Abstract

An effort to develop village tourism potential is not a simple issue. This development requires careful planning and proper management. The purpose of this research is to formulate a synergy model that engages the village government and village consultative agency elements in the development of village tourism potential. This study takes Baturraden Sub-District, Banyumas Regency, as its research location. Baturraden Sub-District boasts a famous tourism destination, Baturraden Tourist Attraction, and 12 (twelve) villages with tourism potential in its surroundings. In this case, the village government (Pemdes) and Village Consultative Agency (BPD) play a vital role in building synergy to arrange a village tourism potential exploration policy. This legal research employs a qualitative approach, combined interview to collect the data, FGD, a document study, and observation. The research results find that BPD, which takes its role in village discussion, attempts to explore and develop village tourism potential by engaging all stakeholders. Keywords:synergy, village consultative agency, village government, village tourism

Abstract

Legislation set two mechanisms of review or oversight of local regulations, the executive and ju-dicial review. Executive authority to oversee the review of local regulations is owned by the govern-ment (executive power), while the judicial review of the authority overseeing local regulation held by the Supreme Court (judicial power). Both of these mechanisms may lead to the cancellation rules of the regulation is contrary regional.Research districts/cities were canceled by the Minister of domestic affairs who then filed a judicial review to the Supreme Court and its effect on empower-ment regional. Approach used are normative and case studies. Secondary data to primary data.Data were collected by the research literature and several areas as places research. Result research shows that the implementation of the right of judicial review of Regulation Regency/negative effect on local empowerment. Key words: supervision, regulation rights judicial region, regional empowerment

Abstract

Diundangkannya UU No. 6 Tahun 2014 tentang Desa memberi peluang bagi pengembangan otonomi desa yang demokratis. Penelitian ini mengangkat dua permasalahan, yakni pertama bagaimana pelaksanaan partisipasi masyarakat desa dalam penyelenggaraan pemerintahan desa?, kedua bagaimanakah implikasi pelaksanaan Undang-Undang No. 6 Tahun 2014 tentang Desa terhadap pengembangan model partisipasi masyarakat dalam penyelenggaraan pemerintahan desa? Metode penelitian yuridis empiris. Penelitian dilakukan di tiga kecamatan yaitu Kecamatan Sumpiuh, Banyumas dan Gumelar. Hasil penelitian menunjukkan bahwa pertama, partisipasi masyarakat diwujudkan dalam bentuk interaksi langsung melalui rembug desa di tingkat RT, maupun melalui unsur keterwakilan seperti BPD, PKK. Kedua, partisipasi masyarakat mengarah pada bentuk keterwakilan, maka disarankan untuk dilakukan peningkatan kualitas SDM lembaga kemasyarakatan di desa.

Abstract

Janggolan village is a village with limited locally generated revenue. In Sumpiuh sub-district there are 14 villages, 3 of which are the village of Janggolan. Village Fund Provision Policy in Law Number 6 Year 2014 on Villages affect on the performance of village apparatus and the quality of village community participation, while the Village Consultative Board (BPD) is expected to be an institution capable of playing role in village development. The problem is how the role of BPD in the implementation of Village Governance in the Janggolan village. The research was conducted by applying qualitative method with action research strategy. The results show that the Village Funds assisted the physical village development and work scheme but did not change the people attitude. BPD makes use of rembug warga (deliberation), selapanan (a traditional ceremony to commemorate a 35-day-old baby), and village meetings to accommodate aspirations and control the village. Yet they do not solve the village problems. The role of BPD in Janggolan village more focused on the absorption of people's aspirations. The internal constraints are low quality of members of BPD while the external constraints that BPD has not effectively performed. Keywords : deliberation, governance, societal participation.

