Abstract

Introduction: This article discusses the position of the Constitutional Court (MK) in Indonesia in the context of the attempts to weaken it and its impact on law and democracy.Purposes of the Research: This research identifies several factors that contribute to the Constitutional Court's challenges, such as political interference, corruption, and legislation that harms the institution's independenceMethods of the Research: Using literature methods, this research analyzes various secondary sources, including books, academic articles, and official reports relating to constitutional and judicial issuesResults of the Research: Weakening of the Constitutional Court (MK) can be divided into two categories: external and internal. External factors include the lack of strengthening authority in the Constitutional Court Law, political efforts in appointing judges, and the removal of judges by the DPR without legal basis. Meanwhile, internal factors come from ethical violations of judges affiliated with politics and inconsistencies in decisions. Strengthening the Constitutional Court institution is needed through a transparent judge selection process and supervision from the Judicial Commission, concluding that efforts to strengthen the Constitutional Court are very important in maintaining justice and democracy in Indonesia. Recommendations are proposed to increase the independence and accountability of the Constitutional Court, including the need for structural reform and strengthening supervisory mechanisms. Thus, this research contributes to understanding the importance of the role of the Constitutional Court in a healthy legal system and democracy.

Abstract

Raja Ampat, sebuah kawasan United Nations Educational, Scientific and Cultural Organization Global Geopark (UNESCO Global Geopark), kini terancam degradasi ekologis oleh ekspansi tambang nikel. Penelitian ini menganalisis dasar hukum pencabutan izin tambang melalui perspektif hukum lingkungan, dengan menitikberatkan pada prinsip kehati-hatian (precautionary principle). Metode yang digunakan ialah yuridis-normatif dengan pendekatan perundang-undangan dan konseptual. Hasil kajian menegaskan bahwa keputusan pemerintah pusat mencabut izin tidak sekadar tindakan administratif, melainkan implementasi nyata prinsip kehati-hatian yang berakar pada Undang-Undang (UU) No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, serta dipertegas lewat yurisprudensi terkini. Kebaruan riset ini terletak pada pemetaan hubungan normatif antara prinsip kehati-hatian dan perlindungan geopark, sehingga memperluas cakupan teoretis prinsip tersebut bagi ekoregion khusus sekaligus memperkuat legitimasi kebijakan di wilayah sensitif. Rekomendasi meliputi penyusunan regulasi khusus geopark, penguatan zona penyangga dalam Rencana Tata Ruang Wilayah (RTRW), dan pelibatan masyarakat adat sebagai pengawas partisipatif.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan, dasar hukum, serta kecenderungan penggunaan Instruksi Presiden (Inpres) yang berimplikasi pada perluasan kekuasaan eksekutif di luar batas kewenangan konstitusional. Inpres selama ini digunakan sebagai alat kebijakan presiden, namun dalam praktiknya seringkali menimbulkan efek normatif ke luar, meskipun tidak termasuk dalam hierarki peraturan perundang-undangan. Fenomena ini menimbulkan ketidakpastian hukum dan membuka peluang penyalahgunaan wewenang, terutama ketika Inpres dipakai sebagai dasar tindakan publik tanpa pengawasan legislatif maupun yudisial. Penelitian ini bersifat yuridis normatif dengan pendekatan terhadap peraturan perundang-undangan dan teori hukum, didukung dengan analisis dua studi kasus Inpres, yaitu Inpres No. 6 Tahun 2020 dan Inpres No. 3 Tahun 2023. Kebaruan dari penelitian ini terletak pada penilaian kritis terhadap efek normatif Inpres dalam kerangka teori Hans Kelsen serta identifikasi kekosongan mekanisme kontrol terhadap tindakan eksekutif berbasis Inpres. Hasil penelitian menunjukkan bahwa Inpres cenderung digunakan melebihi fungsi administratifnya, berpotensi menimbulkan regulasi semu (quasi-regulation), dan memerlukan pembatasan yang tegas melalui reformulasi norma dalam sistem hukum nasional.

Abstract

The appointment of active TNI (Indonesian National Armed Forces) officers to civilian positions has sparked controversy within Indonesia’s legal and democratic framework. The 1998 Reform Movement emphasized the restriction of military involvement in civilian governance, as stipulated in Law Number 34 of 2004 concerning the TNI. However, legal loopholes allow active-duty officers to occupy civilian posts under certain conditions, as reflected in the appointment of the Cabinet Secretary pursuant to Presidential Regulation Number 148 of 2024. This study analyzes the policy from a legal-political perspective by examining regulatory inconsistencies and the implications for civilian supremacy. The research employs a normative juridical method with political, statutory, and conceptual approaches. The findings indicate that the appointment of active-duty military personnel to civilian positions lacks clear urgency and contradicts the principle of civilian supremacy in a democratic system. Furthermore, this policy reflects a tug-of-war between political stability and the interests of ruling elites, potentially hindering military reform and creating regulatory overlaps. Therefore, clearer and more consistent regulations are needed to maintain the balance between national interests and civilian supremacy within Indonesia’s legal system.
