Abstract

Integrity and trust are fundamental in the legal profession, yet diploma forgery threatens these values, leading to ethical violations and diminished public trust. This study examines the legal implications of diploma forgery in Case No. 20/Pid.B/2024/PN Tmg, where an individual used a fraudulent diploma to practice law. Using a normative legal approach, the study analyzes court decisions, legal doctrines, and statutory regulations, including Article 263 of the Indonesian Penal Code and Article 69 of Law No. 20 of 2003. Findings reveal weaknesses in verification systems, allowing unqualified individuals to enter the legal profession. To prevent such fraud, the study proposes blockchain-based diploma verification, offering tamper-proof credentialing and real-time authentication. Stricter regulations, enhanced verification, and ethical awareness campaigns are crucial to safeguarding legal integrity. Adopting blockchain verification can restore public trust, ensure professional accountability, and uphold the credibility of legal institutions.

Abstract

This study examines the disparity between the theoretical framework and practical implementation of arbitration in Tulungagung Regency. Employing an empirical legal approach, the research analyzes data collected from interviews with 12 lawyers and 12 individuals seeking justice. While arbitration offers several advantages, including time efficiency, lower costs, confidentiality, and procedural flexibility, its implementation in Tulungagung Regency encounters significant challenges. The findings indicate that arbitration remains largely unfamiliar to the public, primarily due to limited outreach efforts, the centralized location of arbitration institutions in major cities, and the high fees associated with arbitrators. Furthermore, ambiguities in the enforcement of arbitration decisions and inconsistencies between arbitration rulings and the jurisdiction of certain courts present additional obstacles. These results highlight the necessity for a comprehensive strategy to enhance accessibility and public awareness of arbitration as an effective alternative dispute resolution mechanism.

Abstract

Penelitian ini bertujuan untuk menyoroti perlunya reformasi hukum yang berkelanjutan guna menyempurnakan kerangka regulasi, memperkuat perlindungan terhadap pengetahuan tradisional, dan mendorong inovasi serta pertumbuhan ekonomi nasional melalui sistem HKI yang lebih efektif dan responsif terhadap perkembangan global. Metode ini merupakan penelitian deskriptif yang berfokus pada prinsip dan kerangka hukum melalui studi kepustakaan, dengan menelaah berbagai sumber hukum seperti peraturan, literatur, dan putusan pengadilan. Analisis dilakukan menggunakan pendekatan deskriptif untuk menggambarkan hukum yang berlaku, evaluatif untuk menilai efektivitasnya, argumentatif untuk menyusun logika hukum yang kuat, serta preskriptif untuk memberikan rekomendasi perbaikan atau pembentukan norma hukum baru. Hasil penelitian menunjukkan  Hukum Kekayaan Intelektual (HKI) Indonesia telah berkembang untuk memberikan perlindungan yang kuat terhadap paten, merek dagang, dan hak cipta melalui undang-undang yang selaras dengan perjanjian internasional seperti TRIPS. Perlindungan paten diatur oleh Undang-Undang No. 13 Tahun 2016, dengan proses yang mencakup kebaruan, langkah insentif, dan penerapan industri, serta pemeriksaan substantif dan persyaratan kerja lokal. Merek dagang dilindungi melalui Undang-Undang No. 20 Tahun 2016 dan memainkan peran penting dalam ekonomi, meskipun masih menghadapi tantangan birokrasi dan harmonisasi. Sementara itu, hak cipta diatur oleh Undang-Undang No. 28 Tahun 2014, yang mencerminkan pendekatan baru dalam penegakan hukum berbasis pengaduan dan penting bagi pertumbuhan industri kreatif. Namun, tantangan besar masih ada, terutama dalam hal penegakan hukum, efisiensi birokrasi, dan perlindungan terhadap pengetahuan tradisional. Oleh karena itu, diperlukan reformasi berkelanjutan untuk memperkuat implementasi hukum dan mendukung ekosistem inovasi nasional.
