Abstract

Traditional rituals play a significant role in the lives of indigenous communities, not only as ceremonial events but also as manifestations of unwritten legal norms embedded within these communities. From the perspective of legal philosophy, traditional rituals reflect a close connection between law, morality, and social values. This research employs a normative legal method with a philosophical approach. The findings reveal that customary law functions as an unwritten social regulatory mechanism, where adherence to collective norms is maintained through respect for ancestral traditions, nature, and social order. This article explores the philosophical meaning and social function of various traditional rituals, including efforts to preserve traditions, strengthen cultural identity, and maintain the balance between humans, society, and nature. The study also highlights examples of traditional rituals in the Jambi Province, such as Kenduri Sko and Bantai Adat, which illustrate how customary law is implemented in the daily lives of indigenous communities, while also facing the challenges of modernization. Traditional rituals are an integral part of the legal mechanisms in indigenous societies, serving not only as a means of regulating behavior but also as a medium for restoring social harmony and community spirituality.

Abstract

Penulisan ini bertujuan untuk mengetahui pencegahan politik uang di Indonesia, karena politik uang dapat membuat pemilih tidak lagi memilih berdasarkan pertimbangan rasional, melainkan hanya berdasarkan uang, Metode penelitian yang digunakan adalah metode yuridis normatif yakni metode penelitian yang digunakan untuk menganalisis hukum positif, yaitu hukum yang tertulis dalam peraturan perundang-undangan. Metode ini didasarkan pada asumsi bahwa hukum adalah aturan yang mengikat dan harus ditaati oleh masyarakat. Hasil penelitian yang didapat yaitu Politik uang dapat dilakukan oleh berbagai pihak, baik oleh kandidat, partai politik, maupun oknum penyelenggara pemilu. Praktik ini dapat dilakukan dengan berbagai cara, seperti memberikan uang, barang, atau jasa kepada pemilih. Dampak politik uang bagi demokrasi Indonesia sangatlah negatif. Politik uang dapat menyebabkan terpilihnya pemimpin yang tidak berkualitas, meningkatkan biaya pemilu, dan meningkatkan korupsi. Untuk mencegah politik uang, perlu dilakukan upaya-upaya yang komprehensif, baik dari sisi hukum, kelembagaan, maupun masyarakat. Masyarakat perlu mengetahui bahwa politik uang dapat merusak demokrasi. Dengan adanya upaya-upaya tersebut, diharapkan politik uang dapat ditekan dan proses penyelenggaraan pemilu dapat berjalan dengan lancar dan jujur.

Abstract

This research aims to analyze the legal protection for applicants of the Civil Servant Candidates (CPNS) regarding the age limit policy in Indonesia, examining the dualism between its legal basis and the potential for discrimination from a Human Rights (HAM) perspective. This study employs a normative juridical research method with a statutory and conceptual approach. Data were qualitatively analyzed from primary legal materials, such as Law No. 5 of 2014 and Government Regulation No. 11 of 2017, as well as secondary legal materials. The findings indicate that while the age limit policy is strongly grounded in law and administrative rationality for efficiency and productivity, it inherently risks creating age-based discrimination. This rigid policy conflicts with the non-discrimination principle in human rights as it may exclude competent candidates based on age stereotypes. The impact of this research is a recommendation for the government to re-evaluate the existing policy towards a more flexible, substantive, and competency-focused recruitment system to ensure justice and equal opportunities for all citizens.

Abstract

Professional village governance demands a comprehensive understanding from village officials of the regulations that govern their duties and functions. However, the reality on the ground shows a significant knowledge gap. This community service program aims to enhance the legal literacy and capacity of the officials of Tanjung Mudo Village, Jangkat Timur District, through advocacy on personnel regulations. The program was conducted on March 3-4, 2025, using a participatory method that combined interactive lectures, case studies, and Focus Group Discussions (FGDs). To measure the program's impact, pre-test and post-test instruments were utilized. The initial assessment results showed an average participant score of only 48 out of 100, indicating a low level of understanding regarding their rights, obligations, and personnel procedures. Following the advocacy program, there was a very significant increase in understanding, with the average post-test score jumping to 85 out of 100. This improvement proves that the applied advocacy method was effective in bridging the knowledge gap, thereby empowering village officials to work more professionally, accountably, and in accordance with the prevailing legal framework.
