Ulama Indonesia (MUI) Kabupaten Sanggau sedangkan data sekunder berupa buku, jurnal, skripsi, dan artikel-artikel membahas tentang kerjasama status hukum upah pekerja muslim membangun sarana ibadah gereja. Sedangkan uji keabsahan data, peneliti hanya menggunakan triangulasi. Berdasarkan hasil penelitian dapat disimpulkan bahwa: 1) Sistem upah bagi para pekerja bangunan menggunakan sistem upah borongan dengan kesepakatan secara tertulis dan sistem upah harian dengan kesepakatan secara lisan. 2) Status hukum upah yang diterima para pihak beragama Islam yang melaksanakan kerjasama pembangunan gereja di antaranya pihak kontraktor, pihak pemborong/kepala tukang, dan pihak tukang menurut Komisi Fatwa MUI Kabupaten Sanggau adalah halal. 3) Dalil hukum yang digunakan Komisi Fatwa MUI Kabupaten Sanggau dalam menetapkan status hukum halal upah pekerja muslim membangun sarana ibadah gereja di Kabupaten Sanggau berpijak pada dalil tekstual yaitu Al-Qur’an, Sunnah, dan Qawaid Fiqhiyyah/Kaidah Fikih. Kemudian juga menggunakan dalil kontekstual yaitu dalil aqli (kondisi masyarakat yang pragmatis, sumber daya para pekerja yang tergolong rendah, dan alasan situsional) dan Tarikh Tasyri’ (istinbat hukum dari sejarah masa Sayyidina Ali dan masa KH. Hayim Asy’ari).
