Abstract

Background. Health is an integral part of daily life, from birth to death, and is supported by various health workers in specific fields such as doctors, midwives, and pharmacists. Despite the availability of health facilities, cases of patient abandonment by health workers, particularly involving pregnant women, have been reported. Purpose. This research aims to investigate one such case, focusing on the legal protection available for pregnant women patients abandoned by health workers, specifically midwives. The study also explores the legal actions that can be taken against the midwife responsible for abandoning the patient. Method. The research employs a legal analysis method by examining relevant laws and regulations governing health workers and midwifery, focusing on patient rights and professional obligations. It further examines ethical standards and legal consequences in such cases. Results. The findings reveal several potential factors contributing to the abandonment case, including negligence and gaps in the enforcement of professional responsibilities. The results serve as a valuable resource for educating health workers, particularly midwives, about the legal and ethical dimensions of their profession. This study emphasizes the importance of understanding the professional code of ethics, legal sanctions, and patient rights to prevent future occurrences of patient abandonment.   Conclusion. In conclusion, strengthening legal frameworks and ethical standards is critical to ensuring pregnant women receive adequate care and protection.

Abstract

Kemajuan dan evolusi teknologi tidak terlepas dari keberadaan kejahatan, yang salah satunya adalah penipuan dalam perekrutan tenaga kerja melalui media elektronik, khususnya WhatsApp. Penawaran kerja dengan imbalan yang menggiurkan namun persyaratannya terkesan mudah, namun pada saat penerimaan terdapat syarat tambahan seperti pembelian pulsa dengan nominal tertentu dan nomor yang telah ditentukan oleh individu yang mengaku mewakili perusahaan perkebunan kelapa sawit. Pelaku telah melakukan penipuan selama beberapa tahun dan telah merugikan banyak orang. Korban telah melaporkan kejadian tersebut melalui media sosial, namun perusahaan yang bersangkutan membantah melakukan perekrutan melalui WhatsApp, serta memberikan petunjuk kepada korban untuk mengirimkan laporan kronologis ke email perusahaan. Namun, setelah pelaporan dilakukan oleh korban, tidak ada tindak lanjut dari pihak perusahaan sementara korban telah mengalami kerugian baik secara materiil maupun imateriil. Penelitian ini bertujuan untuk mengungkap modus operandi dari tindak pidana penipuan dalam perekrutan kerja yang menggunakan nama perusahaan melalui WhatsApp, serta untuk memahami proses penegakan hukum terhadap tindak pidana tersebut. Metode yang digunakan adalah pendekatan yuridis-empiris, di mana penelitian tersebut mengkaji implementasi ketentuan hukum normatif pada peristiwa hukum spesifik dalam masyarakat. Selain itu, wawancara dengan saksi korban juga menjadi sumber data sekunder. Hasil penelitian menunjukkan bahwa modus operandi pelaku penipuan melalui media elektronik (WhatsApp) dapat dikenai Pasal 378 KUHP dan Undang-Undang Informasi dan Teknologi Elektronik.

Abstract

Pelaksanaan tugas sebagai notaris yang tunduk dan serta terikat dengan aturan perundang-undangan. Kemenkumham menerbitkan Peraturan Presiden Nomor 13 Tahun 2018 tentang Penerapan Prinsip Mengenali Pemilik Manfaat Dari Koorporasi Dalam Rangka Pencegahan Dan Pemberantasan Tindak Pidana Pencucian Uang Dan Tindak Pidana Pendanaan Terorisme. Hadirnya peraturan tersebut, membuat koorporasi harus melakukan transparansi dengan mewajibkan pengungkapan penerapan prinsip mengenali pemilik manfaat perusahaan. Notaris memiliki peran yang sangat penting karena adanya kewajiban pembuatan akta pendirian badan hukum tersebut dalam bentuk akta notariil. Mewajibkan penerapan prinsip pemilik manfaat harus dilakukan, khususnya pada saat permohonan pendirian dari badan hukum. Kewajiban ini tentunya memberikan tugas tambahan secara khusus kepada notaris di luar daripada kewenangan yang telah dimiliki sebagai notaris pada umumnya. Terjadilah kontroversi atas tumpang tindihnya dengan adanya hierarki peraturan perundang-undangan. Tujuan dari penelitian ini adalah mengetahui pelaksanaan serta akibat hukum terhadap notaris yang tidak melaksanakan Peraturan Presiden Nomor 13 Tahun 2018. Dalam penelitian ini menggunakan metode yuridis empiris dengan megumpulkan data dari bahan primer berupa wawancana dengan Majelis Pengawas Daerah (MPD) terhadap Notaris wilayah Kabupaten Cirebon sebagai institusi pengawas kinerja notaris sesuai atau tidak dengan Undang-Undang Jabatan Notaris. Serta bahan sekunder berupa perundang-undangan dan literatur lain yang berkaitan dengan notaris dengan pemilik manfaat perusahaan. Dalam pelaksanaan Peraturan Presiden Nomor 13 Tahun 2018, memunculkan dilema antara kepatuhan terhadap peraturan yang ada guna mencegah serta memberantas tindak pidana pencucian uang dan tindak pidana pendanaan terorisme dengan Undang-Undang Jabatan Notaris yang berlaku dengan tetap menjaga integritas dan kewajiban profesi notaris dalam menjaga kerahasiaan informasi pribadi kliennya.

