Abstract

The smooth running of business in activities in the workplace occurs when there is a harmonious relationship between employers and workers based on working relationships in an industrial environment. Workers should feel well-being as part of the membership of a business enterprise. This study aims to determine the correlation between worker welfare and industrial relations. Observations were made in a company with a workforce of more than 1000 people in East Java Province. The number of samples taken was 100 people with purposive sampling technique. The collected data is then processed through the SPSS program with statistical correlation techniques. The results obtained are that there is a significant correlation of worker welfare and industrial relations. The form of correlation is positive or unidirectional and quite strong. The better and the welfare felt by the workers, the better and harmonious industrial relations will be created on both sides.

Abstract

This research examines the criminal liability of perpetrators granting lobster seed export permits, with a focus on the corruption case involving the former Minister of Maritime Affairs and Fisheries, Edhy Prabowo. The aim of the research is to analyze forms of abuse of authority and criminal liability that can be imposed on perpetrators. The research method used is normative juridical with a statutory and case approach. The results of the research show that Edhy Prabowo's actions were proven to violate Article 12 letter a of the Corruption Eradication Law jo. Article 55 paragraph (1) 1st jo. Article 65 paragraph (1) of the Criminal Code. The abuse of authority took the form of issuing permits to export lobster seeds unlawfully for personal and certain group interests. The criminal liability imposed includes imprisonment for 5 years, a fine of IDR 400 million subsidiary to 6 months in prison, revocation of political rights for 3 years after serving the principal sentence, and payment of compensation of IDR 9.6 billion and $77,000. There are aggravating reasons because corruption was carried out while serving as a public official and during the Covid-19 pandemic. This case shows the importance of strengthening the supervisory system in granting export permits as well as strict law enforcement to provide a deterrent effect. This research recommends increasing understanding of regulations for state officials and implementing appropriate punishments for perpetrators of corruption to ensure the sustainability of domestic fisheries and the Indonesian fisheries ecosystem.

Abstract

Penelitian ini bertujuan untuk mengetahui pengalihan status pegawai komisi pemberantasan korupsi menjadi aparatur sipil negara ditinjau melalui undang-undang no 39 tahun 1999 tentang hak asasi manusia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan Undang- Undang. Sumber data penelitian ini adalah: (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. (2) Undang-Undang Nomor 19 Tahun 2019 Tentang Perubahan KeduaAtas Undang-Undang Nomor 30 Tahun 2002 Tentang Komisi Pemberantasan Korupsi. (3) Undang-Undang nomor 39 Tahun 1999 Tentang Hak Asasi Manusia. (4) Undang-Undang Nomor 20 Tahun 2023 Tentang Aparatur Sipil Negara. (5) dan sumber hukum lainnya yang relevan. Metode pengumpulan bahan hukum dilakukan secara studi kepustakaan dengan mengkaji dan menelusuri sumber kepustakaan terkait. Metode analisis bahan hukum dilakukan dengan memadukan bahan hasil penelitian berdasarkan konsep hukum, norma hukum, serta doktrin-doktrin yang berkaitan dengan pokok permasalahan. Kasus dialihkannya status dari Pegawai Komisi Pemberantasan Korupsi (KPK) menjadi pegawai Aparatur Sipil Negara (ASN) dengan asesmen Tes Wawasan Kebangsaan (TWK) yang didasari dari Peraturan KPK Nomor 1 Tahun 2021 (Perkom 1 Tahun 2021) kemudian lahir Surat Keputusan(SK) Nomor 652 Tahun 2021 tentang Hasil Asesmen TWK Pegawai KPK yang Tidak Memenuhi Syarat (TMS) menjadi perhatian pada saat pelaksanaannya dan adanya indikasi terjadi Pelanggaran Hak Asasi Manusia (HAM) sehingga hal tersebut menyebabkan Komisi Nasional (Komnas) HAM ikut andil dalam permasalahan tersebut dengan memberikan rekomendasi

Abstract

Given the large potential of fish resources available in the country's waters, there is interest and desire from various parties to develop and participate in ways that are not in accordance with the code of ethics. The practice of fishing without accountability for the interests of certain individuals or groups can be contrary to government regulations, especially those set by the Indonesian Government. This study aims to determine the categories of actions that are included in the crime of Illegal Fishing and law enforcement against illegal fishing as reviewed from the perspective of criminal law. The research method uses a normative legal method, which applies normative case mapping involving the results of legal actions, as well as an analysis of government regulations that apply a qualitative approach. The results of the study revealed that law enforcement against illegal fishing practices in the Exclusive Economic Zone (EEZ) will be carried out in accordance with the principles of international law as stipulated in Article 73(1) of the 1982 United Nations Convention on the Law of the Sea (UNCLOS) which was later ratified by Law of the Republic of Indonesia Number 17 of 1985 concerning Ratification of the United Nations Agreement on the Law of the Sea United Nations Convention On The Law Of The Sea (UNCLOS). This article emphasizes the authority of the coastal state to investigate, arrest, and prosecute foreign vessels that commit violations in the EEZ.
