Abstract

The history of writing error in the Qur'an derived from Aisha and justified by Khalifa Uthman bin Affan received a different responses among Islamic researchers, both from the strictly rejecting that history of writing (riwayat) until to those who accepted the existence the riwayat but with different "reading". On the legal side (juridical), the existence of that riwayat can result in juridical implications, especially in the methodological aspect. Such thought is not driven by the negative domain, but it must be in a positive domain, where the existence of that riwayat provides more progressive and responsive ijtihad, whether the answer is for the diversion to the difference of qira’at or not, the Islamic texts will be read more critically, so the legal purpose of “suitable in every time and place” would be reached.

Abstract

Pesantren ’s distinctive characteristics, is an intelligent cultural product which should be maintained and preserved sustainably. In Manado, Pesantren Alkhairaat becomes an important element in preserving tradi- tions of kepesantrenan (a-la pesantren) which is influenced by Arab tradi- tion. The relationship between kiai (clerics) with their santri (students), as a caretaker-caregiver should be studied, to determine the attempt of those two elements in maintaining pesantren’s unique traditions, as also the patterns of relationship that exist between them. As an Islamic insti- tution in Manado, Pesantren Alkhairaat until recently is still practicing some of typical Islamic traditions that became it’s trademark. Relation- ship between various elements, especially kiai-santri is an important fac- tor for the continuity of these traditions in the future. Moreover, kiai- santri relationship in Pesantren Akhairaat Manado is more likely based on emotional relationships.

Abstract

The purpose of a marriage is to form a happy, prosperous and loving family, or in terms of Law No. 1 of 1974 concerning Marriage, is a happy family. The purpose of the marriage will be able to be realized when the people involved in marital practices follow the rules of applicable law and not with an intention to trick or break the law. Because there are persons who commit irregularities in marriage law, progressive and responsive legal breakthroughs are also needed, using local wisdom values that live in the community, namely in the form of criminal sanctions for violators. Criminal sanctions that can be born in family law can be analogous to the penalties that have lived in local communities such as fines, prison rooms and prison villages, and sentences of eviction from their homes to distant places. For this reason, presenting criminal sanctions in Indonesian marriage law is an inevitability.

Abstract

The term “ torang samua basudara” was the slogan of the community in North Sulawesi in order to keep social harmony and peace in the North Sulawesi. In the context of family law, the idea of “torang samua basudara” implemented in micro to solve family conflicts in the form of divorce so that it can leave a further conflicts, especially for family members, so it takes a formula constructive to actualize the ideas “torang samua basudara” which implies the decline of divorce rate in North Sulawesi. Through the symbol “torang samua basudara” it can built up through value meaning as a process, not as a result. As a process, the value or the idea of “torang samua basudara” expose the openness of thought and communication between couples (husband and wife) more intensively so that family problems will be more easily solved and conflict resolution will present first, before the presentconflict toward divorce

Abstract

The purpose of community service by mentoring and coaching in socio-religious contexts for Muslims with visually impaired or blind disabilities in Manado city is to increase the spirit of religiosity and social lives. This community service activity was held at the Indonesian Muslim Disabilities Visibility Association office in Manado city from June to December 2021, employing the Asset Based Community Development method, prioritizing the utilization of existing assets and potential owned by them. As a result, there is an increase in knowledge in prayer practice. They can now implement fiqh thaharah and Janazah prayer practices well and perfectly. They also now can socialize by benefiting others, especially their readiness to be hosts or MCs, readers of the Qur'an, and preachers, beyond the skills they already have had. There were also jointly formulated by the program organizers and participants three follow-up solutions: continuous mental strengthening, a rapid environment learning, and constantly improving the special skills they have learned. Tujuan pengabdian kepada masyarakat dengan pendampingan dan pembinaan dalam konteks sosial keagamaan bagi tunanetra Muslim di kota Manado adalah untuk meningkatkan semangat keagamaan dan kehidupan sosial mereka. Kegiatan pengabdian masyarakat ini dilaksanakan di kantor Ikatan Tunanetra Muslim Indonesia di kota Manado pada bulan Juni hingga Desember 2021 dengan metode Asset Based Community Development yang mengutamakan pemanfaatan aset yang ada dan potensi yang telah dimiliki. Alhasil, terjadi peningkatan pengetahuan dalam amalan shalat. Mereka kini dapat melaksanakan amalan fiqh thaharah dan shalat Janazah dengan baik dan sempurna. Mereka juga kini bisa bersosialisasi dengan memberi manfaat bagi orang lain, terutama kesiapan mereka menjadi pembawa acara atau MC, pembaca Al-Qur'an, dan khatib, di luar keterampilan yang sudah mereka miliki sebelumnya. Ada pula tiga solusi tindak lanjut yang dirumuskan bersama oleh penyelenggara program dan peserta: penguatan mental terus-menerus, pembelajaran lingkungan yang cepat, dan terus-menerus meningkatkan keterampilan khusus yang telah mereka pelajari.

