Abstract

The purpose of writing this scientific article is to identify and analyze management supervision in the forestry sector in general in the context of forest protection in industrial plantation forests, because the sustainable implementation of industrial plantation forests in principle requires government involvement in community activities through legal instruments. in the form of permits. Sometimes government policies regarding participation in community activities do not end in just one stage, but rather go through several policies. As a research method, a normative research method was used, the results of which are as follows: Because this is an industrial plantation forest, the special basic law, namely. H. Forestry Law no. 41 of 1999 and newer laws. Regional Government Law no. 23 of 2014. Although the Environmental Protection and Management Law no. 32 of 2009 has different content, because it relates to environmental permits in general. Industrial forest plantation permits, known as IUPHHK-HTI, are issued by authorized officials from the Minister of Environment and Forestry, taking into account recommendations from the governor where the permit is issued. In this case, the authorization procedure actually requires preventive checks, because preventive checks are to avoid possible errors with the ultimate goal of ensuring forest sustainability.

Abstract

This study aims to analyse and criticise the application of sustainable development principles in forest spatial planning. The research method used is normative juridical research, and the approach used is the context and statutory approaches. The study results show that law in the primary sector must refer to sustainable development and people's welfare. Forest destruction cannot be considered a consequence of activities in this sector; it also reflects the failure of spatial planning in an area. The embodiment of spatial planning that can realise environmental preservation must lead to how the law exists in the community. The community around the forest area, as the leading actor, plays a crucial role in controlling and protecting the forest, and their involvement is vital for successful environmental preservation. An extraordinary, measurable, planned, and directed spatial arrangement is urgently and significantly needed. This is done so that the living environment is maintained and planned. Good planning is expected to lead to good spatial use, but this requires consistent management so that environmental sustainability remains aligned with spatial planning scenarios.Penelitian ini bertujuan untuk menganalisis dan mengkritisi tata ruang dalam pinjam pakai kawasan hutan dalam hubungannya dengan prinsip-prinsip pembangunan berkelanjutan. Metode penelitian yang digunakan ialah penelitian yuridis normatif dan pendekatan yang digunakan adalah pendekatan konseptual, dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa hukum di sektor kehutanan harus mengacu kepada pembangunan berkelanjutan dan kesejahteraan rakyat. Kerusakan hutan tidak dapat dianggap sebagai konsekuensi dari kegiatan di sektor kehutanan, kerusakan tersebut juga mencerminkan gagalnya penataan ruang di suatu daerah. Perwujudan tata ruang yang dapat mewujudkan pelestarian lingkungan hidup harus mengarah kepada bagaimana hukum yang ada di masyarakat, karena masyarakat sekitar Kawasan hutan dapat menjadi aktor utama pengendali dan penjaga hutan itu sendiri. Atas dasar hal tersebut dibutuhkan penataan ruang yang terukur, terencana dan terarah yang bersifat extraordinary, ini dilakukan agar lingkungan hidup tetap terjaga dan terencana. Perencanaan yang baik diharapkan dapat mengarah pada pemanfaatan ruang yang baik, namun hal ini membutuhkan tata kelola yang konsisten agar kelestarian lingkungan hidup tetap sejalan dengan skenario penataan ruang.

Abstract

Traditional rituals play a significant role in the lives of indigenous communities, not only as ceremonial events but also as manifestations of unwritten legal norms embedded within these communities. From the perspective of legal philosophy, traditional rituals reflect a close connection between law, morality, and social values. This research employs a normative legal method with a philosophical approach. The findings reveal that customary law functions as an unwritten social regulatory mechanism, where adherence to collective norms is maintained through respect for ancestral traditions, nature, and social order. This article explores the philosophical meaning and social function of various traditional rituals, including efforts to preserve traditions, strengthen cultural identity, and maintain the balance between humans, society, and nature. The study also highlights examples of traditional rituals in the Jambi Province, such as Kenduri Sko and Bantai Adat, which illustrate how customary law is implemented in the daily lives of indigenous communities, while also facing the challenges of modernization. Traditional rituals are an integral part of the legal mechanisms in indigenous societies, serving not only as a means of regulating behavior but also as a medium for restoring social harmony and community spirituality.

Abstract

Penulisan ini bertujuan untuk mengetahui hukum dan demokrasi Indonesia masa depan, dengan menggunakan Metode penelitian normatif yakni mempelajari hukum dan demokrasi dalam hal mengkaji hukum yang sudah ada dan yang dikehendaki. Pendekatan yang digunakan dengan pendekatan konseptual dan pendekatan sejarah. Hasil penelitian yang didapat yaitu pentingnya untuk menciptakan mekanisme hukum, transparansi, dan akuntabilitas yang memastikan kebijakan dan keputusan pemerintah, serta pengaruh asing benar-benar sejalan dengan kepentingan dan kesejahteraan rakyat Indonesia. Inisiatif ini dapat membantu membangun fondasi yang kokoh untuk masa depan negara yang inklusif, berkeadilan, dan demokrasi. , namun tantangan-tantangan konkret harus diatasi untuk mewujudkan potensi tersebut, selain itu dalam berdemokrasi perlu memperhatikan perbedaan budaya sebagai salah satu faktor yang dapat mempengaruhi implementasi demokrasi. Penghargaan terhadap keragaman budaya dapat membantu mencegah konflik dan mendukung harmoni dalam masyarakat.

