Abstract

Penulisan ini bertujuan untuk mengetahui hukum dan demokrasi Indonesia masa depan, dengan menggunakan Metode penelitian normatif yakni mempelajari hukum dan demokrasi dalam hal mengkaji hukum yang sudah ada dan yang dikehendaki. Pendekatan yang digunakan dengan pendekatan konseptual dan pendekatan sejarah. Hasil penelitian yang didapat yaitu pentingnya untuk menciptakan mekanisme hukum, transparansi, dan akuntabilitas yang memastikan kebijakan dan keputusan pemerintah, serta pengaruh asing benar-benar sejalan dengan kepentingan dan kesejahteraan rakyat Indonesia. Inisiatif ini dapat membantu membangun fondasi yang kokoh untuk masa depan negara yang inklusif, berkeadilan, dan demokrasi. , namun tantangan-tantangan konkret harus diatasi untuk mewujudkan potensi tersebut, selain itu dalam berdemokrasi perlu memperhatikan perbedaan budaya sebagai salah satu faktor yang dapat mempengaruhi implementasi demokrasi. Penghargaan terhadap keragaman budaya dapat membantu mencegah konflik dan mendukung harmoni dalam masyarakat.

Abstract

Professional village governance demands a comprehensive understanding from village officials of the regulations that govern their duties and functions. However, the reality on the ground shows a significant knowledge gap. This community service program aims to enhance the legal literacy and capacity of the officials of Tanjung Mudo Village, Jangkat Timur District, through advocacy on personnel regulations. The program was conducted on March 3-4, 2025, using a participatory method that combined interactive lectures, case studies, and Focus Group Discussions (FGDs). To measure the program's impact, pre-test and post-test instruments were utilized. The initial assessment results showed an average participant score of only 48 out of 100, indicating a low level of understanding regarding their rights, obligations, and personnel procedures. Following the advocacy program, there was a very significant increase in understanding, with the average post-test score jumping to 85 out of 100. This improvement proves that the applied advocacy method was effective in bridging the knowledge gap, thereby empowering village officials to work more professionally, accountably, and in accordance with the prevailing legal framework.

Abstract

Corporate sentencing in corruption crimes in Indonesia continues to encounter both normative and implementation barriers, particularly in imposing criminal liability on state-owned enterprises such as PT Pertamina (Persero). This study aims to examine the normative weaknesses of Article 2 of the Anti-Corruption Law and assess the scope of corporate criminal liability in the context of crude oil and refinery product governance. The research employs a normative juridical method through a statutory approach, conceptual approach, and case approach to interpret relevant legal norms without relying on empirical data. The findings indicate that although corporations have been formally recognized as subjects of criminal law, the legal framework governing corporate mens rea and the standards for proving organizational fault remain insufficiently defined. The absence of clear obligations regarding internal control systems and compliance programs within state-owned enterprises further increases the risk of governance irregularities. This study proposes a normative reconstruction through strengthening the concept of corporate mens rea, establishing binding compliance standards, and clarifying corporate sentencing mechanisms within the Anti-Corruption Law. These reforms are essential for enhancing the effectiveness of corruption eradication and safeguarding state financial interests.
