Abstract

The role of waqf is very important in participating in building and improving the economy, especially in building community welfare. From the Islamic perspective, productive waqf is the concept of managing waqf assets to obtain results so that they can provide benefits to the community on an ongoing basis. Thus, several questions arise related to this discussion, first, what are the legal and theological foundations of productive waqf? Second, what are the benefits and implementation of productive waqf for the community, and third, what are the challenges and solutions in implementing productive waqf for the community? This research method uses the literature method with data obtained from reference books and journals related to related discussions. The conclusion in this article is the result of a discussion of matters related to the title of the article.

Abstract

The crisis of values within the family has become one of the primary challenges in fulfilling children's educational rights, particularly in shaping the character of early childhood in the midst of modernization, globalization, and technological advancement. This article aims to analyze the impact of the family values crisis on children's right to education and to examine the solutions offered by Islamic legal principles in addressing this phenomenon. This study employs a library research method, drawing on various sources such as books and relevant journal articles. The findings reveal that the family values crisis significantly affects the fulfillment of children's educational rights, especially in terms of moral and spiritual development. Islamic legal principles (fiqh al-munakahat) provide comprehensive guidance for building a strong family structure through the concepts of parental responsibility, moral education, and value-based upbringing grounded in Qur’anic teachings. This article recommends strengthening the role of the family as the primary center of education, underpinned by robust Islamic legal principles, as a solution to the challenges posed by the modern era.

Abstract

Sighat taklik is a pledge declared by a husband after the marriage contract, aimed at protecting the rights of the wife and fostering a harmonious family grounded in sakinah, mawaddah, and rahmah. However, in practice, public understanding of the content and meaning of sighat taklik remains limited, leading to its ineffective implementation. This study aims to explore the public perception of sighat taklik in Tonjong District and identify the factors that influence individuals’ interest in reading it. The research employs a descriptive qualitative approach, using interviews, observations, and documentation as data collection techniques. Data were analyzed through the processes of reduction, presentation, and verification, and the validity of the findings was ensured through triangulation and in-depth observation. The results show that differing interpretations of sighat taklik affect people's interest in reading it. The use of formal language and Arabic terms written in Latin script poses a significant barrier to understanding. As a result, many couples are unaware of the legal consequences embedded in the pledge. Therefore, more effective socialization efforts are needed to enhance public understanding and ensure the proper application of sighat taklik in marriage. Contribution: This study contributes to revealing the obstacles to public understanding of sighat taklik and emphasizes the importance of more effective socialization to support the implementation of wives' rights in marriage. [Sighat taklik merupakan ikrar yang diucapkan oleh suami setelah akad nikah sebagai bentuk perlindungan terhadap hak-hak istri, serta sebagai upaya untuk mewujudkan rumah tangga yang sakinah, mawaddah, dan rahmah. Namun, dalam praktiknya, pemahaman masyarakat terhadap isi dan makna sighat taklik masih rendah, sehingga pelaksanaannya kurang efektif. Penelitian ini bertujuan untuk mengetahui pandangan masyarakat Kecamatan Tonjong terhadap sighat taklik serta faktor-faktor yang memengaruhi minat dalam membacanya. Pendekatan yang digunakan adalah kualitatif deskriptif, dengan teknik pengumpulan data berupa wawancara, observasi, dan dokumentasi. Analisis data dilakukan melalui tahapan reduksi, penyajian, dan verifikasi data, serta diuji keabsahannya melalui triangulasi dan observasi mendalam. Hasil penelitian menunjukkan bahwa perbedaan pemahaman terhadap sighat taklik turut memengaruhi minat membacanya. Bahasa yang formal dan adanya istilah Arab dalam aksara latin menjadi kendala utama. Hal ini menyebabkan banyak pasangan tidak memahami konsekuensi hukum dari isi ikrar tersebut. Oleh karena itu, diperlukan sosialisasi yang lebih efektif agar sighat taklik dapat dipahami dan dijalankan sebagaimana mestinya. Abstract

This study aims to analyze the dynamics of disorderly conduct by legal counsel during court proceedings and examine the ethical and professional responses of judges to such non-procedural behavior. Disruptions caused by legal counsel in the courtroom not only hinder the judicial process but also pose significant challenges for judges in maintaining the dignity and order of the proceedings. Using a qualitative approach through case studies within the religious court system, this research explores various forms of misconduct, judicial responses, and the extent to which the principles outlined in the Code of Ethics and Judicial Conduct (KEPPH) are practically implemented. Furthermore, a theoretical analysis of judicial professionalism and ethics is conducted to assess the alignment between normative ideals and actual courtroom practices. The findings indicate that misconduct by legal counsel manifests in various forms, ranging from breaches of decorum to non-procedural interruptions. Judicial responses vary depending on the severity of the misconduct and the individual character of each judge. This study concludes that the synergy between professionalism and judicial ethics is fundamental to maintaining the credibility of the judicial system. Therefore, the development of guidelines for handling non-procedural behavior, along with the enhancement of ethical and character-based training for legal practitioners, is strongly recommended.

Abstract

This study aims to analyze the implementation of the principle of equal rights for persons with disabilities in the litigation process at the Purbalingga Religious Court, as well as to formulate recommendations and concrete solutions to strengthen inclusive legal services. The research uses a qualitative approach with data collection techniques including interviews, observation, and documentation. The results show that the Purbalingga Religious Court has provided special services for persons with disabilities, reflecting the fulfillment of equal rights in legal proceedings. Recommendations include providing adequate physical access, enhancing the capacity of human resources to be more responsive to the needs of persons with disabilities, and drafting specific Standard Operating Procedures (SOP) for disability-friendly legal services. Concrete solutions that can be implemented include support services such as transportation for persons with disabilities, training court officers on inclusive services, and providing accessible infrastructure and facilities. Therefore, the implementation of the principle of equal rights in the judiciary can be realized in a tangible and comprehensive manner for all members of society, including persons with disabilities
