Abstract

This study discusses the legal legitimacy of the implementation of qurbani on behalf of institutions in the perspective of classical and contemporary fiqh and its relevance in the modern socio-religious context. The background of the research departs from the increasing practice of qurbani carried out by government, educational, and corporate institutions as a religious expression as well as a form of social concern. However, this practice raises juridical-theological issues related to the legitimacy of the institution as a perpetrator of qurbah worship which in shari’i requires the intention and ownership of the mukallaf individual. This study uses a qualitative approach with a literature study design through normative-theological and juridical-comparative analysis of primary sources in the form of verses, hadiths, and classical fiqh texts, and secondary sources in the form of contemporary literature and fatwas. The results of the study show that classical fiqh provides limited legitimacy for imams or leaders to perform qurbani on behalf of the ummah using public funds, while the contemporary view emphasizes that institutions are not the subject of mukallaf so they cannot become qurbani perpetrators independently. Thus, qurbani on behalf of the institution is only valid if the institution acts as a representative who distributes individual qurbani or mukallaf groups, while the use of institutional funds without determining the name of the sacrificer is classified as collective alms, not sharia qurban.

Abstract

Classical Islamic education is an important foundation that laid the scientific and civilizational groundwork in the Islamic world. However, its relevance is often questioned in the face of modern educational challenges that tend to be secular and instrumentalistic. This article aims to explore the fundamental concepts, highlight the thoughts of major figures, and analyze the relevance of the intellectual heritage of classical Islamic education in the contemporary context. This research uses a library research method with a descriptive-analytical qualitative approach. Data sources are derived from the primary works of classical Muslim thinkers and relevant secondary literature. The results show that: (1) The concept of classical Islamic education is integral, unifying cognitive, affective, and spiritual aspects with an emphasis on adab (ethics), hikmah (wisdom), and tazkiyah al-nafs (purification of the soul). (2) Figures such as al-Ghazali, Ibn Sina, and Ibn Khaldun made monumental contributions by emphasizing moral education, balanced rational development, and the role of education in building civilization. (3) The relevance of this classical thought lies in its ability to offer a holistic educational paradigm that integrates worldly and otherworldly knowledge, prioritizes character formation, and encourages lifelong learning. In conclusion, Muslim Educational Classics provide an authentic and highly relevant philosophical and methodological framework for revitalizing contemporary Islamic education.   Keywords: Classical Islamic Education, Educational Thought, Al-Ghazali, Ibn Khaldun, Educational Relevance

Abstract

This study analyzes the combination of prayer (jama’ sholat) for carnival participants and workers in the framework of classical and contemporary fiqh. The purpose of the study was to evaluate whether carnival activities meet the criteria of masyaqqah syadidah (severe difficulty) that justify the application of rukhshah (legal concessions) in the perspective of the four main schools (Hanafi, Maliki, Shafi’i, and Hanbali) as well as the views of contemporary scholars. This research offers novelty by examining the incorporation of prayer in the context of carnival, which is a contemporary social phenomenon that has not been widely discussed in fiqh literature. Previously, most fiqh studies on rukhshah focused more on travel or emergency conditions, while this study explored the application of rukhshah in the context of recreational and professional activities, such as carnivals.  Using qualitative research methods, this study analyzed classical fiqh texts, scientific articles, and related academic literature. The main findings show that carnival, as a voluntary recreational activity, does not meet the criteria of udzur syar’i to incorporate prayer. The majority of scholars prohibit the combination of prayers without a valid reason such as travel or emergency conditions. However, exceptions may apply to carnival workers who are professionally bound and risk economic harm if they leave duty, provided that this practice does not become the norm. In conclusion, although rukhshah is acceptable in limited cases, carnival activities do not justify the incorporation of prayers in general. This study highlights the need for good time management to fulfill prayer obligations without sacrificing work or social activities.