Abstract

The study explores the evolving perceptions of Muslim communities in Manado City regarding religious scholars, particularly in light of the Indonesian Ulema Council's directives on home worship during the COVID-19 pandemic. Using a social jurisprudence philosophy-based approach, the research aims to discern whether the resistance exhibited signifies normalized behavior or poses a threat to religious existence. Spanning from April to November 2020, the study employed field investigations, including observations, interviews with five key informants, and documentation analysis within an interactive model. The findings highlight a sense of hesitation among Manado's clerical bodies, leading to discord and inconsistencies in societal practices, consequently redirecting followers' attention towards mosque imams. However, interpreting this resistance through a social jurisprudence lens suggests positive developments that may not jeopardize the religious foundations of Manado Muslims. Rather, their defiance could be seen as constructive feedback aimed at reinstating the prominence and authority of scholars among Islamic devotees. This shift in focus should be acknowledged as a means to strengthen the relationship between scholars and their followers within the religious landscape

Abstract

Rumah tangga abdi negara tidak bisa terlepas dari commuter marriage. Suami yang berstatus prajurit wajib siap sedia dalam penugasannya dimana pun dan kapan pun. Hal itu juga serentak mengingatkan istri untuk senantiasa berperan sebagai istri shalihah yang qanitat dan hafizhah lil ghaib, Penelitian ini bertujuan untuk mengetahui resepsi shalihah dalam Q.S. An-Nisa/4: 34 di PERSIT Kartika Candra Kirana Cabang LI. Adapun jenis penelitian ini adalah penelitian kualitatif-deskriptif dengan menggunakan metode living Qur’an, dengan teori resepsi Al-Qur’an yang membahas tentang peran pembaca atas respon dan reaksi dalam memahami ayat Al-Qur’an. Berdasarkan hasil analisis disimpulkan bahwa, resepsi organisasi Persatuan Istri Tentara (PERSIT) Kartika Candra Kirana mewujudkan dua ciri shalihah pada sifat dan watak PERSIT KCK diantaranya, suci, setia, bijaksana, dan tanggung jawab. Selanjutnya terdapat tiga bentuk resepsi Al-Qur’an yang terbangun pada PERSIT Kartika Candra Kirana Cabang LI: Pertama, resepsi eksegesis (merespon dan memahami) tentang shalihah dalam Q.S. An-Nisa/4: 34 melalui pembacaan terjemah, ceramah, pengajian, serta media sosial; Kedua, resepsi estetika dengan menerapkan praktik menjaga diri melalui pakaian yang dikenakan itu menutup aurat, sedangkan untuk non muslim pakaiannya rapi dan sopan; Ketiga, resepsi fungsional yang salah satu bentuknya dengan resign dari pekerjaan diluar kota untuk fokus mendidik anak, dll. Serta sikap hafizhah lil ghaib yang diyakini sebagai bentuk perlindungan partisipan demi keselamatan suami dalam penugasan dengan cara membatasi pergaulan (hindari ghibah, dan menjaga dari zina), dll.