Abstract

Indonesian culture from time to time has always undergone very rapid changes, this change occurs because of the factors of the people who really want these changes and the entry of elements of globalization into Indonesian culture. One of the cultures that is still developing in the community is the tradition of traditional marriage, such as the traditional wedding event of Brebes Lor. However, along with the development of the times and the influence of globalization, this tradition faces considerable challenges. This study aims to analyze the existence of Brebes Lor wedding customs in the era of globalization from a legal and cultural perspective, focusing on the preservation efforts carried out by the Brebes Regency Culture and Tourism Office and the obstacles faced in preserving Brebes Lor wedding customs. The research method used is a normative juridical approach, a type of qualitative research by examining literature materials (secondary data). The results of the study show that the Culture and Tourism Office of Brebes Regency has made various efforts to preserve the traditional wedding event of Brebes Lor, such as socializing the bridal makeup association in Brebes, namely the Indonesian Bridal Makeup Association (HARPI) Melati Bumiayu and collaborating with them in compiling the tradition of mapag besan. However, there are a number of obstacles in the preservation of this marriage custom, such as the lack of public interest in using Brebes clothing and makeup, as well as the inhibition of socialization to the community due to the large cost and long time. Therefore, the Tourism and Culture Office needs to make maximum use of information technology to introduce this traditional event to the wider public in order to save costs in conducting socialization, such as making videos of Brebes Lor traditional marriage events, then actively sharing them through social media.

Abstract

Background, The notion of domestic violence, frequently rationalized by the general populace, predominantly manifests as physical aggression. However, the inclination to prioritize physical and interpersonal dimensions of violence obscures the recognition of non-physical forms, leading to the conclusion that violence is inherently subjective. Several cases of symbolic violence often appear in society, one of which is about expressing a wife's feelings of sadness and disappointment for accepting her husband's betrayal in a marriage relationship that has been lived for years even though it does not physically hurt, but this violence can occur because of masculine dominance. This dominant position of men contributes to symbolic violence as a result of patriarchal culture. Aim, This research aims to identify the factors contributing to symbolic violence against women within households that persist in a patriarchal culture and to examine law enforcement related to symbolic violence against women in the context of the Law on the Elimination of Domestic Violence. Methods, This research employs a normative juridical approach, focusing on the implementation of laws against symbolic violence towards women as examined through the Law on the Elimination of Domestic Violence. Data gathering methods included in this study include literature analysis, interviews, and observations. Results, Numerous victims of domestic violence remain hesitant or afraid to report the abuse they have endured. This is affected by multiple factors, including the stigma associated with domestic violence, economic reliance on the abuser, and the inadequate response of law enforcement officials. Conclusions, By combining effective prevention and intervention approaches, this effort is believed to not only reduce cases of symbolic violence but also improve family relationships, create a more harmonious society, and support the comprehensive elimination of domestic violence. Implication, The findings of this study indicate that law enforcement on the Law on the Elimination of Domestic Violence in Cirebon necessitates more enhancement and oversight, particularly with symbolic violence against women inside the domestic context.

Abstract

Background, Aviation is one of the significant forms of business deregulation in Indonesia. The existence of aircraft makes it easy for passengers to move between regions quickly and efficiently for various purposes. The commercial air transportation sector is growing rapidly, as seen by the increasing number of airlines providing flight services and the rising public interest in using these services. However, in reality, many consumer rights have not been fully fulfilled by airlines, especially in the case of flight delays. For this reason, strict legal regulations are needed to regulate airlines' responsibilities to protect consumer rights. In its implementation, it turns out that passengers submit many complaints to the airline due to various problems. Aim, Clear and firm legal regulations are needed to regulate airlines' responsibilities to protect passengers' rights. This research focuses on two main issues, namely how the airline's liability to passengers is related to flight schedule delays and how to claim compensation for airline passengers related to flight schedule delays. Methods, This study uses a normative juridical approach by analysing laws and regulations related to legal protection for consumers. The data obtained was analysed qualitatively to understand the issue more deeply. Results, The study results show that the Regulation of the Minister of Transportation Number 89 of 2015 expressly regulates the rights of consumers affected by flight delays and stipulates the obligations of airlines to aggrieved passengers. Conclusions, The legislation was made to ensure that passengers get safety and security in running flights, as well as passengers, are more independent and know the importance of the issuance of the law. Implication, Furthermore, the regulation can be used as a foothold for passengers' legal protection against problems.

