Abstract

Ahead of the syncronous Pilkada that to be run in November 2024, there is still a polemic related to the legal guidelines for the acting of regional heads’s levitation whose term of office ends ahead of the 2024 simultaneous elections. The legal basis for the Minister of Home Affairs Regulation Number 4 of 2023 concerning Acting Regional Heads issued by the Minister of Home Affairs is considered to have many irregularities. This paper will reveal the absence of statutory delegation in the issuance of the Permendagri and the use of legal considerations of the Constitutional Court judges in the Constitutional Court Decision Number 15/PUU-XX/2022 as a consideration in the Permendagri. The research method used in this paper is normative juridical through a statutory approach as a source of existing law. The results of this study conclude that the issuance of Permendagri No. 4 of 2023 is unfounded if only viewed through the presence or absence of delegation of the formation of implementing regulations. If viewed more broadly through the theory of discretion, then this is considered valid, in order to fill the legal vacuum. The legal deliberations of the Constitutional Court judges in MK’s Decision Number 15/PUU-XX/2022 also strengthen the legitimacy of the issuance of Permendagri No. 4 of 2023, this is because the content of the legal considerations is considered to be commensurate with the ruling, even though the ruling was rejected.  Unfortunately, the implementing regulation chosen by the government to regulate the inauguration of acting regional heads is in the form of a Minister of Home Affairs Regulation, not a Government Regulation.

Abstract

Review of the trademark determination in court decision Number 75/Pdt.Sus-Hki/Merek/ 2022/Pn Niaga Jkt.Pst rejection of the application for the trademark GENHALILINTAR + Painting by Anofial Asmid because it was registered by PT SOKA CIPTA NIAGA on October 23 2017 with a Notification of Rejection Registration of the Mark "GENHALILINTAR + Painting" Agenda Number D002018027834 dated 31 December 2019 by the Directorate General of Intellectual Property and Decision of the Mark Appeal Commission / Defendant Number 375 / KBM / IPR / 2020 dated 8 September 2020. This turns out to be interesting because in Halilintar Anofial Asmid has registered the GENHALILINTAR + Painting brand in several classes, which of course contradicts the arguments in the Notice of Rejection and Decision of the Mark Appeal Commission. This paper uses normative legal research methods. With the conclusion Based on the legal annotation of the Decision that there are problems that occur in granting well-known trademark rights to certain people or civil legal entities, especially if the trademark holder is not the initial initiator of its popularity. In terms of administrative certainty of the GENHALILINTAR + Painting mark, state administrative legal action in trademark disputes can be filed against the decision to delete a registered mark at the initiative of the Minister. If there has not been an administrative Judge's Decision, the first principle is that the registered mark has a stronger position compared to the popular indication of a mark

Abstract

Perkembangan dunia bisnis yang pesat di Indonesia salah satunya di bidang kecantikan. Kondisi ini ditandai dengan ramainya persaingan usaha di bidang kecantikan. Meningkatnya kebutuhan lahiriah manusia yaitu selalu ingin tampil sempurna dalam berbagai keadaan. Hal tersebut menjadi pendorong bisnis kecantikan untuk terus berkembang pesat karena permintaan kecantikan terus bertambah. Tujuan dari literature review ini adalah untuk mendeskripsikan strategi pengembangan bisnis di dunia kecantikan. Metode yang digunakan dalam literatur review ini menggunakan strategi secara komprehensif, seperti dengan adanya pelatihan-pelatihan. Dengan bisnis kecantikan ini, bisnis salaon, strategi bisnis, tata rias kecantikan, peluang bisnis, rias pengantin. melalui strategi pengembangan bisnis yang terdiri atas Sumber Daya Manusia (SDM), pemasaran, melalui pemberian pengetahuan dari mulut ke mulut sangat efektif karena masyarakat sangat berminat untuk meningkatkan kepuasan terhadap pelangan, seperti yang dilakkan Rintisan beautypreneur berbasis teknologi dalam industri salon Kelurahan Pasir Gunung Selatan Kecamatan Cimanggis Depok merupakan program pengembangan kewirausahaan yang bertujuan untuk mengurangi pengangguran dan meningkatkan kualitas SDM di bidang kecantikan.

Abstract

Domestic Workers (DWs) are a group that is vulnerable to rights violations and exploitation. ILO Convention No. 189 regulates protection standards for DWs, but its implementation is limited because not all countries have adopted these provisions. In Indonesia, the absence of clear regulations has led to a legal vacuum and weak protection of the rights of DWs. In contrast, the Philippines has specific regulations through the Kasambahay Law, which provides more comprehensive protection. The purpose of this study is to review the forms of legal protection for DWs in Indonesia and the Philippines and to examine the impact of the legal vacuum in Indonesia. The method used is normative juridical with a conceptual and comparative approach. The results of this study show that Indonesia still lags far behind the Philippines in providing protection for DWs. This condition reflects the need for concrete efforts by the Indonesian government to reform the existing system by adopting the best practices implemented in the Philippines to strengthen the national legal framework, reduce violations, and improve the welfare of DWs.