Abstract

Forestry management in Indonesia has an important role in supporting the balance of ecosystems and community welfare. In recent decades, the issue of forest degradation and deforestation has become a serious concern, both at the national and international levels. The concept of the Green Constitution comes as an approach that emphasizes environmental protection within a strong legal framework. This research aims to ensure that natural resource management policies, including forestry, are carried out with the principles of sustainability and environmental responsibility. The research method used is a normative legal research method with a conceptual approach, the results of this study found that the green constitution can be applied in forestry management in Indonesia, as well as the challenges and opportunities faced in its implementation. This study examines various relevant legal and policy aspects, including the protection of indigenous peoples' rights, public participation mechanisms, and the responsibilities of the state and other stakeholders in preserving forests. Thus, it is hoped that forestry management in Indonesia can be more sustainable and fair, in line with the principles of the Green Constitution.

Abstract

Lingkungan hidup yang sehat merupakan hak konstitusional yang diakui dalam UUD 1945,tetapi implementasinya masih menghadapi berbagai tantangan. Mahkamah Konstitusi memilikiperan strategis dalam menegakkan prinsip Konstitusi Hijau melalui judicial review terhadapundang-undang lingkungan. Penelitian ini bertujuan untuk menganalisis peran MK dalammemperkuat perlindungan lingkungan, kontribusi putusannya terhadap kebijakan lingkungan,serta tantangan yang dihadapi dalam implementasinya. Penelitian ini menggunakan metodeyuridis normatif dengan pendekatan konseptual terhadap putusan MK terkait perlindunganlingkungan. Hasil penelitian menunjukkan bahwa putusan MK telah memberikan dasar hukumyang kuat bagi perlindungan lingkungan dan kebijakan pembangunan berkelanjutan, tetapiimplementasinya masih menghadapi hambatan regulasi, kelembagaan, serta dominasikepentingan ekonomi dan politik. Oleh karena itu, diperlukan sinergi antara pemerintah, aparatpenegak hukum, akademisi, dan masyarakat sipil untuk memastikan bahwa prinsip KonstitusiHijau benar-benar diwujudkan dalam kebijakan lingkungan yang efektif. Penguatan regulasi, peningkatan pengawasan, serta partisipasi aktif masyarakat menjadi langkah krusial dalammenjamin keberlanjutan lingkungan bagi generasi mendatang.

Abstract

This study aims to analyze the standard of proof and the effectiveness of evidence in state administrative disputes based on violations of the General Principles of Good Governance (Asas-Asas Umum Pemerintahan yang Baik/AAUPB). The main focus is to answer how violations of abstract principles can be concretely proven in the proceedings of the State Administrative Court (PTUN), an area fraught with practical challenges for justice seekers. The research method used is normative juridical with statutory, case, and conceptual approaches. Primary and secondary legal materials were analyzed qualitatively to identify evidentiary practices in jurisprudence. The results show that the standard of proof for AAUPB violations is flexible (vrij bewijs), depending on the judge's conviction supported by at least two valid pieces of evidence. Effective proof cannot rely on a single type of evidence but on a synergistic combination of written documents to trace the process, expert testimony to translate abstract norms, and witness testimony to reveal procedural facts. The impact of this research is the provision of a strategic framework for legal practitioners in formulating lawsuits and offering a basis for the development of judicial guidelines to enhance decisional consistency.

Abstract

Professional village governance demands a comprehensive understanding from village officials of the regulations that govern their duties and functions. However, the reality on the ground shows a significant knowledge gap. This community service program aims to enhance the legal literacy and capacity of the officials of Tanjung Mudo Village, Jangkat Timur District, through advocacy on personnel regulations. The program was conducted on March 3-4, 2025, using a participatory method that combined interactive lectures, case studies, and Focus Group Discussions (FGDs). To measure the program's impact, pre-test and post-test instruments were utilized. The initial assessment results showed an average participant score of only 48 out of 100, indicating a low level of understanding regarding their rights, obligations, and personnel procedures. Following the advocacy program, there was a very significant increase in understanding, with the average post-test score jumping to 85 out of 100. This improvement proves that the applied advocacy method was effective in bridging the knowledge gap, thereby empowering village officials to work more professionally, accountably, and in accordance with the prevailing legal framework.