Abstract

Pemilihan kepala daerah langsung ternyata tak kunjung menjamin adanya keadilan sosial bagi seluruh rakyat di daerah secara otomatis. Pemilihan kepala daerah secara langsung justeru memicu masalah-masalah baru yang pelik seperti: pertama, munculnya sengketa horizontal di tingkat lokal dan kedua banyak anggaran yang dibuang percuma tanpa jaminan terpilihnya pemimpin yang komitmen kepada rakyat. UUD 1945 maupun UU No.32/2004 telah mengakui bahwa Pemilihan Kepala Daerah (Pemilihan Bupati – UU No. 15 Tahun 2011 Pasal 1 angka 4) adalah Pemilihan Umum. Untuk menjamin dan memastikan suatu pemilu yang demokratis, selain diterapkannya asas langsung, umum, bebas, rahasia, jujur dan adil, juga diperlukan pemisahan yang tegas antara rezim hukum pemilu dengan rezim hukum pemerintahan. Pemisahan ini penting agar proses pemilu dan proses pemerintahan tidak saling mempengaruhi, sehingga hasil pemilu maupun kebijakan pemerintahan mencerminkan proses demokrasi yang murni sebagai perwujudan kedaulatan rakyat sebagaimana digariskan pada UUD 1945 Pasal 1 ayat . Oleh karena itu diperlukan desain ketatanegaraan untuk menjamin pemilikada yang bersih, demokratis dan bermartabat. Kata Kunci: Desain Ketatanegaraan dan Pemilikada. .

Abstract

Community based waste management (PSBM) is a waste management approach based on community’s needs and demand and is planned, carried out (if possible), controlled and evaluated jointly by the community. An increase in population is always followed with increasing volume of waste, which requires change in the waste management especially from the old paradigm (collect – transport – dispose of) to the new paradigm of 3R concept (reduce, reuse, recycle). The 3R waste management pattern is implemented through waste bank empowerment by involving all elements of the community. Law Number 18 Year 2008 on Waste Management and Regulation of the Minister of Environment Number 13 Year 2021 on the Guidelines on Reduce, Reuse and Recycle Implementation through Waste Bank has opened the opportunity for public participation in waste management. All this times the Government of Banyumas Regency has applied waste management technical policies several times, but there is no express legal policy about the existence of Waste Bank. The Government of Banyumas Regency currently still prioritizes big scale waste management through a hangar system. The potential of Waste Bank as one waste conscious group and as an alternative whose role can be optimized especially in community-based waste reduction management has not got attention.Keywords: Role, Waste Bank, Domestic Waste.

Abstract

Industrial waste is considered to have a higher economic value. The cigarette industry is a large industry that involves thousands of workers, so it is necessary to carry out good waste/garbage management so as not to pollute the surrounding environment. The Ministry of National Development Planning/BAPPENAS in collaboration with United Nations Development Program (UNDP) and supported by the Government of Denmark, launched a new concept on the development of a Circular Economy in Indonesia. The circular economy encourages a business model oriented to Reduce, Reuse, Recycle, Recovery and Repair (5R). The implementation of 5R concept approach can reduce the consumption of new materials by up to 30% in 2035 and 50% in 2050. This study aims to find out how to implement a sustainable waste management strategy using the 5R concept in the Cigarette Industry. The data were collected by means of observation and interviews with cigarette factory PT. X, The Department of Housing and Settlements and Environment Kebumen Regency and academics. The method used is descriptive analysis quantitative, and Analytical Hierarchy Process (AHP). The results of this study show that during 2020, the average amount of waste generated in the cigarette factory of PT. X 1405.21 kg/month with the composition of waste in January 2021 consisting of 5.3% of category A waste; 5.5% category B; 51.3% category C; 1% category D; 36.5% category E; and 0.5% category F. Waste management in the cigarette factory of PT. X is broadly in accordance with Presidential Regulation No. 97 of 2017 regarding Indonesian National Strategy Policy on Managing Domestic Waste and Domestic Waste Equivalents. The suggested main alternative strategy is by using good/raw material in accordance with the procedure.

Abstract

Fulfilling communal rights to customary lands has still become an unresolved polemic. As a country adhering to Pancasila ideology, all laws and regulations should embody in Pancasila, including regulation on Agrarian Reform. This research aimed to figure out the reduction of values found in the 2nd principle of Pancasila against the Presidential Regulation Number 86 Year 2018 concerning Agrarian Reform in the context of fulfilling communal rights of indigenous peoples to customary lands. The research used a normative-juridical method with both statutory and analytical approaches. This research specifically examined and analyzed the reduction of values in the second principles of Pancasila toward the regulation of agrarian reform in Indonesia. The data sources were in the form of secondary data to obtain objective research results including primary, secondary, and tertiary legal materials obtained through documents and literatures. The collected data were then qualitatively analyzed and presented in the forms of narrative text. By implementing the second principle of Pancasila, the communal rights to customary lands are fulfilled in Agrarian Reform and become the basis to strengthen the position of indigenous peoples in national legal system.