Abstract

Pergulatan pemikiran tentang Islam dan kearifan lokal telah memberikan akses keterbukaan di masa kini untuk lebih kritis dalam memahami hukum Islam atas dasar definisi asy-syari’ah, termasuk melalui proses inkulturasi wahyu dengan budaya lokal. Mengenai hal tersebut, ketika asy-syari’ah telah terkodifikasi dalam bentuk Al Qur’an dan Islam telah tersebar ke seluruh penjuru dunia termasuk Indonesia – yang tentunya memiliki perbedaan sosial-budaya dengan masyarakat Arab – maka perlu dilakukan sebuah pembacaan ulang terhadap asy-syari’ah dengan pendekatan inkulturasi tersebut. Proses inkulturasi yang dimaksud di dalam tulisan ini harus dibaca secara bottom-up, dengan cara memberikan pemahaman bahwa ketika asy-syari’ah yang berasal atau lahir dari proses budaya, lalu budaya tersebut berubah maka asy-syari’ah seyogyanya juga berubah sehingga budaya baru tersebut dapat diimplementasikan di dalam masyarakat. Salah satu contoh yang urgen dalam konteks hubungan Islam dan kebudayaan lokal di Indonesia melalui model tersebut adalah tentang kewarisan produktif. Dalam hal ini, perubahan sebagai sifat utama dari budaya, akan selalu menghendaki masyarakatnya untuk selalu mengapresiasi perubahan dan melakukan perubahan, termasuk dalam hal ortodoksi keagamaan, sehingga kritikan ilmiah terhadap ortodoksi agama tidak sekedar menjadi bacaan yang kaku sehingga menegasi maksud Tuhan yang lebih besar. Perubahan yang lebih baik di dalam masyarakat sesungguhnya juga bagian dari wahyu Tuhan yang sering kali tidak terbaca. The Problematic of thought on Islam and local wisdom has granted access in the present era to be more critical in understanding Islamic law based on the definition of al-syari'ah, including through a process of inculturation revelation to the local wisdom. Regarding this, when the al-syari'ah has been codified in the form of the Qur'an and Islam has spread all over the world, including Indonesia - which has a socio-cultural differences with the Arab community - there should be re-reading of the al-syari'ah with the inculturation approach. The process of inculturation in this case is must be read in bottom-up, by providing an understanding that when the al-syari'ah come from or born from the culture process, then that culture changes into al-syari'ah should also change so that the new culture can be implemented in the community. One example is the urgency in the context of relationship between Islam and local wisdom in Indonesia through the model is inheritance productive. In this case, alteration as the main characteristics of the culture will always want community to always appreciate the changes and make changes including in terms of religious orthodoxy so that scientific criticism against religious orthodoxy did not just become so rigid readings negate God's greater purposes. The changes for the better in society actually also the part of God's revelation that is often illegible.

Abstract

Religious teachers have a key role in instilling religious moderation in the younger generation. Through their experiential approach and capacity to teach moderation values, Religious Teachers are expected to be role models of ethics and morality. They also need to open up correct and valid information, making them a source of information that can form a moderate, tolerant and harmonious society. The community service program was conducted in Perkamil Village, Manado, with a focus on Elementary School Religious Teachers. Using a Participatory Action Research (PAR) approach, the program includes mapping of religious issues, teacher training, and development of religious moderation literacy. The mapping results identified incomprehension, inequality, lack of interfaith dialog, identity politics, lack of multicultural education, and irresponsible media as the main problems. Strengthening religious moderation literacy is done through curriculum alignment, teacher training, collaborative learning activities, and mastering multicultural issues. These steps are expected to create functional and sustainable institutions and communities, and accelerate the implementation of religious moderation in elementary schools. Through these efforts, the community is expected to overcome potential religious conflicts and build an inclusive environment. Abstract

Undang-Undang No. 1 Tahun 1974 tentang perkawinan, mengatur batas usia pernikahan baik laki-laki dan perempuan, namun sejak 2019 hal tersebut diperbaharui melalui Undang-undang No. 16 Tahun 2019 yang menyatakan bahwa standar minimal pernikahan bagi laki-laki dan perempuan adalah 19 tahun. Namun sejak terjadinya pandemi Covid-19 angka perkara dispensi nikah di Pengadilan Agama Manado meningkat dari 21 perkara ditahun 2019 menjadi 42 perkara ditahun 2020 dan selama tahun 2021 (per agustus 2021) tercatat ada 36 perkara. Penelitian ini dilakukan untuk mengetahui bagaimana latar belakang terjadinya dispensasi nikah di di Pengadilan Agama Manado pada masa pandemi Covid-19 dan Bagaimana tinjauan yuridis terhadap peningkatan dispensasi nikah di Pengadilan Agama Manado. Jenis penelitian ini adalah penelitian lapangan (field research) dengan menggunakan pendekatan sosiologi hukum. Adapun yang menjadi informan penelitian adalah hakim dan panitera Pengadilan Agama Manado serta pelaku dispensasi nikah atau kuasa hukum dengan menggunakan teknik purposive sampling. sedangkan metode yang digunakan dalam pengumpulan data adalah observasi, wawancara, dan dokumentasi, kemudian dianalisa menggunakan model Miles and Huberman yang dilakukan secara interaktif dan berlangsung secara terus-menerus pada setiap tahapan penelitian hingga tuntas. Hasil penelitian ini menunjukkan bahwa, pertama faktor kehamilan diluar nikah dan faktor ekonomi menjadi latar belakang terjadinya dispensasi nikah di Pengadilan Agama Manado. Kedua, dalam tinjauan yuridis pembaharuan batas usia minimal pernikahan yang diatur dalam Undang-undang No. 16 Tahun 2019 sebagai upaya pemerintah untuk menekan angka pernikahan dini, ternyata tidak cukup untuk menekan angka pernikahan dini atau dispensasi nikah di Pengadilan Agama Manado selama pandemi covid-19.
