Abstract

The existence and increase in the quantity of Foreign Workers (TKA) in Indonesia has given rise to a lot of debate that has spread in society, especially for workers. So that in certain conditions it can actually give rise to various problems, including violations of the residence and work permits of foreign workers, often in their passports it is written that the permission given by the Indonesian government and immigration authorities is for them to work as foreign workers in Indonesia. position and certain period of time, not just as a tourist. The research conducted by the author is a type of normative juridical research. Normative law focuses on legal concepts, principles and legal rules. Normative legal research focuses on positive legal norms such as statutory regulations. Apart from that, in principle this research also comes from secondary legal materials.. The research results show that the influx of foreign workers (TKA) into Indonesia hampers economic growth, reduces employment opportunities, and reduces the wage level of local workers. Law enforcement is carried out by checking, inspecting and providing sanctions for TKA violations. Administrative sanctions in the form of a fine of IDR 6-36 million in accordance with PP No. 34 of 2021. Apart from that, the sanction for illegal foreign workers is in the form of deportation. Preventive and educational efforts are carried out through outreach to companies regarding the rules for employing foreign workers.

Abstract

Underage marriage is a phenomenon that still occurs frequently in various countries, including Indonesia, even though there are regulations that regulate the minimum age limit for marriage. This article aims to analyze the legal implications of maturing children who marry underage, especially in the context of marriage agreements. The Marriage Law has stipulated the age limit for marriage (material requirements), one of which is the provisions regarding the minimum age limit which are regulated in Article 14 paragraph (2) of Law Number 1 of 1974. Maturity status is related to the validity of a legal act. Immature legal subjects are seen as legal subjects who are not yet capable of acting for and for themselves before the law. The research method used is a normative juridical approach with analysis of statutory regulations, legal doctrine and relevant concrete cases. The research results show that children who marry underage have limited legal capacity to make legal and binding marriage agreements. Children's immaturity causes vulnerability in understanding and bearing the legal consequences of the agreements made. In addition, marriage agreements involving minors often do not meet the requirements for the validity of a contract under civil law, which means the agreement can be considered null and void. In the case of making a marriage agreement before a notary, especially before a minor is married, it is necessary to guarantee the recognition of the child's maturity status.

Abstract

This study discusses the role of the prosecutor's code of ethics in supervision and accountability to maintain the integrity of law enforcement in Indonesia, considering that integrity is the main foundation of public trust in the justice system. The purpose of this study is to analyze the extent to which the prosecutor's code of ethics acts as an instrument for controlling professional behavior and the effectiveness of the mechanism for supervision and accountability for ethical violations in the prosecutor's office. This study uses a normative legal research method with a statute approach and a conceptual approach, as well as data collection techniques through literature studies. The results of the study indicate that although the prosecutor's code of ethics has been regulated normatively and becomes a guideline for professional behavior, its implementation still faces challenges, such as weak internal supervision, less strict sanctions, and limited external supervision authority by the Prosecutor's Commission. Various cases of violations of the code of ethics, such as abuse of authority and conflicts of interest, indicate a gap between rules and practices. Therefore, it is necessary to strengthen the supervision system, update the substance of the code of ethics, and increase transparency and accountability to realize law enforcement with integrity and public trust.

Abstract

Customary law communities have a strong connection to natural resources and customary land as their main source of livelihood. This study was conducted to determine the protection of customary law communities on customary land for the public interest, as well as the judge's considerations in Decision No. 120/Pdt.G/2018/PN.Son regarding compensation for customary land. The researcher applied a normative juridical method through a Statute Approach and a Case Approach in analyzing the topic or issue. The results of the study show that protection is provided in the form of preventive and repressive actions by the government. Preventive efforts are carried out by forming Law No. 12 of 2012 and its derivative regulations to prevent disputes and guarantee the rights of customary law communities in land acquisition. Repressive efforts are pursued through the settlement of disputes in court by filing lawsuits in accordance with the provisions of the law. In Decision No. 120/Pdt.G/2018/PN.Son, the judge can use three stages, namely constatation, qualification, and constitution, to reach a good decision based on the principle of justice. Compensation in this decision was awarded as recognition and respect for the Marga Momo Indigenous Community. This writing is expected to demonstrate the importance of balancing development for the public interest and the protection of the rights of indigenous peoples with laws that favor justice.

Abstract

Tanah adalah objek vital yang bernilai tinggi sehingga transaksi jual beli tanah menuntut kepastian hukum agar tidak menciptakan sengketa. Namun, praktik membeli atau menjual tanah secara tunai tanpa melalui PPAT dan tanpa memiliki sertifikat kepemilikan masih banyak terjadi, sehingga menimbulkan berbagai masalah terkait keabsahan dokumen, perlindungan hukum, serta risiko terjadinya sengketa. Latar belakang inilah yang melandasi penelitian dengan judul Perlindungan Hukum bagi Pembeli atas Tanah dalam Perjanjian Jual Beli: Studi Putusan Nomor 1990/K/PDT/2025. Penelitian ini ditulis guna menganalisis kekuatan hukum perjanjian jual beli tanah di bawah tangan dan menilai pertimbangan hakim dalam memberikan perlindungan hukum kepada pembeli. Metode penelitian yakni yuridis normatif dengan pendekatan perundang-undangan. Hasilnya ditemukan dalam Putusan Nomor 1990/K/PDT/2025, perjanjian yang telah dibuat oleh para pihak terkait jual beli tanah adalah sah dan bersifat mengikat. Para Tergugat dinyatakan wanprestasi atas mengurus penerbitan sertifikat pengganti maupun proses peralihan hak atas tanah. Selain itu, Majelis Hakim memerintahkan agar sertifikat pengganti segera diterbitkan, dilakukan pemecahan bidang tanah, dan dilaksanakan proses balik nama. Untuk menjamin kepastian pelaksanaan putusan, hakim memberikan kewenangan kepada pembeli untuk mengurus sendiri seluruh proses tersebut apabila penjual tetap lalai. Pertimbangan hukum ini mencerminkan sikap hakim yang berorientasi pada perlindungan hak pembeli beritikad baik sekaligus sebagai upaya menegakkan prinsip kepastian hukum dan rasa keadilan.
