Abstract

Car designs owned by industrial design owners have exclusive rights to exercise moral rights and economic rights. However, this right has a certain time limit, as long as the product's design is still under the registrant's ownership. This often causes problems related to industrial designs by other parties who are not entitled to the use of similar designs, such as kitcar production practices in Indonesia. The kitcar certification process typically involves several stages that must be passed by the vehicle assembler or manufacturer to ensure that the vehicle meets applicable standards by testing safety and environmental standards. This study aims to find out the legal protection related to industrial design used in the manufacture of kitcars in Indonesia and to find out the regulations regarding kitcar certification in Indonesia. This study uses a normative juridical approach consisting of two sources, namely primary materials and secondary data. The primary material used in this study is laws and regulations. Meanwhile, the secondary materials used are the results of research interviews, expert opinions in books, journals, and articles related to this research. The results of this study prove that kitcar manufacturing activities are not included in violations, as long as the industrial design used is in accordance with applicable provisions and its legality has been regulated in terms of reviews related to legal protection of industrial design and legal certainty regarding kitcar certification. This kitcar activity is not categorized as a violation as long as the industrial design used in its manufacture has expired its protection period and the nature of the design has become public property. So, the industrial design can be used freely. Kitcar needs to follow several stages of testing that have been regulated in legislation. If all stages of testing have been met, the status of the kitcar can be declared legal.

Abstract

Background. Unregistered marriages remain widespread, creating legal issues for both couples and their children. Aims. The objective of this community service program is to provide assistance in the itsbat nikah process at the Religious Court, enabling couples to obtain legal certainty. The implementation methods included socialization, legal counseling, and direct assistance up to the issuance of the court’s decision. Methods. The socialization activities demonstrated an increased awareness among participants regarding the importance of marriage registration. Counseling activities resulted in a deeper understanding of the consequences of marriage. Assistance activities helped participants prepare documents and face the court proceedings. Conclusion. Of the 32 couples who registered, 24 passed the administrative verification to participate in the hearing, and 23 obtained itsbat nikah decrees, while one case was rejected due to age verification issues. Implementation. By obtaining an itsbat nikah decree, couples could proceed to the Office of Religious Affairs to have a marriage certificate issued.

Abstract

The internet has been widely used in Indonesia as a support for communication and information in various electronic media. The rapid development of the times makes technology even more increasing. This gave rise to several e-commerce applications in online sales and purchases  such as Shopee, Tokopedia, Akulaku, Traveloka, and many others, some of these  e-commerce  applications have features that can make it easier for consumers to make buying and selling transactions, namely the Paylater feature. The focus of this research is to find out about the legal protection of personal data to consumers and the efforts made to the parties in an e-commerce transaction  using the PayLater method. This research uses the Normative Juridical method and applies legislative and conceptual approaches. The results of the research obtained found that legal protection for PayLater Credit service users is contained in the regulations of Law No. 8 of 1999 concerning Consumer Protection, POJK Number 77 / POJK.01 / 2016 and Law No. 19 of 2016 concerning Electronic Information and Transactions. And in Law Number 27 of 2022 concerning Personal Data Protection. Meanwhile, PayLater Credit dispute resolution is more effectively implemented with the APS (Alternative Dispute Resolution) method, one of which is by creating a PSD (Online Dispute Resolution) institution.