Abstract

This study discusses various problems faced by women workers, including employment agreements, shuttle transportation facilities, the right to menstrual leave, and aspects of Occupational Safety and Health (K3). The purpose of this study is to identify how the policies regarding employment that apply in Majalengka Regency are mainly to ensure the fulfillment of the rights of women workers and the obstacles faced by women workers in Majalengka Regency in obtaining Legal Protection. The type of research applied by the researcher is empirical juridical research. According to Abdul Kadir Muhamad, empirical juridical research is carried out by examining secondary data first, which is then followed by collecting primary data through field studies. The results of the analysis of the protection of women workers in Majalengka Regency are in accordance with Law No. 13 of 2003 concerning Manpower has been implemented, but there are still rights that have not been fulfilled. The protection of women workers in Majalengka Regency faces several obstacles, the local government through the DISNAKER (Manpower, Cooperatives, and SMEs Office) Majalengka Regency has not fully implemented regulations on the rights of women workers. Ideally, a number of local regulations. 9 of 2022 concerning Manpower contains provisions regarding the rights of women workers, as stipulated in higher laws and regulations, namely the Manpower Law No. 13 of 2003 concerning Manpower. However, in reality, there are still many female workers who do not know the rights they should get.

Abstract

The certificate of right to use on state land is a legal instrument that gives the holder the right to use state land for a certain period of time in accordance with the provisions of the applicable laws. This study examines the case of State Land intended for pangonan, which is located in Dukupace Block, Geyongan Village, Cirebon Regency, where the villagers use the abandoned Pangonan land, then they control it for various purposes such as agriculture and housing. Even though they have controlled the land for many years, the community does not have its ownership status. This will cause problems in the future if the status of the land is not yet owned by the people who occupy the land. The research method used is empirical juridical, with reference to various previous studies on state land ownership and land distribution justice. The results of the study show that there is a lack of public understanding of procedures and ownership conflicts. To overcome these obstacles, it is necessary to simplify the mechanism regarding rules and increase socialization. This study provides fair and inclusive policy recommendations, as well as concrete steps to improve the process of issuing use rights certificates and recognition of land rights based on long-standing physical tenure.

Abstract

The rejection of the marriage itsbat application directly impacts the legal status of the child born, as the parents' marriage is not legally, religiously, or customarily recognized. This study aims to analyze the legal consequences of the rejection on the child's position and examine the determination of the child's origin as a form of legal protection. Using a normative juridical approach, this study analyzes legal materials related to the status of children born from sirri marriages. The results of the study show that children born from sirri marriages only have a legal relationship with their mother. Moreover, if the itsbat application is rejected, the child will not be recognized as the legitimate child of their biological father. This has consequences on the child's access to administrative, inheritance, and guardianship rights. Remarriage also does not alter the child's position because, according to Islamic law, the sirri marriage is invalid and thus rejected by itsbat. As a result, the child remains an out-of-wedlock child. The determination of origin by the court is an alternative protection that allows the inclusion of the biological father's name in the population document and provides limited space for the child's civil rights. These limitations are also reaffirmed in the Fatwa of the Indonesian Ulema Council, which states that the biological father's obligation is limited to providing living support and a mandatory will. The conclusion of this study emphasizes the importance of determining origin as an instrument for the legal protection of children in the national legal system, especially regarding the rejection of the marriage itsbat application.

Abstract

Car designs owned by industrial design owners have exclusive rights to exercise moral rights and economic rights. However, this right has a certain time limit, as long as the product's design is still under the registrant's ownership. This often causes problems related to industrial designs by other parties who are not entitled to the use of similar designs, such as kitcar production practices in Indonesia. The kitcar certification process typically involves several stages that must be passed by the vehicle assembler or manufacturer to ensure that the vehicle meets applicable standards by testing safety and environmental standards. This study aims to find out the legal protection related to industrial design used in the manufacture of kitcars in Indonesia and to find out the regulations regarding kitcar certification in Indonesia. This study uses a normative juridical approach consisting of two sources, namely primary materials and secondary data. The primary material used in this study is laws and regulations. Meanwhile, the secondary materials used are the results of research interviews, expert opinions in books, journals, and articles related to this research. The results of this study prove that kitcar manufacturing activities are not included in violations, as long as the industrial design used is in accordance with applicable provisions and its legality has been regulated in terms of reviews related to legal protection of industrial design and legal certainty regarding kitcar certification. This kitcar activity is not categorized as a violation as long as the industrial design used in its manufacture has expired its protection period and the nature of the design has become public property. So, the industrial design can be used freely. Kitcar needs to follow several stages of testing that have been regulated in legislation. If all stages of testing have been met, the status of the kitcar can be declared legal.
